An act to add Division 20.6 (commencing with Section 30961) to the Public Resources Code, relating to sea level rise.

Existing law establishes the Natural Resources Agency consisting of various entities, departments, and boards, including the Department of Water Resources, the California Coastal Commission, the State Energy Resources Conservation and Development Commission, the State Lands Commission, the San Francisco Bay Conservation and Development Commission, and the State Coastal Conservancy.

This bill would require, on or before January 1, 2016, the Natural Resources Agency, in collaboration with the Ocean Protection Council, to create, update monthly, and post on its Internet Web site a Planning for Sea Level Rise Database describing steps being taken throughout the state to prepare for, and adapt to, sea level rise. The bill would require various public and private entities to provide, by July 1, 2015, and on a monthly basis thereafter, information to the Natural Resources Agency to be included in the database, including descriptions of projects that address or prepare for sea level rise that are within the entity’s control or jurisdiction. The bill would require the agency to organize the database by geographic region and provide an entry for each city, county, and city and county within the coastal zone and San Francisco Bay area.

The people of the State of California do enact as follows:

SECTION 1.

30961.  

On or before January 1, 2016, the Natural Resources
8Agency, in collaboration with the Ocean Protection Council, shall
9create and post on its Internet Web site a Planning for Sea Level
10Rise Database describing steps being taken throughout the state
11to prepare for, and adapt to, sea level rise. To be an effective
12inventory of sea level rise planning in the state, the Natural
13Resources Agency shall update the database on a monthly basis
14with information provided by the entities described in Section
1530964.

The Planning for Sea Level Rise Database shall include,
17but shall not be limited to, the following information:

18(a) Title and description of all state and local private and public
19projects addressing or preparing for sea level rise, including
20information described in Section 30963. For purposes of this
21division, “projects” includes studies, programs, modeling, mapping,
22cost-benefit analyses, vulnerability assessments, and adaptation
23assessments.

24(b) Information regarding which cities, counties, and cities and
25counties have implemented a local coastal program, including all
26of the following information:

27(1) When the local coastal program was created.

28(2) All dates on which the local coastal program was updated,
29if updated.

30(3) Whether the local coastal program addresses sea level rise.

31(c) Cities, counties, and cities and counties that do not have a
32local coastal program in place.

30963.  

To the extent applicable, the following information
2shall be included in the description of a project:

3(a) Purpose.

4(b) The person or entity charged with carrying out the project
5and other contributors or collaborators.

6(c) Whether the project is required to be completed by local,
7state, or federal law.

8(d) Geographic location of the project.

9(e) Geographic scope of the project.

10(f) If the project is an assessment, whether it is a risk or
11 vulnerability assessment.

12(g) Whether the project has governance, environmental,
13economic, social equity, or public education objectives, or any
14combination thereof.

15(h) Whether the project results are measurable.

16(i) Whether the project is replicable and, if it is replicable,
17whether the project can be adjusted to apply to different sized
18regions.

19(j) Source of funding for the project.

20(k) Cost of the project.

21(l) Any scientific considerations or science-based facts that are
22involved in the project.

23(m) Relevant maps.

24(n) The project’s estimated date of completion.

25(o) Links to other Internet Web site materials that provide further
26information.

The following entities shall provide information
28described in Sections 30962 and 30963 for projects and local
29coastal programs that are within the entity’s control or jurisdiction,
30as applicable, to the Natural Resources Agency by July 1, 2015,
31and shall continue to provide updated information to the Natural
32Resources Agency on a monthly basis:

33(a) Airports within the California coastal zone or San Francisco
34Bay area.

35(b) California Coastal Commission.

36(c) State Energy Resources Conservation and Development
37Commission.

38(d) California ports.

39(e) Department of Transportation.

3(g) Regional water quality control boards.

4(h) San Francisco Bay Conservation and Development
5Commission.

6(i) State Coastal Conservancy.

7(j) State Lands Commission.

8(k) State Water Resources Control Board.

The Natural Resources Agency, in developing the
10Planning for Sea Level Rise Database, shall organize the database
11by geographic regions, provide an entry for each city, county, and
12city and county within the coastal zone and San Francisco Bay
13area, and include information described in Sections 30962 and
1430963 under each entry. The agency shall organize the database
15in a manner it determines best to provide the public with clear,
16useful, and readily accessible information.

30966.  

It is the intent of the Legislature that the Planning for
18Sea Level Rise Database provide the public with an educational
19tool that will enable parties to view up-to-date information from
20a single, centrally located source about actions taken by cities,
21counties, cities and counties, regions, and public and private entities
22to address sea level rise.

30967.  

Nothing in this division shall alter the duties,
24responsibilities, and jurisdiction of state agencies that provide
25information pursuant to this division.
