An act to amend Section 2191 of the Business and Professions Code, relating to physicians and surgeons.

Existing law, the Medical Practice Act, provides for the licensure and regulation of physicians and surgeons by the Medical Board of California. Existing law requires the Division of Licensing of the Medical Board of California to establish continuing education requirements for physicians and surgeons.begin insert Existing law abolishes the division, provides for the board to handle the responsibilities of the division, and deems a reference to the division to refer to the board.end insert

SECTION 1.  

This act shall be known and may be cited as the
2Dolores H. Fox Act.

SEC. 2.  

Section 2191 of the Business and Professions Code is
4amended to read:

2191.  

(a) In determining its continuing education requirements,
6thebegin delete Division of Licensingend deletebegin insert boardend insert shall consider including a course
7in human sexuality as defined in Section 2090 and nutrition to be
8taken by those licensees whose practices may require knowledge
9in those areas.

10(b) Thebegin delete divisionend deletebegin insert boardend insert shall consider including a course in child
11abuse detection and treatment to be taken by those licensees whose
12practices are of a nature that there is a likelihood of contact with
13abused or neglected children.

14(c) Thebegin delete divisionend deletebegin insert boardend insert shall consider including a course in
15acupuncture to be taken by those licensees whose practices may
16require knowledge in the area of acupuncture and whose education
17has not included instruction in acupuncture.

18(d) Thebegin delete divisionend deletebegin insert boardend insert shall encourage every physician and
19surgeon to take nutrition as part of his or her continuing education,
20particularly a physician and surgeon involved in primary care.

21(e) Thebegin delete divisionend deletebegin insert boardend insert shall consider including a course in elder
22abuse detection and treatment to be taken by those licensees whose
23practices are of a nature that there is a likelihood of contact with
24abused or neglected persons 65 years of age and older.

25(f) In determining its continuing education requirements, the
26begin delete divisionend deletebegin insert boardend insert shall consider including a course in the early
27detection and treatment of substance abusing pregnant women to
28be taken by those licensees whose practices are of a nature that
29there is a likelihood of contact with these women.

30(g) In determining its continuing education requirements, the
31begin delete divisionend deletebegin insert boardend insert shall consider including a course in the special care
32needs of drug addicted infants to be taken by those licensees whose
33practices are of a nature that there is a likelihood of contact with
34these infants.

35(h) In determining its continuing education requirements, the
36begin delete divisionend deletebegin insert boardend insert shall consider including a course providing training
37and guidelines on how to routinely screen for signs exhibited by
38abused women, particularly for physicians and surgeons in
P3    1emergency, surgical, primary care, pediatric, prenatal, and mental
2health settings. In the event thebegin delete divisionend deletebegin insert boardend insert establishes a
3requirement for continuing education coursework in spousal or
4partner abuse detection or treatment, that requirement shall be met
5by each licensee within no more than four years from the date the
6requirement is imposed.

7(i) In determining its continuing education requirements, the
8begin delete divisionend deletebegin insert boardend insert shall consider including a course in the special care
9needs of individuals and their families facing end-of-life issues,
10including, but not limited to, all of the following:

11(1) Pain and symptom management.

12(2) The psycho-social dynamics of death.

13(3) Dying and bereavement.

14(4) Hospice care.

15(j) In determining its continuing education requirements, the

17on pain management.

18(k) In determining its continuing education requirements, the
19begin delete divisionend deletebegin insert boardend insert shall consider including a course in geriatric care
20for emergency room physicians and surgeons.
