An act to amend Sections 4980.72, 4980.78, 4980.80, 4980.90, 4999.57, 4999.58, 4999.59, 4999.60, and 4999.62 of, and to add Sections 4980.79, 4980.81, and 4999.63 to, the Business and Professions Code, relating to behavioral health care licensees.

(1) Under existing law, the Board of Behavioral Sciences licenses and regulate marriage and family therapists and licensed professional clinical counselors. Existing law requires an applicant for either license to complete specified numbers of hours of supervised experience, and requires an applicant to register with the board as a marriage and family therapist intern or a licensed professional clinical counselor intern, respectively, in order to be credited for postdegree hours of supervised experience gained toward licensure.

The board may issue a marriage and family therapist license to a person who holds a valid license in good standing issued by an out-of-state board of marriage counselor examiners, board of marriage and family therapists, or corresponding authority, who satisfies specified conditions applicable to a person applying on or after January 1, 2016. These conditions include that the applicant’s education is substantially equivalent to that required of in-state applicants. Under existing law, education is deemed substantially equivalent if specified coursework requirements and practicum requirements are satisfied. Under existing law an applicant is required to satisfy these requirements through graduate level coursework, and remediate any deficiencies in these requirements prior to registering with the board as an intern.

This bill would allow an out-of-state applicant to remediate specified coursework requirements through continuing education, and to remediate specified coursework while registered as an intern. The bill would specify hour or unit requirements for certain coursework requirements. The bill would allow an applicant to remediate the practicum requirements if the applicant holds a license as described above.

(2) Existing law requires a marriage and family therapist applicant who completes his or her degree on or after August 1, 2012, to complete 60 semester units or 90 quarter units of instruction.

This bill would allow those applicants to remediate up to 12 semester units or 18 quarter units while the applicant is registered as an intern.

(3) Existing law requires a marriage and family therapist applicant who obtained his or her degree prior to August 1, 2012, to complete 60 semester or 90 quarter units of instruction.

This bill would allow those applicants to satisfy the degree requirement by completing 48 semester or 72 quarter units of instruction.

(4) Under existing law the board may issue professional clinical counselor license to a person who holds a valid license as a professional clinical counselor, or other counseling license that allows the applicant to independently provide clinical mental health services out of state who satisfies specified conditions applicable to a person applying on or after January 1, 2016. Those conditions include that the applicant’s education is substantially equivalent to that required of in-state applicants. Under existing law, education is deemed substantially equivalent if specified coursework requirements are satisfied. An applicant is required to satisfy these requirements through graduate level coursework, and remediate any deficiencies in these requirements prior to registering with the board as an intern.

This bill would require those out-of-state applicants to satisfy the degree requirement by completing 60 semester or 90 quarter units of instruction, and would allow those applicants to remediate up to 12 semester or 18 quarter units.

The bill would also make technical, nonsubstantive and conforming changes.

SECTION 1.  

Section 4980.72 of the Business and Professions
2Code
is amended to read:

4980.72.  

(a) This section applies to persons who are licensed
4outside of California and apply for licensure on or after January
51, 2016.

6(b) The board may issue a license to a person who, at the time
7of submitting an application for a license pursuant to this chapter,
8holds a valid license in good standing issued by a board of marriage
9counselor examiners, board of marriage and family therapists, or
10corresponding authority, of any state or country, if all of the
11following conditions are satisfied:

12(1) The applicant’s education is substantially equivalent, as
13defined in Sectionbegin delete 4980.78.end deletebegin insert 4980.79.end insert The applicant’s degree title
14need not be identical to that required by Section 4980.36 or
154980.37.

16(2) The applicant complies with Section 4980.76, if applicable.

17(3) The applicant’s supervised experience is substantially
18equivalent to that required for a license under this chapter. The
19board shall consider hours of experience obtained outside of
20California during the six-year period immediately preceding the
21date the applicant initially obtained the license described above.

23experience, time actively licensed as a marriage and family
24therapist shall be accepted at a rate of 100 hours per month, up
P4    1to a maximum of 1,200 hours, if the applicant’s degree meets the
2practicum requirement described in subparagraph (C) of
3paragraph (1) of subdivision (b) of Section 4980.79 without
4exemptions or remediation.end insert

5(4) The applicant passes the California law and ethics
6examination.

7(5) The applicant passes a clinical examination designated by
8the board. An applicant who obtained his or her license or
9registration under another jurisdiction may apply for licensure with
10the board without taking the clinical examination if both of the
11following conditions are met:

12(A) The applicant obtained a passing score on the licensing
13examination set forth in regulation as accepted by the board.

14(B) The applicant’s license or registration in that jurisdiction is
15in good standing at the time of his or her application and has not
16been revoked, suspended, surrendered, denied, or otherwise
17restricted or encumbered as a result of any disciplinary proceeding
18brought by the licensing authority of that jurisdiction.

SEC. 2.  

Section 4980.78 of the Business and Professions Code
20 is amended to read:

(a) This section applies to persons who apply for

Section 4980.79 is added to the Business and

26a license as described in Section 4980.72.

27(b) For purposes of Section 4980.72, education is substantially
28equivalent if all of the following requirements are met:

29(1) The degree is obtained from a school, college, or university
30accredited by an accrediting agency recognized by the United
31States Department of Education and consists of, at a minimum,
32the following:

33(A) For an applicant who obtained his or her degree within the
34timeline prescribed by subdivision (a) of Section 4980.36, the

5(iii) Six semester or nine quarter units of practicum, including,
6but not limited to, a minimum of 150 hours of face-to-face
7counseling, and an additional 75 hours of either face-to-face
8counseling or client-centered advocacy, as specified in
9subparagraph (B) of paragraph (1) of subdivision (d) of Section
104980.36.

11(I) An out-of-state applicant who has been licensed for at least
12two years in clinical practice, as verified by the board, is exempt
13from this requirement.

14(II) An out-of-state applicant who has been licensed for less
15than two years in clinical practice, as verified by the board, who
16does not meet the practicum requirement, shall remediate it by
17obtaining 150 hours of face-to-face counseling, and an additional
1875 hours of either face-to-face counseling or client-centered
19advocacy, as specified in subparagraph (B) of paragraph (1) of
20subdivision (d) of Section 4980.36. These hours are in addition to
21the 3,000 hours of experience required by this chapter, and shall
22be gained while registered as an intern.

23(B) Twelve semester or 18 quarter units in the subject of
24marriage, family, and child counseling and marital and family
25systems approaches to treatment, as specified in subparagraph (A)
26of paragraph (1) of subdivision (d) of Section 4980.36.

27(2) An applicant shall complete coursework in California law
28and ethics as follows:

29(A) An applicant who completed a course in law and
30professional ethics for marriage and family therapists as specified
31in paragraph (7) of subdivision (a) of Section 4980.81 that did not
32include instruction in California law and ethics, shall complete an
3318-hour course in California law and professional ethics. The
34content of the course shall include, but not be limited to,
35advertising, scope of practice, scope of competence, treatment of
36minors, confidentiality, dangerous patients, psychotherapist-patient
37privilege, recordkeeping, patient access to records, state and federal
38laws relating to confidentiality of patient health information, dual
39relationships, child abuse, elder and dependent adult abuse, online
40therapy, insurance reimbursement, civil liability, disciplinary
P9    1actions and unprofessional conduct, ethics complaints and ethical
2standards, termination of therapy, standards of care, relevant family
3law, therapist disclosures to patients, differences in legal and ethical
4standards in different types of work settings, and licensing law
5and licensing process. This coursework shall be completed prior
6to registration as an intern.

7(B) An applicant who has not completed a course in law and
8professional ethics for marriage and family therapists as specified
9in paragraph (7) of subdivision (a) of Section 4980.81 shall
10complete this required coursework. The coursework shall include
11content specific to California law and ethics. An applicant shall
12complete this coursework registration as an intern.

13(3) The applicant completes the educational requirements
14specified in Section 4980.81 not already completed in his or her
15education. The coursework may be from an accredited school,
16college, or university as specified in paragraph (1), from an
17educational institution approved by the Bureau for Private
18Postsecondary Education, or from a continuing education provider
19that is acceptable to the board as defined in Section 4980.54. The
20content of this coursework shall be of a graduate level.

21(4) The applicant completes the following coursework not
22already completed in his or her education from an accredited
23school, college, or university as specified in paragraph (1) above,
24from an educational institution approved by the Bureau for Private
25Postsecondary Education, or from a continuing education provider
26that is acceptable to the board as defined in Section 4980.54. The
27content of this coursework shall be of a graduate level.

28(A) At least three semester units, or 45 hours, of instruction
29pertaining to the principles of mental health recovery-oriented care
30and methods of service delivery in recovery-oriented practice
31environments, including structured meetings with various
32consumers and family members of consumers of mental health
33services to enhance understanding of their experience of mental
34illness, treatment, and recovery.

35(B) At least one semester unit, or 15 hours, of instruction that
36includes an understanding of various California cultures and the
37social and psychological implications of socioeconomic position.

38(5) An applicant's degree title need not be identical to that
39required by subdivision (b) of Section 4980.36.

2requirements required under paragraphs (3) and (4) not already
3completed in his or her education while registered as an intern,
4unless otherwise specified.

SEC. 4.  

Section 4980.80 of the Business and Professions Code
6 is amended to read:

4980.80.  

(a) This section applies to persons who apply for
8licensure between January 1, 2010, and December 31, 2015,
9inclusive.

10(b) The board may issue a license to a person who, at the time
11of application, holds a valid license issued by a board of marriage
12counselor examiners, marriage therapist examiners, or
13corresponding authority of any state, if all of the following
14requirements are satisfied:

15(1) The person has held that license for at least two years
16immediately preceding the date of application.

17(2) The education and supervised experience requirements are
18substantially the equivalent of this chapter.begin insert If an applicant has less
19than 3,000 hours of qualifying supervised experience, time actively
20licensed as a marriage and family therapist shall be accepted at
21a rate of 100 hours per month up to a maximum of 1,200 hours.end insert

22(3) The person complies with Section 4980.76, if applicable.

23(4) The person successfully completes the board administered
24licensing examinations as specified by subdivision (d) of Section
254980.40 and pays the fees specified.

26(5) The person completes all of the following coursework or
27training:

28(A) (i) An applicant who completed a two semester or three
29quarter unit course in law and professional ethics for marriage and
30family therapists that does not meet the requirements of Section
314980.41 as part of his or her qualifying degree shall complete an
3218-hour course in California law and professional ethics that
33includes, but is not limited to, the following subjects: advertising,
34scope of practice, scope of competence, treatment of minors,
35confidentiality, dangerous patients, psychotherapist-patient
36privilege, recordkeeping, patient access to records, state and federal
37laws relating to the confidentiality of patient health information,
38dual relationships, child abuse, elder and dependent adult abuse,
39online therapy, insurance reimbursement, civil liability, disciplinary
40actions and unprofessional conduct, ethics complaints and ethical
P11   1standards, termination of therapy, standards of care, relevant family
2law, and therapist disclosures to patients.

3(ii) An applicant who has not completed a two semester or three
4quarter unit course in law and professional ethics for marriage and
5family therapists that included areas of study as specified in Section
64980.41 as part of his or her qualifying degree, shall complete a
7two semester or three quarter unit course in California law and
8professional ethics that includes, at minimum, the areas of study
9specified in Section 4980.41.

10(B) A minimum of seven contact hours of training or coursework
11in child abuse assessment and reporting as specified in Section 28
12and any regulations promulgated thereunder.

13(C) A minimum of 10 contact hours of training or coursework
14in human sexuality as specified in Section 25 and any regulations
15promulgated thereunder.

16(D) A minimum of 15 contact hours of training or coursework
17in alcoholism and other chemical substance dependency as
18specified by regulation.

19(E) (i) Instruction in spousal or partner abuse assessment,
20detection, and intervention. This instruction may be taken either
21in fulfillment of other requirements for licensure or in a separate
22course.

23(ii) A minimum of 15 contact hours of coursework or training
24in spousal or partner abuse assessment, detection, and intervention
25strategies.

26(F) A minimum of a two semester or three quarter unit survey
27course in psychological testing. This course may be taken either
28in fulfillment of other requirements for licensure or in a separate
29course.

30(G) A minimum of a two semester or three quarter unit survey
31course in psychopharmacology. This course may be taken either
32in fulfillment of other requirements for licensure or in a separate
33course.

34(H) With respect to human sexuality, alcoholism and other
35chemical substance dependency, spousal or partner abuse
36assessment, detection, and intervention, psychological testing, and
37psychopharmacology, the board may accept training or coursework
38acquired out of state.

P12   1(c) This section shall remain in effect only until January 1, 2016,
2and as of that date is repealed, unless a later enacted statute, that
3is enacted before January 1, 2016, deletes or extends that date.

SEC. 5.  

Section 4980.81 is added to the Business and
5Professions Code
, to read:

6

4980.81.  

This section applies to persons subject to Section
74980.78 or 4980.79, who apply for licensure or registration on or
8after January 2016.

9(a) For purposes of Sections 4980.78 and 4980.79, an applicant
10shall meet all of the following educational requirements:

11(1) A minimum of two semester units of instruction in the
12diagnosis, assessment, prognosis, and treatment of mental
13disorders, including severe mental disorders, evidence-based
14practices, psychological testing, psychopharmacology, and
15promising mental health practices that are evaluated in peer
16reviewed literature. This shall include at least one semester unit
17or 15 hours of instruction in psychological testing and at least one
18semester unit or 15 hours of instruction in psychopharmacology.

19(2) (A) Developmental issues from infancy to old age, including
20demonstration of at least one semester unit, or 15 hours, of
21instruction that includes all of the following subjects:

22(i) The effects of developmental issues on individuals, couples,
23and family relationships.

24(ii) The psychological, psychotherapeutic, and health
25implications of developmental issues and their effects.

26(iii) The understanding of the impact that personal and social
27insecurity, social stress, low educational levels, inadequate housing,
28and malnutrition have on human development.

29(B) An applicant who is deficient in any of these subjects may
30 remediate the coursework by completing three hours of instruction
31in each deficient subject.

32(3) (A) The broad range of matters and life events that may
33arise within marriage and family relationships and within a variety
34of California cultures, including instruction in all of the following:

35(i) A minimum of seven contact hours of training or coursework
36in child abuse assessment and reporting as specified in Section 28
37and any regulations promulgated under that section.

38(ii) A minimum of 10 contact hours of coursework that includes
39all of the following:

P13   1(I) The assessment and reporting of, as well as treatment related
2to, elder and dependent adult abuse and neglect.

3(II) Aging and its biological, social, cognitive, and psychological
4aspects.

5(III) Long-term care.

6(IV) End-of-life and grief.

7(iii) A minimum of 15 contact hours of coursework in spousal
8or partner abuse assessment, detection, intervention strategies, and
9same gender abuse dynamics.

10(iv) Cultural factors relevant to abuse of partners and family
11members.

12(v) Childbirth, child rearing, parenting, and stepparenting.

13(vi) Marriage, divorce, and blended families.

14(vii) Poverty and deprivation.

15(viii) Financial and social stress.

16(ix) Effects of trauma.

17(x) The psychological, psychotherapeutic, community, and
18health implications of the matters and life events described in
19clauses (i) to (ix), inclusive.

20(4) At least one semester unit, or 15 hours, of instruction in
21multicultural development and cross-cultural interaction, including
22experiences of race, ethnicity, class, spirituality, sexual orientation,
23gender, and disability, and their incorporation into the
24psychotherapeutic process.

25(5) A minimum of 10 contact hours of training or coursework
26in human sexuality, as specified in Section 25 and any regulations
27promulgated under that section, including the study of
28physiological, psychological, and social cultural variables
29associated with sexual behavior and gender identity, and the
30assessment and treatment of psychosexual dysfunction.

31(6) A minimum of 15 contact hours of coursework in substance
32use disorders, and a minimum of 15 contact hours of coursework
33in cooccurring disorders and addiction. The following subjects
34shall be included in this coursework:

35(A) The definition of substance use disorders, cooccurring
36disorders, and addiction. For purposes of this subparagraph
37“cooccurring disorders” means a mental illness and substance
38abuse diagnosis occurring simultaneously in an individual.

39(B) Medical aspects of substance use disorders and cooccurring
40disorders.

P14   1(C) The effects of psychoactive drug use.

2(D) Current theories of the etiology of substance abuse and
3addiction.

4(E) The role of persons and systems that support or compound
5substance abuse and addiction.

6(F) Major approaches to identification, evaluation, and treatment
7of substance use disorders, cooccurring disorders, and addiction,
8including, but not limited to, best practices.

9(G) Legal aspects of substance abuse.

10(H) Populations at risk with regard to substance use disorders
11and cooccurring disorders.

12(I) Community resources offering screening, assessment,
13treatment, and followup for the affected person and family.

14(J) Recognition of substance use disorders, cooccurring

SEC. 6.  

Section 4980.90 of the Business and Professions Code

25(2) A minimum of seven contact hours of training or coursework
26in child abuse assessment and reporting as specified in Section 28
27and any regulations promulgated thereunder.

28(3) A minimum of 10 contact hours of training or coursework
29in sexuality as specified in Section 25 and any regulations
30promulgated thereunder.

31(4) A minimum of 15 contact hours of training or coursework
32in alcoholism and other chemical substance dependency as
33specified by regulation.

34(5) (A) Instruction in spousal or partner abuse assessment,
35detection, and intervention. This instruction may be taken either
36in fulfillment of other educational requirements for licensure or
37in a separate course.

38(B) A minimum of 15 contact hours of coursework or training
39in spousal or partner abuse assessment, detection, and intervention
40strategies.

P16   1(6) A minimum of a two semester or three quarter unit survey
2course in psychological testing. This course may be taken either
3in fulfillment of other requirements for licensure or in a separate
4course.

5(7) A minimum of a two semester or three quarter unit survey
6course in psychopharmacology. This course may be taken either

9(8) With respect to human sexuality, alcoholism and other
10chemical substance dependency, spousal or partner abuse

12psychopharmacology, the board may accept training or coursework
13acquired out of state.

14(d) For purposes of this section, the board may, in its discretion,
15accept education as substantially equivalent if the applicant meets
16both of the following requirements:

17(1) The applicant has been granted a degree in a single integrated
18program primarily designed to train marriage and family therapists.

19(2) The applicant’s education meets the requirements of Section
204980.37. The degree title need not be identical to that required by
21subdivision (b) of Section 4980.37. If the applicant’s degree does
22not contain the content or the overall units required by Section
234980.37, the board may, in its discretion, accept the applicant’s
24education as substantially equivalent if the following criteria are
25satisfied:

26(A) The applicant’s degree contains the required number of
27practicum units and coursework required in the areas of marriage,
28family, and child counseling and marital and family systems
29approaches to treatment as specified in Section 4980.37.

30(B) The applicant remediates his or her specific deficiency by
31completing the course content and the units required by Section
324980.37.

33(C) The applicant’s degree otherwise complies with this section.

34(e) This section shall remain in effect only until January 1, 2016,
35and as of that date is repealed, unless a later enacted statute, that
36is enacted before January 1, 2016, deletes or extends that date.

16the other jurisdiction are substantially the equivalent of this chapter,
17as described in subdivision (e) and in Section 4999.46.

18(2) The person complies with subdivision (b) of Section 4999.40,
19if applicable.

20(3) The person successfully completes the examinations required
21by the board pursuant to paragraph (3) of subdivision (a) of Section
224999.50. An applicant who obtained his or her license or
23registration under another jurisdiction by taking a national
24examination that is required by the board may apply for licensure
25with the board without retaking that examination if both of the
26following conditions are met:

27(A) The applicant obtained a passing score on the national
28licensing examination that is required by the board.

29(B) The applicant’s license or registration in that jurisdiction is
30in good standing at the time of his or her application and has not
31been revoked, suspended, surrendered, denied, or otherwise
32restricted or encumbered as a result of any disciplinary proceeding
33brought by the licensing authority of that jurisdiction.

34(4) The person pays the required fees.

35(c) Experience gained outside of California shall be accepted
36toward the licensure requirements if it is substantially equivalent
37to that required by this chapter. The board shall consider hours of
38experience obtained in another state during the six-year period

35requirement by demonstrating completion of a total of 280 hours
36of face-to face counseling, as specified in subparagraph (K) of
37paragraph (3) of subdivision (c) of Section 4999.33. Any
38postdegree hours gained to meet this requirement are in addition
39to the 3,000 hours of experience required by this chapter, and shall

3(D) The required subjects specified in subparagraphs (A) to
4(M), inclusive, of paragraph (1) of subdivision (c) of Section
54999.33.

6(i) An applicant whose degree is deficient in any of the required
7subjects specified in subparagraphs (A) to (M), inclusive, of
8paragraph (1) of subdivision (c) may satisfy those deficiencies by
9successfully completing graduate level coursework at an accredited
10or approved institution, as defined in Section 4999.12. Coursework
11taken to meet those deficiencies shall be the equivalent of three
12semester units or four and one-half quarter units of study.

13(ii) An applicant who completed a course in professional
14orientation, ethics, and law in counseling as required by
15subparagraph (I) of paragraph (1) of subdivision (c) of Section
164999.33 that did not contain instruction in California law and ethics
17shall complete an 18-hour course in California law and professional
18ethics that includes, but is not limited to, instruction in advertising,
19scope of practice, scope of competence, treatment of minors,
20confidentiality, dangerous clients, psychotherapist-client privilege,
21recordkeeping, client access to records, state and federal laws
22relating to confidentiality of patient health information, dual
23relationships, child abuse, elder and dependent adult abuse, online
24therapy, insurance reimbursement, civil liability, disciplinary
25actions and unprofessional conduct, ethics complaints and ethical
26standards, termination of therapy, standards of care, relevant family
27law, and therapist disclosures to clients. An applicant shall
28complete this coursework prior to registration as an intern.

29(iii) An applicant who has not completed a course in professional
30orientation, ethics and law in counseling as required by
31subparagraph (I) of paragraph (1) of subdivision (c) of Section
324999.33 shall complete this required coursework, including content
33in California law and ethics. An applicant shall complete this
34coursework prior to registration as an intern.

35(2) The applicant completes any units required under subdivision
36(c) of Section 4999.33 not already completed in his or her education
37as follows:

38(A) At least 15 semester units or 22.5 quarter units of advanced
39coursework to develop knowledge of specific treatment issues or
P28   1special populations. This coursework is in addition to the course
2requirements described in subparagraph (D) of paragraph (1).

3(B) Coursework shall be from an accredited or approved school,
4college, or university as defined in Section 4999.12.

5(3) The applicant completes the following coursework not
6already completed in his or her education:

7(A) A minimum of 10 contact hours of training in human
8sexuality, as specified in Section 25 and any regulations
9promulgated thereunder, including the study of the physiological,
10psychological, and social cultural variables associated with sexual
11behavior, gender identity, and the assessment and treatment of
12psychosexual dysfunction.

13(B) A minimum of 15 contact hours of instruction in spousal
14or partner abuse assessment, detection, intervention strategies, and
15same-gender abuse dynamics.

16(C) A minimum of seven contact hours of training or coursework
17in child abuse assessment and reporting as specified in Section 28
18and any regulations promulgated under that section.

19(D) A minimum of 10 contact hours of instruction in aging and
20long-term care, including biological, social, cognitive, and
21psychological aspects of aging. This coursework shall include
22instruction on the assessment and reporting of, as well as treatment
23related to, elder and dependent adult abuse and neglect.

24(E) This coursework may be from an accredited or approved
25school, college, or university as defined in Section 4999.12, or
26from a continuing education provider that is acceptable to the board
27as defined in Section 4999.76. The content of this coursework shall
28be of a graduate level.

29(4) The applicant completes the following coursework not
30already completed in his or her education from an accredited or
31approved school, college, or university as defined in Section
324999.12, or from a continuing education provider that is acceptable
33to the board as defined in Section 4999.76. The content of this
34coursework shall be of a graduate level.

35(A) At least three semester units or 45 hours of instruction
36regarding the principles of mental health recovery-oriented care
37and methods of service delivery in recovery-oriented practice
38environments, including structured meetings with various
39consumers and family members of consumers of mental health
P29   1services to enhance understanding of their experience of mental
2illness, treatment, and recovery.

3(B) At least one semester unit or 15 hours of instruction that
4includes an understanding of various California cultures and the
5social and psychological implications of socioeconomic position.

6(5) An applicant may complete any units and course content
7requirements required by subparagraph (D) of paragraph (1) or
8paragraphs (2), (3), and (4) not already completed in his or her
9education while registered with the board as an intern, unless
10otherwise specified.
