An act to amend Section 2191 of the Business and Professions Code, relating to physicians.

AB 2214, as introduced, Fox. Emergency room physicians: continuing medical education: geriatric care.

Existing law requires the Division of Licensing of the Medical Board of California to establish continuing education requirements for physicians and surgeons.

This bill, the Dolores H. Fox Act, would require the division, in determining continuing education requirements, to include a course in geriatric care for emergency room physicians.

Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: no.

The people of the State of California do enact as follows:

SECTION 1.  

This act shall be known and may be cited as the
2Dolores H. Fox Act.

SEC. 2.  

Section 2191 of the Business and Professions Code is
4amended to read:

2191.  

(a) In determining its continuing education requirements,
6the Division of Licensing shall consider including a course in
7human sexuality as defined in Section 2090 and nutrition to be
P2    1taken by those licensees whose practices may require knowledge
2in those areas.

3(b) The division shall consider including a course in child abuse
4detection and treatment to be taken by those licensees whose
5practices are of a nature that there is a likelihood of contact with
6abused or neglected children.

7(c) The division shall consider including a course in acupuncture
8to be taken by those licensees whose practices may require
9knowledge in the area of acupuncture and whose education has
10not included instruction in acupuncture.

11(d) The division shall encourage every physician and surgeon
12to take nutrition as part of his or her continuing education,
13particularly a physician and surgeon involved in primary care.

14(e) The division shall consider including a course in elder abuse
15detection and treatment to be taken by those licensees whose
16practices are of a nature that there is a likelihood of contact with
17abused or neglected persons 65 years of age and older.

18(f) In determining its continuing education requirements, the
19division shall consider including a course in the early detection
20and treatment of substance abusing pregnant women to be taken
21by those licensees whose practices are of a nature that there is a
22likelihood of contact with these women.

23(g) In determining its continuing education requirements, the
24division shall consider including a course in the special care needs
25of drug addicted infants to be taken by those licensees whose
26practices are of a nature that there is a likelihood of contact with
27these infants.

28(h) In determining its continuing education requirements, the
29division shall consider including a course providing training and
30guidelines on how to routinely screen for signs exhibited by abused
31women, particularly for physicians and surgeons in emergency,
32surgical, primary care, pediatric, prenatal, and mental health
33settings. In the event the division establishes a requirement for
34continuing education coursework in spousal or partner abuse
35detection or treatment, that requirement shall be met by each
36licensee within no more than four years from the date the
37requirement is imposed.

38(i) In determining its continuing education requirements, the
39division shall consider including a course in the special care needs
P3    1of individuals and their families facing end-of-life issues, including,
2but not limited to, all of the following:

3(1) Pain and symptom management.

4(2) The psycho-social dynamics of death.

5(3) Dying and bereavement.

6(4) Hospice care.

7(j) In determining its continuation education requirements, the
8division shall give its highest priority to considering a course on
9pain management.

11division shall include a course in geriatric care for emergency
12room physicians.
