An act to amend Sections 4980.72, 4980.78, 4980.80, 4980.90, 4999.57, 4999.58, 4999.59, 4999.60, and 4999.62 of, and to add Sections 4980.79, 4980.81, and 4999.63 to, the Business and Professions Code, relating to behavioral health care licensees.

(1) Under existing law, the Board of Behavioral Sciences licenses andbegin delete regulateend deletebegin insert regulatesend insert marriage and family therapists and licensed professional clinical counselors. Existing law requires an applicant for either license to complete specified numbers of hours of supervised experience, and requires an applicant to register with the board as a marriage and family therapist intern or a licensed professional clinical counselor intern, respectively, in order to be credited for postdegree hours of supervised experience gained toward licensure.

The board may issue a marriage and family therapist license to a person who holds a valid license in good standing issued by an out-of-state board of marriage counselor examiners, board of marriage and family therapists, or corresponding authority, who satisfies specified conditions applicable to a person applying on or after January 1, 2016. These conditions include that the applicant’s education is substantially equivalent to that required of in-state applicants. Under existing law, education is deemed substantially equivalent if specified coursework requirements and practicum requirements are satisfied. Under existing law an applicant is required to satisfy these requirements through graduate level coursework, and remediate any deficiencies in these requirements prior to registering with the board as an intern.

This bill would allow an out-of-state applicant to remediate specified coursework requirements through continuing education, and to remediate specified coursework while registered as an intern. The bill would specify hour or unit requirements for certain coursework requirements. The bill would allow an applicant to remediate the practicum requirements if the applicant holds a license as described above.

(2) Existing law requires a marriage and family therapist applicant whobegin delete completesend deletebegin insert beginsend insert his or her degree on or after August 1, 2012, to complete 60 semester units or 90 quarter units of instruction.

This bill would allow those applicants to remediate up to 12 semester units or 18 quarter units while the applicant is registered as an intern.

(3) Existing law requiresbegin delete aend deletebegin insert an out-of-stateend insert marriage and family therapist applicant whobegin delete obtainedend deletebegin insert beganend insert his or her degree prior to August 1, 2012, to complete 60 semester or 90 quarter units of instruction.

This bill would allow those applicants to satisfy the degree requirement by completing 48 semester or 72 quarter units of instruction.

(4) Under existing law the board may issue professional clinical counselor license to a person who holds a valid license as a professional clinical counselor, or other counseling license that allows the applicant to independently provide clinical mental health services out of state who satisfies specified conditions applicable to a person applying on or after January 1, 2016. Those conditions include that the applicant’s education is substantially equivalent to that required of in-state applicants. Under existing law, education is deemed substantially equivalent if specified coursework requirements are satisfied. An applicant is required to satisfy these requirements through graduate level coursework, and remediate any deficiencies in these requirements prior to registering with the board as an intern.

SECTION 1.  

Section 4980.72 of the Business and Professions
2Code
is amended to read:

4980.72.  

(a) This section applies to persons who are licensed
4outside of California and apply for licensure on or after January
51, 2016.

6(b) The board may issue a license to a person who, at the time
7of submitting an application for a license pursuant to this chapter,
8holds a valid license in good standing issued by a board of marriage
9counselor examiners, board of marriage and family therapists, or
10corresponding authority, of any state or country, if all of the
11following conditions are satisfied:

12(1) The applicant’s education is substantially equivalent, as
13defined in Section 4980.79. The applicant’s degree title need not
14be identical to that required by Section 4980.36 or 4980.37.

15(2) The applicant complies with Section 4980.76, if applicable.

16(3) The applicant’s supervised experience is substantially
17equivalent to that required for a license under this chapter. The
18board shall consider hours of experience obtained outside of
19California during the six-year period immediately preceding the
20date the applicant initially obtained the license described above.
21If the applicant has less than 3,000 hours of qualifying supervised
22experience, time actively licensed as a marriage and family
23therapist shall be accepted at a rate of 100 hours per month, up to
P4    1a maximum of 1,200 hours, if the applicant’s degree meets the
2practicum requirement described in subparagraph (C) of paragraph
3(1) of subdivision (b) of Section 4980.79 without exemptions or
4remediation.

5(4) The applicant passes the California law and ethics
6examination.

7(5) The applicant passes a clinical examination designated by
8the board. An applicant who obtained his or her license or
9registration under another jurisdiction may apply for licensure with
10the board without taking the clinical examination if both of the
11following conditions are met:

12(A) The applicant obtained a passing score on the licensing
13examination set forth in regulation as accepted by the board.

14(B) The applicant’s license or registration in that jurisdiction is
15in good standing at the time of his or her application and has not
16been revoked, suspended, surrendered, denied, or otherwise
17restricted or encumbered as a result of any disciplinary proceeding
18brought by the licensing authority of that jurisdiction.

SEC. 2.  

Section 4980.78 of the Business and Professions Code
20 is amended to read:

21

4980.78.  

(a) This section applies to persons who apply for
22licensure or registration on or after January 1, 2016, and who do
23not hold a license as described in Section 4980.72.

24(b) For purposes of Section 4980.74, education is substantially
25equivalent if all of the following requirements are met:

26(1) The degree is obtained from a school, college, or university
27accredited by an accrediting agency recognized by the United
28States Department of Education and consists of, at a minimum,
29the following:

30(A) (i) For an applicant who obtained his or her degree within
31the timeline prescribed by subdivision (a) of Section 4980.36, the
32degree shall contain no less than 60 semester or 90 quarter units
33of instruction.

34(ii) Up to 12 semester or 18 quarter units of instruction may be
35remediated, if missing from the degree. The remediation may occur
36while the applicant is registered as an intern.

37(B) For an applicant who obtained his or her degree within the
38timeline prescribed by subdivision (a) of Section 4980.37, the
39degree shall contain no less than 48 semester units or 72 quarter
40units of instruction.

2but not limited to, a minimum of 150 hours of face-to-face
3counseling, and an additional 75 hours of either face-to-face

8(D) Twelve semester or 18 quarter units in the areas of marriage,

10approaches to treatment, as specified in subparagraph (A) of
11paragraph (1) of subdivision (d) of Section 4980.36.

12(2) The applicant shall complete coursework in California law
13and ethics as follows:

14(A) An applicant who completed a course in law and
15professional ethics for marriage and family therapists as specified
16in paragraph (7) of subdivision (a) of Section 4980.81, that did not
17contain instruction in California law and ethics, shall complete an
1818-hour course in California law and professional ethics. The
19content of the course shall include, but not be limited to,
20advertising, scope of practice, scope of competence, treatment of
21minors, confidentiality, dangerous patients, psychotherapist-patient
22privilege, recordkeeping, patient access to records, state and federal
23laws relating to confidentiality of patient health information, dual
24relationships, child abuse, elder and dependent adult abuse, online
25therapy, insurance reimbursement, civil liability, disciplinary
26actions and unprofessional conduct, ethics complaints and ethical
27standards, termination of therapy, standards of care, relevant family
28law, therapist disclosures to patients, differences in legal and ethical
29standards in different types of work settings, and licensing law
30and licensing process. This coursework shall be completed prior
31to registration as an intern.

32(B) An applicant who has not completed a course in law and
33professional ethics for marriage and family therapists as specified
34in paragraph (7) of subdivision (a) of Section 4980.81 shall
35complete this required coursework. The coursework shall contain
36content specific to California law and ethics. This coursework shall
37be completed prior to registration as an intern.

38(3) The applicant completes the educational requirements
39specified in Section 4980.81 not already completed in his or her
40education. The coursework may be from an accredited school,

2educational institution approved by the Bureau for Private
3Postsecondary Education, or from a continuing education provider
4that is acceptable to the board as defined in Section 4980.54.begin delete The

19consumers and family members of consumers of mental health
20services to enhance understanding of their experience of mental
21illness, treatment, and recovery.

22(B) At least one semester unit, or 15 hours, of instruction that
23includes an understanding of various California cultures and the
24social and psychological implications of socioeconomic position.

25(5) An applicant may complete any units and course content
26requirements required under paragraphs (3) and (4) not already
27completed in his or her education while registered as an intern,
28unless otherwise specified.

29(6) The applicant’s degree title need not be identical to that
30required by subdivision (b) of Section 4980.36.

SEC. 3.  

Section 4980.79 is added to the Business and
32Professions Code

(a) This section applies to persons who apply for
34licensure or registration on or after January 1, 2016, and who hold

SEC. 4.  

Section 4980.80 of the Business and Professions Code
26 is amended to read:

27

4980.80.  

(a) This section applies to persons who apply for
28licensure between January 1, 2010, and December 31, 2015,
29inclusive.

30(b) The board may issue a license to a person who, at the time
31of application, holds a valid license issued by a board of marriage
32counselor examiners, marriage therapist examiners, or
33corresponding authority of any state, if all of the following
34requirements are satisfied:

35(1) The person has held that license for at least two years
36immediately preceding the date of application.

37(2) The education and supervised experience requirements are
38substantially the equivalent of this chapter. If an applicant has less
39than 3,000 hours of qualifying supervised experience, time actively
P10   1licensed as a marriage and family therapist shall be accepted at a
2rate of 100 hours per month up to a maximum of 1,200 hours.

3(3) The person complies with Section 4980.76, if applicable.

4(4) The person successfully completes thebegin delete board administeredend delete
5begin insert board-administeredend insert licensing examinations as specified by
6subdivision (d) of Section 4980.40 and pays the fees specified.

7(5) The person completes all of the following coursework or
8training:

9(A) (i) An applicant who completed a two semester or three
10quarter unit course in law and professional ethics for marriage and
11family therapists that does not meet the requirements of Section
124980.41 as part of his or her qualifying degree shall complete an
1318-hour course in California law and professional ethics that
14includes, but is not limited to, the following subjects: advertising,
15scope of practice, scope of competence, treatment of minors,
16confidentiality, dangerous patients, psychotherapist-patient
17privilege, recordkeeping, patient access to records, state and federal
18laws relating to the confidentiality of patient health information,
19dual relationships, child abuse, elder and dependent adult abuse,
20online therapy, insurance reimbursement, civil liability, disciplinary
21actions and unprofessional conduct, ethics complaints and ethical
22standards, termination of therapy, standards of care, relevant family
23law, and therapist disclosures to patients.

24(ii) An applicant who has not completed a two semester or three
25quarter unit course in law and professional ethics for marriage and
26family therapists that included areas of study as specified in Section
274980.41 as part of his or her qualifying degree, shall complete a
28two semester or three quarter unit course in California law and
29professional ethics that includes, at minimum, the areas of study
30specified in Section 4980.41.

31(B) A minimum of seven contact hours of training or coursework
32in child abuse assessment and reporting as specified in Section 28
33and any regulations promulgated thereunder.

34(C) A minimum of 10 contact hours of training or coursework
35in human sexuality as specified in Section 25 and any regulations
36promulgated thereunder.

37(D) A minimum of 15 contact hours of training or coursework
38in alcoholism and other chemical substance dependency as
39specified by regulation.

P11   1(E) (i) Instruction in spousal or partner abuse assessment,
2detection, and intervention. This instruction may be taken either
3in fulfillment of other requirements for licensure or in a separate
4course.

5(ii) A minimum of 15 contact hours of coursework or training
6in spousal or partner abuse assessment, detection, and intervention
7strategies.

8(F) A minimum of a two semester or three quarter unit survey
9course in psychological testing. This course may be taken either
10in fulfillment of other requirements for licensure or in a separate
11course.

12(G) A minimum of a two semester or three quarter unit survey
13course in psychopharmacology. This course may be taken either
14in fulfillment of other requirements for licensure or in a separate
15course.

16(H) With respect to human sexuality, alcoholism and other
17chemical substance dependency, spousal or partner abuse
18assessment, detection, and intervention, psychological testing, and
19psychopharmacology, the board may accept training or coursework
20acquired out of state.

21(c) This section shall remain in effect only until January 1, 2016,
22and as of that date is repealed, unless a later enacted statute, that
23is enacted before January 1, 2016, deletes or extends that date.

SEC. 5.  

Section 4980.81 is added to the Business and
25Professions Code
, to read:

26

4980.81.  

This section applies to persons subject to Section
274980.78 or 4980.79, who apply for licensure or registration on or
28after January 2016.

29(a) For purposes of Sections 4980.78 and 4980.79, an applicant
30shall meet all of the following educational requirements:

31(1) A minimum of two semester units of instruction in the
32diagnosis, assessment, prognosis, and treatment of mental
33disorders, including severe mental disorders, evidence-based
34practices, psychological testing, psychopharmacology, and
35promising mental health practices that are evaluated in peer
36reviewed literature. This shall include at least one semester unit
37or 15 hours of instruction in psychological testing and at least one
38semester unit or 15 hours of instruction in psychopharmacology.

P12   1(2) (A) Developmental issues from infancy to old age, including
2demonstration of at least one semester unit, or 15 hours, of
3instruction that includes all of the following subjects:

4(i) The effects of developmental issues on individuals, couples,
5and family relationships.

6(ii) The psychological, psychotherapeutic, and health
7implications of developmental issues and their effects.

8(iii) The understanding of the impact that personal and social
9insecurity, social stress, low educational levels, inadequate housing,
10and malnutrition have on human development.

11(B) An applicant who is deficient in any of these subjects may
12 remediate the coursework by completing three hours of instruction
13in each deficient subject.

14(3) (A) The broad range of matters and life events that may
15arise within marriage and family relationships and within a variety
16of California cultures, including instruction in all of the following:

17(i) A minimum of seven contact hours of training or coursework
18in child abuse assessment and reporting as specified in Section 28
19and any regulations promulgated under that section.

20(ii) A minimum of 10 contact hours of coursework that includes
21all of the following:

22(I) The assessment and reporting of, as well as treatment related
23to, elder and dependent adult abuse and neglect.

24(II) Aging and its biological, social, cognitive, and psychological
25aspects.

26(III) Long-term care.

27(IV) End-of-life and grief.

28(iii) A minimum of 15 contact hours of coursework in spousal
29or partner abuse assessment, detection, intervention strategies, and
30begin delete same genderend deletebegin insert same-genderend insert abuse dynamics.

31(iv) Cultural factors relevant to abuse of partners and family
32members.

33(v) Childbirth, child rearing, parenting, and stepparenting.

34(vi) Marriage, divorce, and blended families.

35(vii) Poverty and deprivation.

36(viii) Financial and social stress.

37(ix) Effects of trauma.

38(x) The psychological, psychotherapeutic, community, and
39health implications of the matters and life events described in
40clauses (i) to (ix), inclusive.

P13   1(4) At least one semester unit, or 15 hours, of instruction in
2multicultural development and cross-cultural interaction, including
3experiences of race, ethnicity, class, spirituality, sexual orientation,
4gender, and disability, and their incorporation into the
5psychotherapeutic process.

6(5) A minimum of 10 contact hours of training or coursework
7in human sexuality, as specified in Section 25 and any regulations
8promulgated under that section, including the study of
9physiological, psychological, and social cultural variables
10associated with sexual behavior and gender identity, and the
11assessment and treatment of psychosexual dysfunction.

12(6) A minimum of 15 contact hours of coursework in substance
13use disorders, and a minimum of 15 contact hours of coursework
14in cooccurring disorders and addiction. The following subjects
15shall be included in this coursework:

16(A) The definition of substance use disorders, cooccurring
17disorders, and addiction. For purposes of this subparagraph
18“cooccurring disorders” means a mental illness and substance
19abuse diagnosis occurring simultaneously in an individual.

20(B) Medical aspects of substance use disorders and cooccurring
21disorders.

22(C) The effects of psychoactive drug use.

23(D) Current theories of the etiology of substance abuse and
24addiction.

25(E) The role of persons and systems that support or compound
26substance abuse and addiction.

27(F) Major approaches to identification, evaluation, and treatment
28of substance use disorders, cooccurring disorders, and addiction,
29including, but not limited to, best practices.

30(G) Legal aspects of substance abuse.

31(H) Populations at risk with regard to substance use disorders
32and cooccurring disorders.

33(I) Community resources offering screening, assessment,
34treatment, and followup for the affected person and family.

35(J) Recognition of substance use disorders, cooccurring
36 disorders, and addiction, and appropriate referral.

37(K) The prevention of substance use disorders and addiction.

38(7) A minimum of a two semester or three quarter unit course
39in law and professional ethics for marriage and family therapists,
40including instruction in all of the following subjects:

P14   1(A) Contemporary professional ethics and statutory, regulatory,
2and decisional laws that delineate the scope of practice of marriage
3and family therapy.

4(B) The therapeutic, clinical, and practical considerations
5involved in the legal and ethical practice of marriage and family
6therapy, including, but not limited to, family law.

SEC. 6.  

Section 4980.90 of the Business and Professions Code
19 is amended to read:

20

4980.90.  

(a) This section applies to persons who apply for
21licensure between January 1, 2010, and December 31, 2015,
22inclusive.

23(b) Experience gained outside of California shall be accepted
24toward the licensure requirements if it is substantially equivalent
25to that required by this chapter, if the applicant complies with
26Section 4980.76, if applicable, and if the applicant has gained a
27minimum of 250 hours of supervised experience in direct
28counseling within California while registered as an intern with the
29board. The board shall consider hours of experience obtained in
30another state during the six-year period immediately preceding the
31applicant’s initial licensure by that state as a marriage and family
32therapist. If the applicant has less than 3,000 hours of qualifying
33supervised experience, time actively licensed as a marriage and
34family therapist shall be accepted at a rate of 100 hours per month
35up to a maximum of 1,200 hours.

36(c) Education gained while residing outside of California shall
37be accepted toward the licensure requirements if it is substantially
38equivalent to the education requirements of this chapter, and if the
39applicant has completed all of the following:

P15   1(1) A two semester or three quarter unit course in California
2law and professional ethics for marriage, family, and child
3counselors that shall include areas of study as specified in Section
44980.41.

5(2) A minimum of seven contact hours of training or coursework
6in child abuse assessment and reporting as specified in Section 28
7and any regulations promulgated thereunder.

8(3) A minimum of 10 contact hours of training or coursework
9in sexuality as specified in Section 25 and any regulations
10promulgated thereunder.

11(4) A minimum of 15 contact hours of training or coursework
12in alcoholism and other chemical substance dependency as
13specified by regulation.

14(5) (A) Instruction in spousal or partner abuse assessment,
15detection, and intervention. This instruction may be taken either
16in fulfillment of other educational requirements for licensure or
17in a separate course.

18(B) A minimum of 15 contact hours of coursework or training
19in spousal or partner abuse assessment, detection, and intervention
20strategies.

21(6) A minimum of a two semester or three quarter unit survey
22course in psychological testing. This course may be taken either
23in fulfillment of other requirements for licensure or in a separate
24course.

25(7) A minimum of a two semester or three quarter unit survey
26course in psychopharmacology. This course may be taken either
27in fulfillment of other requirements for licensure or in a separate
28course.

29(8) With respect to human sexuality, alcoholism and other
30chemical substance dependency, spousal or partner abuse
31assessment, detection, and intervention, psychological testing, and
32psychopharmacology, the board may accept training or coursework
33acquired out of state.

34(d) For purposes of this section, the board may, in its discretion,
35accept education as substantially equivalent if the applicant meets
36both of the following requirements:

37(1) The applicant has been granted a degree in a single integrated
38program primarily designed to train marriage and family therapists.

39(2) The applicant’s education meets the requirements of Section
404980.37. The degree title need not be identical to that required by
P16   1subdivision (b) of Section 4980.37. If the applicant’s degree does
2not contain the content or the overall units required by Section
34980.37, the board may, in its discretion, accept the applicant’s
4education as substantially equivalent if the following criteria are
5satisfied:

6(A) The applicant’s degree contains the required number of
7practicum units and coursework required in the areas of marriage,
8family, and child counseling and marital and family systems
9approaches to treatment as specified in Section 4980.37.

10(B) The applicant remediates his or her specific deficiency by
11completing the course content and the units required by Section
124980.37.

13(C) The applicant’s degree otherwise complies with this section.

14(e) This section shall remain in effect only until January 1, 2016,
15and as of that date is repealed, unless a later enacted statute, that
16is enacted before January 1, 2016, deletes or extends that date.

SEC. 7.  

Section 4999.57 of the Business and Professions Code
18 is amended to read:

19

4999.57.  

(a) This section applies to a person who applies for
20examination eligibility or registration between January 1, 2011,
21and December 31, 2015, inclusive, who does not hold a license
22described in subdivision (a) of Section 4999.58.

23(b) Experience gained outside of California shall be accepted
24toward the licensure requirements if it is substantially equivalent
25to that required by this chapter, if the applicant complies with
26Section 4999.40, if applicable, and if the applicant has gained a
27minimum of 250 hours of supervised experience in direct
28counseling within California while registered as an intern with the
29board.

30(c) (1) Education gained while residing outside of California
31shall be accepted toward the licensure requirements if it is
32substantially equivalent to the education requirements of this
33chapter, and if the applicant has completed the training or
34coursework required under subdivision (e) of Section 4999.32.

35(2) An applicant who completed a course that meets the
36requirements of subparagraph (I) of paragraph (1) of subdivision
37(c) of Section 4999.32, and that included instruction in California
38law and ethics, is exempt from taking the 18-hour course specified
39in paragraph (6) of subdivision (e) of Section 4999.32.

P17   1(d) For purposes of this section, the board may, in its discretion,
2accept education as substantially equivalent if the applicant’s
3education meets the requirements of Section 4999.32. If the
4applicant’s degree does not contain the content or the overall units
5required by Section 4999.32, the board may, in its discretion, accept
6the applicant’s education as substantially equivalent if the following
7criteria are satisfied:

8(1) The applicant’s degree contains the required number of
9practicum units under paragraph (3) of subdivision (c) of Section
104999.32.

11(2) The applicant remediates his or her specific deficiency by
12completing the course content and units required by Section
134999.32.

14(3) The applicant’s degree otherwise complies with this section.

15(e) This section shall become inoperative on January 1, 2016,
16and as of that date is repealed, unless a later enacted statute, which
17is enacted before January 1, 2016, deletes or extends that date.

SEC. 8.  

Section 4999.58 of the Business and Professions Code
19 is amended to read:

20

4999.58.  

(a) This section applies to a person who applies for
21examination eligibility between January 1, 2011, and December
2231, 2015, inclusive, and who meets both of the following
23requirements:

24(1) At the time of application, holds a valid license as a
25professional clinical counselor, or other counseling license that
26allows the applicant to independently provide clinical mental health
27services, in another jurisdiction of the United States.

28(2) Has held the license described in paragraph (1) for at least
29two years immediately preceding the date of application.

30(b) The board may issue a license to a person described in
31subdivision (a) if all of the following requirements are satisfied:

32(1) The education and supervised experience requirements of
33the other jurisdiction are substantially the equivalent of this chapter,
34as described in subdivision (e) and in Section 4999.46.

35(2) The person complies with subdivision (b) of Section 4999.40,
36if applicable.

37(3) The person successfully completes the examinations required
38by the board pursuant to paragraph (3) of subdivision (a) of Section
394999.50. An applicant who obtained his or her license or
40registration under another jurisdiction by taking a national
P18   1examination that is required by the board may apply for licensure
2with the board without retaking that examination if both of the
3following conditions are met:

4(A) The applicant obtained a passing score on the national
5licensing examination that is required by the board.

6(B) The applicant’s license or registration in that jurisdiction is
7in good standing at the time of his or her application and has not
8been revoked, suspended, surrendered, denied, or otherwise
9restricted or encumbered as a result of any disciplinary proceeding
10brought by the licensing authority of that jurisdiction.

11(4) The person pays the required fees.

12(c) Experience gained outside of California shall be accepted
13toward the licensure requirements if it is substantially equivalent
14to that required by this chapter. The board shall consider hours of
15experience obtained in another state during the six-year period
16immediately preceding the applicant’s initial licensure by that state
17as a licensed professional clinical counselor. If the applicant has
18less than 3,000 hours of qualifying supervised experience, time
19actively licensed as a licensed professional clinical counselor shall
20 be accepted at a rate of 100 hours per month up to a maximum of
211,200 hours.

22(d) (1) Education gained while residing outside of California
23shall be accepted toward the licensure requirements if it is
24substantially equivalent to the education requirements of this
25chapter, and if the applicant has completed the training or
26coursework required under subdivision (e) of Section 4999.32.

27(2) An applicant who completed a course that meets the
28requirements of subparagraphbegin delete (A)end deletebegin insert (I)end insert of paragraph (1) of
29subdivision (c) of Section 4999.32, and that included instruction
30in California law and ethics, is exempt from taking the 18-hour
31course specified in paragraph (6) of subdivision (e) of Section
324999.32.

33(e) For purposes of this section, the board may, in its discretion,
34accept education as substantially equivalent if the applicant’s
35education meets the requirements of Section 4999.32. If the
36applicant’s degree does not contain the content or the overall units
37required by Section 4999.32, the board may, in its discretion, accept
38the applicant’s education as substantially equivalent if the following
39criteria are satisfied:

P19   1(1) The applicant’s degree contains the required number of
2practicum units under paragraph (3) of subdivision (c) of Section
34999.32.

4(2) The applicant remediates his or her specific deficiency by
5completing the course content and units required by Section
64999.32.

7(3) The applicant’s degree otherwise complies with this section.

8(f) This section shall become inoperative on January 1, 2016,
9and as of that date is repealed, unless a later enacted statute, which
10is enacted before January 1, 2016, deletes or extends that date.

SEC. 9.  

Section 4999.59 of the Business and Professions Code
12 is amended to read:

4999.59.  

(a) This section applies to a person who applies for
14examination eligibility or registration between January 1, 2011,
15and December 31, 2015, inclusive, who meets both of the following
16requirements:

17(1) At the time of application, holds a valid license described
18in paragraph (1) of subdivision (a) of Section 4999.58.

19(2) Has held the license described in paragraph (1) for less than
20two years immediately preceding the date of application.

21(b) Experience gained outside of California shall be accepted
22toward the licensure requirements if it is substantially equivalent
23to that required by this chapter, if the applicant complies with
24Section 4999.40, if applicable, and if the applicant has gained a
25minimum of 250 hours of supervised experience in direct
26counseling within California while registered as an intern with the
27board. The board shall consider hours of experience obtained in
28another state during the six-year period immediately preceding the
29applicant’s initial licensure in that state as a professional clinical
30counselor. If the applicant has less than 3,000 hours of qualifying
31supervised experience, time actively licensed as a licensed
32professional clinical counselor shall be accepted at a rate of 100
33hours per month up to a maximum of 1,200 hours.

34(c) (1) Education gained while residing outside of California
35shall be accepted toward the licensure requirements if it is
36substantially equivalent to the education requirements of this
37chapter, and if the applicant has completed the training or
38coursework required under subdivision (e) of Section 4999.32.

39(2) An applicant who completed a course that meets the
40requirements of subparagraph (I) of paragraph (1) of subdivision
P20   1(c) of Section 4999.32, and that included instruction in California
2law and ethics, is exempt from taking the 18-hour course specified
3in paragraph (6) of subdivision (e) of Section 4999.32.

4(d) For purposes of this section, the board may, in its discretion,
5accept education as substantially equivalent if the applicant’s
6education meets the requirements of Section 4999.32. If the
7applicant’s degree does not contain the content or the overall units
8required by Section 4999.32, the board may, in its discretion, accept
9the applicant’s education as substantially equivalent if the following
10criteria are satisfied:

11(1) The applicant’s degree contains the required number of
12practicum units under paragraph (3) of subdivision (c) of Section
134999.32.

14(2) The applicant remediates his or her specific deficiency by
15completing the course content and units required by Section
164999.32.

17(3) The applicant’s degree otherwise complies with this section.

18(e) An applicant who obtained his or her license or registration
19under another jurisdiction by taking a national examination that
20is required by the board may apply for licensure with the board
21without retaking that examination if both of the following
22conditions are met:

23(1) The applicant obtained a passing score on the national
24licensing examination that is required by the board.

25(2) The applicant’s license or registration in that jurisdiction is
26in good standing at the time of his or her application and has not
27been revoked, suspended, surrendered, denied, or otherwise
28restricted or encumbered as a result of any disciplinary proceeding
29brought by the licensing authority of that jurisdiction.

30(f) This section shall become inoperative on January 1, 2016,

SEC. 10.  

Section 4999.60 of the Business and Professions
34Code
is amended to read:

4999.60.  

(a) This section applies to persons who are licensed
36outside of California and apply for examination eligibility on or
37after January 1, 2016.

38(b) The board may issue a license to a person who, at the time
39of submitting an application for a license pursuant to this chapter,
40holds a valid license as a professional clinical counselor, or other
P21   1counseling license that allows the applicant to independently
2provide clinical mental health services, in another jurisdiction of
3the United States, if all of the following conditions are satisfied:

4(1) The applicant’s education is substantially equivalent, as
5defined in Section 4999.63.

6(2) The applicant complies with subdivision (b) of Section
74999.40, if applicable.

8(3) The applicant’s supervised experience is substantially
9equivalent to that required for a license under this chapter. The
10board shall consider hours of experience obtained outside of
11California during the six-year period immediately preceding the
12date the applicant initially obtained the license described above.
13If the applicant has less than 3,000 hours of qualifying supervised
14experience, time actively licensed as a professional clinical
15counselor shall be accepted at a rate of 100 hours per month up to
16a maximum of 1,200 hours if the applicant’s degree meets the
17practicum requirement described in subparagraph (C) of paragraph
18(1) of subdivision (b) of Section 4999.63 without exemptions or
19remediation.

20(4) The applicant passes the examinations required to obtain a
21license under this chapter. An applicant who obtained his or her
22license or registration under another jurisdiction may apply for
23licensure with the board without taking the clinical examination
24if both of the following conditions are met:

25(A) The applicant obtained a passing score on the licensing
26examination set forth in regulation as accepted by the board.

27(B) The applicant’s license or registration in that jurisdiction is
28in good standing at the time of his or her application and has not
29been revoked, suspended, surrendered, denied, or otherwise
30restricted or encumbered as a result of any disciplinary proceeding
31brought by the licensing authority of that jurisdiction.

SEC. 11.  

Section 4999.62 of the Business and Professions
33Code
is amended to read:

34

4999.62.  

(a) This section applies to persons who apply for
35examination eligibility or registration on or after January 1, 2016,
36and who do not hold a license as described in Section 4999.60.

37(b) For purposes of Section 4999.61, education is substantially
38equivalent if all of the following requirements are met:

P22   1(1) The degree is obtained from an accredited or approved
2institution, as defined in Section 4999.12, and consists of, at a
3minimum, the following:

4(A) (i) For an applicant who obtained his or her degree within
5the timeline prescribed by subdivision (a) of Section 4999.33 the
6degree shall contain no less than 60 graduate semester or 90
7graduate quarter units of instruction.

8(ii) Up to 12 semester or 18 quarter units of instruction may be
9remediated, if missing from the degree. The remediation may occur
10while the applicant is registered as an intern.

11(B) For an applicant who obtained his or her degree within the
12timeline prescribed by subdivision (a) of Section 4999.32 the
13degree shall contain no less than 48 graduate semester or 72
14graduate quarter units of instruction.

15(C) Six semester or nine quarter units of practicum, including,
16but not limited to, a minimum of 280 hours of face-to-face
17counseling.

18(D) The required areas of study listed in subparagraphs (A) to
19(M), inclusive, of paragraph (1) of subdivision (c) of Section
204999.33.

21(i) An applicant whose degree is deficient inbegin delete anyend deletebegin insert no more than
22sixend insert
of the requiredbegin delete subjectsend deletebegin insert areas of studyend insert listed in subparagraphs
23(A) to (M), inclusive, of paragraph (1) of subdivision (c) may

27deficiencies shall be the equivalent of three semester units or four
28and one-half quarter units of study.

29(ii) An applicant who completed a course in professional
30orientation, ethics, and law in counseling as required by
31subparagraph (I) of paragraph (1) of subdivision (c) of Section
324999.33 that did not contain instruction in California law and ethics
33shall complete an 18-hour course in California law and professional
34ethics that includes, but is not limited to, instruction in advertising,
35scope of practice, scope of competence, treatment of minors,
36confidentiality, dangerous clients, psychotherapist-client privilege,
37recordkeeping, client access to records, state and federal laws
38relating to confidentiality of patient health information, dual
39relationships, child abuse, elder and dependent adult abuse, online
40therapy, insurance reimbursement, civil liability, disciplinary
P23   1actions and unprofessional conduct, ethics complaints and ethical
2standards, termination of therapy, standards of care, relevant family
3law, and therapist disclosures to clients. An applicant shall
4complete this coursework prior to registration as an intern.

5(iii) An applicant who has not completed a course in professional
6orientation, ethics, and law in counseling as required by
7subparagraph (I) of paragraph (1) of subdivision (c) of Section
84999.33 shall complete this required coursework, including content
9in California law and ethics. An applicant shall complete this
10coursework prior to registration as an intern.

11(2) The applicant completes any units required by subdivision
12(c) of Section 4999.33 not already completed in his or her education
13as follows:

14(A) At least 15 semester units or 22.5 quarter units of advanced
15coursework to develop knowledge of specific treatment issues or
16special populations. This coursework is in addition to the course
17requirements described in subparagraph (D) of paragraph (1).

18(B) Coursework shall be from an accredited or approved school,
19college, or university as defined in Section 4999.12.

20(3) (A) The applicant completes the following coursework not
21already completed in his or her education:

22(i) A minimum of 10 contact hours of training in human
23sexuality, as specified in Section 25 and any regulations
24promulgated thereunder, including the study of the physiological,
25psychological, and social cultural variables associated with sexual
26behavior, gender identity, and the assessment and treatment of
27psychosexual dysfunction.

28(ii) A minimum of 15 contact hours of instruction in spousal or
29partner abuse assessment, detection, intervention strategies, and
30same-gender abuse dynamics.

31(iii) A minimum of seven contact hours of training or
32coursework in child abuse assessment and reporting as specified
33in Section 28 and any regulations promulgated thereunder.

34(iv) A minimum of 10 contact hours of instruction in aging and
35long-term care, including biological, social, cognitive, and
36psychological aspects of aging. This coursework shall include
37instruction on the assessment and reporting of, as well as treatment
38related to, elder and dependent adult abuse and neglect.

39(B) This coursework may be from an accredited or approved
40school, college, or university as defined in Section 4999.12, or
P24   1from a continuing education provider that is acceptable to the board

16consumers and family members of consumers of mental health
17services to enhance understanding of their experiences of mental
18illness, treatment, and recovery.

19(B) At least one semester unit, or 15 hours, of instruction that
20includes an understanding of various California cultures and the
21social and psychological implications of socioeconomic position.

22(5) An applicant may complete any units and course content
23requirements required under paragraphs (2), (3), or (4) not already
24completed in his or her education while registered with the board
25as an intern.

SEC. 12.  

Section 4999.63 is added to the Business and
27Professions Code
, to read:

28

4999.63.  

(a) This section applies to persons who apply for
29examination eligibility or registration on or after January 1, 2016,
30and who hold a license as described in Section 4999.60.

31(b) For purposes of Section 4999.60, education is substantially
32equivalent if all of the following requirements are met:

33(1) The degreebegin delete wasend deletebegin insert isend insert obtained from an accredited or approved
34institution, as defined in Section 4999.12, and consists of the
35following:

36(A) (i) For an applicant who obtained his or her degree within
37the timeline prescribed by subdivision (a) of Section 4999.33 the
38degree shall contain no less than 60 graduate semester or 90
39graduate quarter units of instruction.

P25   1(ii) Up to 12 semester or 18 quarter units of instruction may be
2remediated, if missing from the degree. The remediation may occur
3while the applicant is registered as an intern.

4(B) For an applicant who obtained his or her degree within the
5timeline prescribed by subdivision (a) of Section 4999.32 the
6degree shall contain no less than 48 graduate semester or 72
7graduate quarter units of instruction.

8(C) Six semester or nine quarter units of practicum, including,

11(i) An applicant who has been licensed for at least two years in
12clinical practice, as verified by the board, is exempt from this
13requirement.

14(ii) An out-of-state applicant who has been licensed for less
15than two years in clinical practice, as verified by the board, who
16does not meet the practicum requirement, shall remediate the
17requirement by demonstrating completion of a total of 280 hours
18of face-to face counseling, as specified in subparagraph (K) of
19paragraph (3) of subdivision (c) of Section 4999.33. Any
20postdegree hours gained to meet this requirement are in addition
21to the 3,000 hours of experience required by this chapter, and shall
22be gained while the applicant is registered with the board as an
23intern.

26subdivision (c) of Section 4999.33.

33meet those deficiencies shall be the equivalent of three semester
34units or four and one-half quarter units of study.

35(ii) An applicant who completed a course in professional
36orientation, ethics, and law in counseling as required by
37subparagraph (I) of paragraph (1) of subdivision (c) of Section
384999.33 that did not contain instruction in California law and ethics
39shall complete an 18-hour course in California law and professional
40ethics that includes, but is not limited to, instruction in advertising,

2confidentiality, dangerous clients, psychotherapist-client privilege,
3recordkeeping, client access to records, state and federal laws
4relating to confidentiality of patient health information, dual

11(iii) An applicant who has not completed a course in professional
12orientation, ethicsbegin insert,end insert and law in counseling as required by
13subparagraph (I) of paragraph (1) of subdivision (c) of Section
144999.33 shall complete this required coursework, including content
15in California law and ethics. An applicant shall complete this
16coursework prior to registration as an intern.

17(2) The applicant completes any units required under subdivision
18(c) of Section 4999.33 not already completed in his or her education
19as follows:

20(A) At least 15 semester units or 22.5 quarter units of advanced
21coursework to develop knowledge of specific treatment issues or
22special populations. This coursework is in addition to the course
23requirements described in subparagraph (D) of paragraph (1).

24(B) Coursework shall be from an accredited or approved school,
25college, or university as defined in Section 4999.12.

26(3) The applicant completes the following coursework not
27already completed in his or her education:

28(A) A minimum of 10 contact hours of training in human
29sexuality, as specified in Section 25 and any regulations
30promulgated thereunder, including the study of the physiological,

19(A) At least three semester units or 45 hours of instruction
20regarding the principles of mental health recovery-oriented care
21and methods of service delivery in recovery-oriented practice
22environments, including structured meetings with various
23consumers and family members of consumers of mental health
24services to enhance understanding of their experience of mental
25illness, treatment, and recovery.

26(B) At least one semester unit or 15 hours of instruction that
27includes an understanding of various California cultures and the
28social and psychological implications of socioeconomic position.

29(5) An applicant may complete any units and course content
30requirements required by subparagraph (D) of paragraph (1) or
31paragraphs (2), (3), and (4) not already completed in his or her
32education while registered with the board as an intern, unless
33otherwise specified.
