           SUBJECT  :  Community College Transportation Fees.
          
           SUMMARY  

          This bill clarifies that a community college district  
          governing board may enter into, or extend, a contract for  
          transportation services funded by the proceeds of a fee  
          levied upon all students of a campus upon a favorable vote  
          of the majority of the students of that campus.

           BACKGROUND  

          Current law authorizes California Community College (CCC)  
          districts to charge a fee to students or to students and  
          employees in order to fund transportation services for  
          purposes of partially or fully recovering the district's  
          transportation costs or for reducing fares for services  
          provided by municipally owned transit services to these  
          students and employees.  

          Current law authorizes fees for transportation services to  
          be required to be paid only by students and employees using  
          the services or, alternatively:

                 Upon a favorable vote of a majority of the students  
               and majority of employees at a campus of the district,  
               the fees may be required to be paid by all students  
               and all employees.

                 Upon a favorable vote of a majority of the students  
               at a campus of the district, the fees may be required  
               to be paid by all students.

          Current law requires a pro-rata fee for part-time students,  
          provides for an optional exemption for low-income students

          and limits a contract for transportation services to no  
          more than 10 years.  

          Current law prohibits the transportation fee from exceeding  
          the amount necessary to reimburse districts for  
          transportation costs/services and caps the amount which may  
          be charged for these services.  Specifically, combined  
          transportation and parking services fees cannot exceed $70  
          per semester or $35 per intersession, or the proportionate  
          equivalent for part-time enrollment.  These fee limits may  
          be increased annually by the same percentage increase as  
          the Implicit Price Deflator for State and Local Government  
          Purchases of Goods and Services. (Education Code § 76360)

           ANALYSIS
           
           This bill  clarifies that the governing board of a community  
          college district may enter into, or extend, a contract for  
          transportation services, funded by the proceeds of a fee  
          paid by all students of a campus, upon a favorable vote of  
          the majority of the students of that campus.  

           STAFF COMMENTS  

           Clarification  .  Current law already provides that a  
          transportation services fee may be required to be paid by  
          all students at a campus upon the favorable vote of a  
          majority of students at the campus.  This bill makes a  
          clarifying and conforming change within existing law to  
          ensure that a contract for transportation services entered  
          into or extended under this authority is subject to a  
          majority vote of students of the district,  or campus of the  
          district  , as appropriate.
