An act to amend Section 18966 of the Welfare and Institutions Code, relating to children.

AB 2187, as amended, Cooley. County children’s trust funds.

Existing law requires that specified fees be paid by certain applicants for certified copies of birth certificates. Existing law provides that $4 of each fee be paid to either a county children’s trust fund or to the State Children’s Trust Fund, to fund child abuse and neglect prevention and intervention programs. Existing law requires a county treasurer to transmit moneys collected from birth certificate fees that are for the county children’s trust fund and that are collected with respect to the birth certificate of a child whose mother was a resident of another county at the time of the birth to the treasurer of the county of the mother’s residence at the time of the birth if the county to receive the funds, among other things, does not have a licensed health facility that provides maternity services within its jurisdiction.

This bill would delete the requirement that the county to receive the funds does not have a licensed health facility that provides maternity services within its jurisdictionbegin insert, as specifiedend insert.

SECTION 1.  

Section 18966 of the Welfare and Institutions

is amended to read:

18966.  

(a) When a county board of supervisors designates a
4commission pursuant to Section 18965, the board of supervisors
5shall establish a county children’s trust fund. The children’s trust
6fund shall consist of the fees for birth certificates, collected
7pursuant to Section 103625 of the Health and Safety Code, grants,
8gifts, or bequests from private sources to be used for child abuse
9and neglect prevention and intervention programs, any funds
10appropriated by local governmental entities to the trust fund, and
11any funds appropriated to the county for the trust fund by the
12Legislature. The local registrar or county recorder may, however,
13retain a percentage, not to exceed 10 percent, of the surcharge
14collectible pursuant to subdivision (b) of Section 103625 of the
15Health and Safety Code, in order to defray the costs of collection.

24(2) Paragraph (1) applies only to the collection and payment
25of the four-dollar ($4) fee to the county children’s trust fund,
26pursuant to subdivision (b) of Section 103625 of the Health and
27Safety Code, and does not apply to the collection and payment of
28the two-dollar ($2) fee to the Umbilical Cord Blood Collection
29Program Fund or any other assessment authorized by statute and
30levied by a local jurisdiction.
