   An act to amend Section  13520   71631.7
 of the Water Code, relating to water.


	LEGISLATIVE COUNSEL'S DIGEST


   AB 2446, as amended, Waldron.  Recycled water: recycling
criteria.   Standby charges: San Luis Rey Municipal
Water District.  
   Existing law, the Municipal Water District Law of 1911, prohibits
a standby assessment or availability charge from exceeding $10 per
acre per year for each acre of land on which the charge is levied or
$10 per year for a parcel less than one acre. Existing law, operative
until January 1, 2015, prohibits a standby assessment or
availability charge levied in any improvement district situated
within the San Luis Rey Municipal Water District from exceeding $30
per acre per year for land on which the charge is levied or $30 per
year for a parcel less than one acre and requires the proceeds in
excess of $10 per acre per year or $10 per year for a parcel less
than one acre to be used for the purposes of the improvement
district.  
   This bill would extend the operation of the provision for San Luis
Rey Municipal Water District until January 1, 2020.  
   Existing law, the Porter-Cologne Water Quality Control Act,
requires the State Department of Public Health to establish uniform
statewide recycling criteria for each varying type of use of recycled
water if the use involves the protection of public health. The act
defines recycling criteria to mean the levels of constituents of
recycled water, and the means for assurance of reliability under the
design concept that will result in recycled water that is safe for
the uses to be made.  
   This bill would make technical, nonsubstantive changes to that
definition.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

   SECTION 1.    Section 71631.7 of the   Water
Code   is amended to read: 
   71631.7.  (a) Notwithstanding Section 71631, in any improvement
district situated within the San Luis Rey Municipal Water District,
the standby assessment or availability charge shall not exceed thirty
dollars ($30) per acre per year for land on which the charge is
levied or thirty dollars ($30) per year for a parcel less than one
acre. In the improvement district, the proceeds from any standby
assessment or availability charge in excess of ten dollars ($10) per
acre per year or ten dollars ($10) per year for a parcel less than
one acre shall only be used for the purposes of that improvement
district.
   (b) This section, applicable only to the San Luis Rey Municipal
Water District, is necessary because of the unique and special water
management problems of those areas included within that district.
   (c) This section shall remain in effect only until January 1,
 2015   2020  , and as of that date is
repealed, unless a later enacted statute, which is enacted before
January 1,  2015   2020  , deletes or
extends that date. 
  SECTION 1.    Section 13520 of the Water Code is
amended to read:
   13520.  As used in this article "recycling criteria" are the
levels of constituents of recycled water, and the means for assurance
of reliability under the design concept that will result in recycled
water that is safe from the standpoint of public health, for the
uses to be made of the recycled water.
