(1) Under existing law, the Board of Behavioral Sciences licenses and regulates marriage and family therapists and licensed professional clinical counselors. Existing law requires an applicant for either license to complete specified numbers of hours of supervised experience, and requires an applicant to register with the board as a marriage and family therapist intern or a licensed professional clinical counselor intern, respectively, in order to be credited for postdegree hours of supervised experience gained toward licensure.
The board may issue a marriage and family therapist license to a person who holds a valid license in good standing issued by an out-of-state board of marriage counselor examiners, board of marriage and family therapists, or corresponding authority, who satisfies specified conditions applicable to a person applying on or after January 1, 2016. These conditions include that the applicant’s education is substantially equivalent to that required of in-state applicants. Under existing law, education is deemed substantially equivalent if specified coursework requirements and practicum requirements are satisfied. Under existing law an applicant is required to satisfy these requirements through graduate level coursework, and remediate any deficiencies in these requirements prior to registering with the board as an intern.
This bill would allow an out-of-state applicant to remediate specified coursework requirements through continuing education, and to remediate specified coursework while registered as an intern. The bill would specify hour or unit requirements for certain coursework requirements. The bill would allow an applicant to remediate the practicum requirements if the applicant holds a license as described above.
(2) Existing law requires a marriage and family therapist applicant who begins his or her degree on or after August 1, 2012, to complete 60 semester units or 90 quarter units of instruction.
This bill would allow those applicants to remediate up to 12 semester units or 18 quarter units while the applicant is registered as an intern.
(3) Existing law requires an out-of-state marriage and family therapist applicant who began his or her degree prior to August 1, 2012, to complete 60 semester or 90 quarter units of instruction.
This bill would allow those applicants to satisfy the degree requirement by completing 48 semester or 72 quarter units of instruction.
(4) Under existing law the board may issue professional clinical counselor license to a person who holds a valid license as a professional clinical counselor, or other counseling license that allows the applicant to independently provide clinical mental health services out of state who satisfies specified conditions applicable to a person applying on or after January 1, 2016. Those conditions include that the applicant’s education is substantially equivalent to that required of in-state applicants. Under existing law, education is deemed substantially equivalent if specified coursework requirements are satisfied. An applicant is required to satisfy these requirements through graduate level coursework, and remediate any deficiencies in these requirements prior to registering with the board as an intern.

21in good standing at the time of his or her application and has not

17approaches to treatment, as specified in subparagraph (A) of

20and ethics as follows:
21(A) An applicant who completed a course in law and
22professional ethics for marriage and family therapists as specified
23in paragraph (7) of subdivision (a) of Section 4980.81, that did not
24contain
instruction in California law and ethics, shall complete an
2518-hour course in California law and professional ethics. The
26content of the course shall include, but not be limited to,
27advertising, scope of practice, scope of competence, treatment of
28minors, confidentiality, dangerous patients, psychotherapist-patient

40professional ethics for marriage and family therapists as specified

19than two years in clinical practice, as verified by the board, who
20does not meet the practicum requirement, shall remediate it by
21obtaining 150 hours of face-to-face counseling, and an additional
2275 hours of either face-to-face counseling or client-centered
23advocacy,
or a combination of face-to-face counseling and
24client-centered advocacy. These hours are in addition to the 3,000
25hours of experience required by this chapter, and shall be gained
26while registered as an intern.
27(D) Twelve semester or 18 quarter units in the areas of marriage,
28family, and child counseling and marital and family systems
29approaches to treatment, as specified in subparagraph (A) of
30paragraph (1) of subdivision (d) of Section 4980.36.

17counselor examiners, marriage therapist examiners, or
18corresponding authority of any state, if all of the following
19requirements are satisfied:
20(1) The person has held that license for at least two years
21immediately preceding the date of application.
22(2) The education and supervised experience requirements are
23substantially
the equivalent of this chapter. If an applicant has less
24than 3,000 hours of qualifying supervised experience, time actively
25licensed as a marriage and family therapist shall be accepted at a
26rate of 100 hours per month up to a maximum of 1,200 hours.

35family therapists that does not meet the requirements of Section
364980.41 as part of his or her qualifying degree shall complete an

40confidentiality, dangerous patients, psychotherapist-patient

4online therapy, insurance reimbursement, civil liability, disciplinary

6standards, termination of therapy, standards of care, relevant family
7law, and therapist disclosures to patients.
8(ii) An applicant who has not completed a two semester or three
9quarter unit course in law and professional ethics for marriage and
10family therapists that included areas of study as specified in Section
114980.41 as part of his or her qualifying degree, shall complete a
12two semester or three quarter unit course in California law and
13professional ethics that includes, at minimum, the areas of study
14specified in Section 4980.41.
15(B) A minimum of seven contact hours of training or coursework
16in child abuse assessment and reporting as specified in Section 28
17and any regulations promulgated thereunder.
18(C) A minimum of 10 contact hours of training or coursework
19in human sexuality as specified in Section 25 and any regulations
20promulgated thereunder.
21(D) A minimum of 15 contact hours of training or coursework
22in alcoholism and other chemical substance dependency as
23specified by regulation.
24(E) (i) Instruction in spousal or partner abuse assessment,
25detection, and intervention. This instruction may be taken either

28(ii) A minimum of 15 contact hours of coursework or training

30strategies.
31(F) A minimum of a two semester or three quarter unit survey
32course in psychological testing. This course may be taken either
33in fulfillment of other
requirements for licensure or in a separate
34course.
35(G) A minimum of a two semester or three quarter unit survey
36course in psychopharmacology. This course may be taken either
37in fulfillment of other requirements for licensure or in a separate
38course.
39(H) With respect to human sexuality, alcoholism and other
40chemical substance dependency, spousal or partner abuse
P15 1assessment, detection, and intervention, psychological testing, and
2psychopharmacology, the board may accept training or coursework
3acquired out of state.
4(c) This section shall remain in effect only until January 1, 2016,
5and as of that date is repealed, unless a later enacted statute, that
6is enacted before January 1, 2016, deletes or
extends that date.
Section 4980.81 is added to the Business and
8Professions Code, to read:
This section applies to persons subject to Section
104980.78 or 4980.79, who apply for licensure or registration on or
11after January 2016.
12(a) For purposes of Sections 4980.78 and 4980.79, an applicant
13shall meet all of the following educational requirements:
14(1) A minimum of two semester units of instruction in the
15diagnosis, assessment, prognosis, and treatment of mental
16disorders, including severe mental disorders, evidence-based
17practices, psychological testing, psychopharmacology, and
18promising mental health practices that are evaluated in peer
19reviewed literature. This shall include at least one semester unit
20or
15 hours of instruction in psychological testing and at least one
21semester unit or 15 hours of instruction in psychopharmacology.
22(2) (A) Developmental issues from infancy to old age, including
23demonstration of at least one semester unit, or 15 hours, of
24instruction that includes all of the following subjects:
25(i) The effects of developmental issues on individuals, couples,
26and family relationships.
27(ii) The psychological, psychotherapeutic, and health
28implications of developmental issues and their effects.
29(iii) The understanding of the impact that personal and social
30insecurity, social stress, low educational levels, inadequate housing,
31and
malnutrition have on human development.
32(B) An applicant who is deficient in any of these subjects may
33
remediate the coursework by completing three hours of instruction
34in each deficient subject.
35(3) (A) The broad range of matters and life events that may
36arise within marriage and family relationships and within a variety
37of California cultures, including instruction in all of the following:
38(i) A minimum of seven contact hours of training or coursework
39in child abuse assessment and reporting as specified in Section 28
40and any regulations promulgated under that section.
P16 1(ii) A minimum of 10 contact hours of coursework that includes
2all of the following:
3(I) The assessment and reporting of, as well as treatment related
4to, elder
and dependent adult abuse and neglect.
5(II) Aging and its biological, social, cognitive, and psychological
6aspects.
7(III) Long-term care.
8(IV) End-of-life and grief.
9(iii) A minimum of 15 contact hours of coursework in spousal
10or partner abuse assessment, detection, intervention strategies, and
11same-gender abuse dynamics.
12(iv) Cultural factors relevant to abuse of partners and family
13members.
14(v) Childbirth, child rearing, parenting, and stepparenting.
15(vi) Marriage, divorce, and blended families.
16(vii) Poverty and deprivation.
17(viii) Financial and social stress.
18(ix) Effects of trauma.
19(x) The psychological, psychotherapeutic, community, and
20health implications of the matters and life events described in
21clauses (i) to (ix), inclusive.
22(4) At least one semester unit, or 15 hours, of instruction in
23multicultural development and cross-cultural interaction, including
24experiences of race, ethnicity, class, spirituality, sexual orientation,
25gender, and disability, and their incorporation into the
26psychotherapeutic process.
27(5) A minimum of 10 contact hours of training or coursework
28in human sexuality, as specified in Section 25 and any regulations
29promulgated under that section, including the study of
30physiological, psychological, and social cultural variables
31associated with sexual behavior and gender identity, and the
32assessment and treatment of psychosexual dysfunction.
33(6) A minimum of 15 contact hours of coursework in substance
34use disorders, and a minimum of 15 contact hours of coursework
35in cooccurring disorders and addiction. The following subjects
36shall be included in this coursework:
37(A) The definition of substance use disorders, cooccurring
38disorders, and addiction. For purposes of this subparagraph
39“cooccurring disorders” means a mental illness and substance
40abuse diagnosis
occurring simultaneously in an individual.
P17 1(B) Medical aspects of substance use disorders and cooccurring
2disorders.
3(C) The effects of psychoactive drug use.
4(D) Current theories of the etiology of substance abuse and
5addiction.
6(E) The role of persons and systems that support or compound
7substance abuse and addiction.
8(F) Major approaches to identification, evaluation, and treatment
9of substance use disorders, cooccurring disorders, and addiction,
10including, but not limited to, best practices.
11(G) Legal aspects of substance abuse.
12(H) Populations at risk with regard to substance use disorders
13and cooccurring disorders.
14(I) Community resources offering screening, assessment,
15treatment, and followup for the affected person and family.
16(J) Recognition of substance use disorders, cooccurring
17
disorders, and addiction, and appropriate referral.
18(K) The prevention of substance use disorders and addiction.
19(7) A minimum of a two semester or three quarter unit course
20in law and professional ethics for marriage and family therapists,
21including instruction in all of the following subjects:
22(A) Contemporary professional ethics and statutory, regulatory,
23and decisional laws that delineate the scope of practice of marriage
24and family therapy.
25(B) The therapeutic, clinical, and practical considerations
26involved in the legal and ethical practice of marriage and family
27therapy, including, but not limited to, family law.
28(C) The current legal patterns and trends in the mental health
29
professions.
30(D) The psychotherapist-patient privilege, confidentiality, the
31patient dangerous to self or others, and the treatment of minors
32with and without parental consent.
33(E) A recognition and exploration of the relationship between
34a practitioner’s sense of self and human values and his or her
35professional behavior and ethics.
36(F) Differences in legal and ethical standards for different types
37of work settings.
38(G) Licensing law and licensing process.
Section 4980.90 of the Business and Professions Code
40 is amended to read:
(a) This section applies to persons who apply for
2licensure between January 1, 2010, and December 31, 2015,
3inclusive.
4(b) Experience gained outside of California shall be accepted
5toward the licensure requirements if it is substantially equivalent
6to that required by this chapter, if the applicant complies with
7Section 4980.76, if applicable, and if the applicant has gained a
8minimum of 250 hours of supervised experience in direct
9counseling within California while registered as an intern with the
10board. The board shall consider hours of experience obtained in
11another state during the six-year period immediately preceding the
12applicant’s initial licensure by that state as a
marriage and family
13therapist. If the applicant has less than 3,000 hours of qualifying
14supervised experience, time actively licensed as a marriage and
15family therapist shall be accepted at a rate of 100 hours per month
16up to a maximum of 1,200 hours.
17(c) Education gained while residing outside of California shall
18be accepted toward the licensure requirements if it is substantially
19equivalent to the education requirements of this chapter, and if the
20applicant has completed all of the following:
21(1) A two semester or three quarter unit course in California
22law and professional ethics for marriage, family, and child
23counselors that shall include areas of study as specified in Section
244980.41.
25(2) A minimum of
seven contact hours of training or coursework
26in child abuse assessment and reporting as specified in Section 28
27and any regulations promulgated thereunder.
28(3) A minimum of 10 contact hours of training or coursework
29in sexuality as specified in Section 25 and any regulations
30promulgated thereunder.
31(4) A minimum of 15 contact hours of training or coursework
32in alcoholism and other chemical substance dependency as
33specified by regulation.
34(5) (A) Instruction in spousal or partner abuse assessment,
35detection, and intervention. This instruction may be taken either
36in fulfillment of other educational requirements for licensure or
37in a separate course.
38(B) A minimum of 15 contact hours of coursework or training
39in spousal or partner abuse assessment, detection, and intervention
40strategies.
P19 1(6) A minimum of a two semester or three quarter unit survey
2course in psychological testing. This course may be taken either
3in fulfillment of other requirements for licensure or in a separate
4course.
5(7) A minimum of a two semester or three quarter unit survey
6course in psychopharmacology. This course may be taken either
7in fulfillment of other requirements for licensure or in a separate
8course.
9(8) With respect to human sexuality, alcoholism and other
10chemical substance dependency, spousal or partner abuse
11assessment, detection, and intervention, psychological

14(d) For purposes of this section, the board may, in its discretion,

16both of the following requirements:
17(1) The applicant has been granted a degree in a single integrated
18program primarily designed to train marriage and family therapists.
19(2) The applicant’s education meets the requirements of Section
204980.37. The degree title need not be identical to that required by
21subdivision (b) of Section 4980.37. If the applicant’s degree does
22not contain the content or the overall units required by Section
234980.37, the board may, in its discretion, accept the
applicant’s
24education as substantially equivalent if the following criteria are
25satisfied:
26(A) The applicant’s degree contains the required number of
27practicum units and coursework required in the areas of marriage,
28family, and child counseling and marital and family systems
29approaches to treatment as specified in Section 4980.37.
30(B) The applicant remediates his or her specific deficiency by
31completing the course content and the units required by Section
324980.37.
33(C) The applicant’s degree otherwise complies with this section.
34(e) This section shall remain in effect only until January 1, 2016,
35and as of that date is repealed, unless a later enacted
statute, that
36is enacted before January 1, 2016, deletes or extends that date.
Section 4999.57 of the Business and Professions Code
38 is amended to read:
(a) This section applies to a person who applies for
40examination eligibility or registration between January 1, 2011,
P20 1and December 31, 2015, inclusive, who does not hold a license
2described in subdivision (a) of Section 4999.58.
3(b) Experience gained outside of California shall be accepted
4toward the licensure requirements if it is substantially equivalent

meets the requirements of Section 4999.32. If the

25the applicant’s education as substantially equivalent if the following
26criteria are satisfied:
27(1) The applicant’s degree contains the required number of
28practicum units under paragraph (3) of subdivision (c) of Section

Section 4999.58 of the Business and Professions Code
38 is amended to read:
(a) This section applies to a person who applies for
40examination eligibility between January 1, 2011, and December
P21 131, 2015, inclusive, and who meets both of the following
2requirements:
3(1) At the time of application, holds a valid license as a
4professional clinical counselor, or other counseling license that
5allows the applicant to independently provide clinical mental health
6services, in another jurisdiction of the United States.
7(2) Has held the license described in paragraph (1) for at least
8two years immediately preceding the date of application.
9(b) The
board may issue a license to a person described in
10subdivision (a) if all of the following requirements are satisfied:
11(1) The education and supervised experience requirements of
12the other jurisdiction are substantially the equivalent of this chapter,
13as described in subdivision (e) and in Section 4999.46.
14(2) The person complies with subdivision (b) of Section 4999.40,
15if applicable.
16(3) The person successfully completes the examinations required
17by the board pursuant to paragraph (3) of subdivision (a) of Section
184999.50. An applicant who obtained his or her license or
19registration under another jurisdiction by taking a national
20examination that is required by the board may apply for licensure
21with the board
without retaking that examination if both of the
22following conditions are met:
23(A) The applicant obtained a passing score on the national
24licensing examination that is required by the board.
25(B) The applicant’s license or registration in that jurisdiction is
26in good standing at the time of his or her application and has not
27been revoked, suspended, surrendered, denied, or otherwise
28restricted or encumbered as a result of any disciplinary proceeding
29brought by the licensing authority of that jurisdiction.
30(4) The person pays the required fees.
31(c) Experience gained outside of California shall be accepted
32toward the licensure requirements if it is substantially equivalent
33to
that required by this chapter. The board shall consider hours of
34experience obtained in another state during the six-year period
35immediately preceding the applicant’s initial licensure by that state
36as a licensed professional clinical counselor. If the applicant has
37less than 3,000 hours of qualifying supervised experience, time
38actively licensed as a licensed professional clinical counselor shall
39be accepted at a rate of 100 hours per month up to a maximum of
401,200 hours.

38(b) The board may issue a license to a person who, at the time
39of submitting an application for a license pursuant to this chapter,
40holds a valid license as a professional clinical counselor, or other
P28 1counseling license that allows the applicant to independently
2provide clinical mental health services, in another jurisdiction of
3the United States, if all of the following conditions are satisfied:
4(1) The applicant’s education is substantially equivalent, as
5defined in Section
4999.63.
6(2) The applicant complies with subdivision (b) of Section
74999.40, if applicable.
8(3) The applicant’s supervised experience is substantially
9equivalent to that required for a license under this chapter. The
10board shall consider hours of experience obtained outside of
11California during the six-year period immediately preceding the
12date the applicant initially obtained the license described above.
13If the applicant has less than 3,000 hours of qualifying supervised
14experience, time actively licensed as a professional clinical
15counselor shall be accepted at a rate of 100 hours per month up to
16a maximum of 1,200 hours if the applicant’s degree meets the
17practicum requirement described in subparagraph (C) of paragraph
18(1) of subdivision (b) of Section 4999.63 without exemptions
or
19remediation.
20(4) The applicant passes the examinations required to obtain a
21license under this chapter. An applicant who obtained his or her
22license or registration under another jurisdiction may apply for
23licensure with the board without taking the clinical examination
24if both of the following conditions are met:
25(A) The applicant obtained a passing score on the licensing
26examination set forth in regulation as accepted by the board.
27(B) The applicant’s license or registration in that jurisdiction is
28in good standing at the time of his or her application and has not
29been revoked, suspended, surrendered, denied, or otherwise
30restricted or encumbered as a result of any disciplinary proceeding

8(B) For an applicant who obtained his or her degree within the
9timeline prescribed by subdivision (a) of Section 4999.32 the
10degree shall contain no less than 48 graduate semester or 72
11graduate quarter units of instruction.
12(C) Six semester or nine quarter units of practicum, including,
13but not limited to, a minimum of 280 hours of face-to-face
14counseling.
15(D) The required areas of study listed in subparagraphs (A) to
16(M), inclusive, of paragraph (1) of subdivision (c) of Section
174999.33.
18(i) An applicant whose degree is deficient in no more than six
19of the required areas of study listed in subparagraphs (A) to (M),
20inclusive, of paragraph (1) of subdivision (c) may satisfy those
21deficiencies by successfully completing graduate level coursework
22at an accredited or approved institution, as defined in Section
234999.12. Coursework taken to meet those deficiencies shall be the
24equivalent of three semester units or four and one-half quarter
25units of study.
26(ii) An applicant who completed a course in professional
27orientation, ethics, and law in counseling as required by
28subparagraph (I) of paragraph (1) of subdivision (c) of
Section
294999.33 that did not contain instruction in California law and ethics
30shall complete an 18-hour course in California law and professional
31ethics that includes, but is not limited to, instruction in advertising,
32scope of practice, scope of competence, treatment of minors,
33confidentiality, dangerous clients, psychotherapist-client privilege,
34recordkeeping, client access to records, state and federal laws
35relating to confidentiality of patient health information, dual
36relationships, child abuse, elder and dependent adult abuse, online
37therapy, insurance reimbursement, civil liability, disciplinary
38actions and unprofessional conduct, ethics complaints and ethical
39standards, termination of therapy, standards of care, relevant family
P31 1law, and therapist disclosures to clients. An applicant shall
2complete this coursework prior to registration as an intern.
3(iii) An applicant who has not completed a course in professional
4orientation, ethics, and law in counseling as required by
5subparagraph (I) of paragraph (1) of subdivision (c) of Section
64999.33 shall complete this required coursework, including content
7in California law and ethics. An applicant shall complete this
8coursework prior to registration as an intern.
9(2) The applicant completes any units required by subdivision
10(c) of Section 4999.33 not already completed in his or her education
11as follows:
12(A) At least 15 semester units or 22.5 quarter units of advanced
13coursework to develop knowledge of specific treatment issues or
14special populations. This coursework is in addition to the course
15requirements described in subparagraph (D) of paragraph (1).
16(B) Coursework shall be from an accredited or approved school,
17college, or university as defined in Section 4999.12.
18(3) (A) The applicant completes the following coursework not
19already completed in his or her education:
20(i) A minimum of 10 contact hours of training in human
21sexuality, as specified in Section 25 and any regulations
22promulgated thereunder, including the study of the physiological,
23psychological, and social cultural variables associated with sexual
24behavior, gender identity, and the assessment and treatment of
25psychosexual dysfunction.
26(ii) A minimum of 15 contact hours of instruction in spousal or
27partner abuse assessment,
detection, intervention strategies, and
28same-gender abuse dynamics.
29(iii) A minimum of seven contact hours of training or
30coursework in child abuse assessment and reporting as specified
31in Section 28 and any regulations promulgated thereunder.
32(iv) A minimum of 10 contact hours of instruction in aging and
33long-term care, including biological, social, cognitive, and
34psychological aspects of aging. This coursework shall include
35instruction on the assessment and reporting of, as well as treatment
36related to, elder and dependent adult abuse and neglect.
37(B) This coursework may be from an accredited or approved
38school, college, or university as defined in Section 4999.12, or
39from a continuing education provider that is
acceptable to the board
P32 1as defined in Section 4999.76. Undergraduate coursework shall
2not satisfy this requirement.
3(4) The applicant completes the following coursework not
4already completed in his or her education from an accredited or
5approved school, college, or university as defined in Section
64999.12, or from a continuing education provider that is acceptable
7to the board as defined in Section 4999.76. Undergraduate
8coursework shall not satisfy this requirement.
9(A) At least three semester units, or 45 hours, of instruction
10regarding the principles of mental health recovery-oriented care
11and methods of service delivery in recovery-oriented practice
12environments, including structured meetings with various
13consumers and family members of consumers of mental health
14services
to enhance understanding of their experiences of mental
15illness, treatment, and recovery.
16(B) At least one semester unit, or 15 hours, of instruction that
17includes an understanding of various California cultures and the
18social and psychological implications of socioeconomic position.
19(5) An applicant may complete any units and course content
20requirements required under paragraphs (2), (3), or (4) not already
21completed in his or her education while registered with the board
22as an intern.
Section 4999.63 is added to the Business and
24Professions Code, to read:
(a) This section applies to persons who apply for
26examination eligibility or registration on or after January 1, 2016,
27and who hold a license as described in Section 4999.60.
28(b) For purposes of Section 4999.60, education is substantially
29equivalent if all of the following requirements are met:

13does not meet the practicum requirement, shall remediate the
14requirement by demonstrating completion of a total of 280 hours
15of face-to face counseling, as specified in subparagraph (K) of
16paragraph (3) of subdivision (c) of Section 4999.33. Any
17postdegree hours gained to meet this requirement are in addition
18to the 3,000 hours of experience required by this chapter, and shall
19be gained while the applicant is registered with the board as an
20intern.
21(D) The required areas of study specified in subparagraphs
(A)
22to (M), inclusive, of paragraph (1) of subdivision (c) of Section
234999.33.
24(i) An applicant whose degree is deficient in no more than six
25of the required areas of study specified in subparagraphs (A) to
26(M), inclusive, of paragraph (1) of subdivision (c) may satisfy

35after Senate Bill 1466, in which case Section 1 of this bill shall
