   An act to add and repeal Article 6.5 (commencing with Section
9136) to Chapter 1.5. of Part 1 of Division 2 of Title 2 of the
Government Code, relating to the state budget.

   AB 2635, as introduced, Olsen. Performance-based budgeting
practices: legislative review.
   Existing law establishes a joint legislative committee, the Joint
Legislative Budget Committee, to ascertain facts and make
recommendations to the Legislature and the houses thereof concerning
the state budget, the revenues and expenditures of the state, the
organization and functions of the state, its departments,
subdivisions, and agencies, and other matters.
   This bill would require, on or before April 1, 2015, the
Department of Finance to submit a report to the Legislature on the
progress of state agencies that have utilized performance-based
budgeting practices since the implementation of a specified executive
order.
   The California Constitution vests the Legislature with the power
of appropriation and requires the Legislature to pass the budget bill
by midnight on June 15 of each year.
   The bill would expressly state that the budget committees of each
house of the Legislature may consider information from the report
described above and that the Legislature may withhold or modify
appropriations for state agencies that do not comply with the
specified executive order.
   Vote: majority. Appropriation: no. Fiscal committee: yes.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Article 6.5 (commencing with Section 9136) is added to
Chapter 1.5 of Part 1 of Division 2 of Title 2 of the Government
Code, to read:

      Article 6.5.  Legislative Budget Review


   9136.  (a) On or before April 1, 2015, the Department of Finance
shall, notwithstanding Section 9795, submit a report to the
Legislature on the progress of state agencies that have utilized
performance-based budgeting practices since the implementation of
Executive Order B-13-11.
   (b) The Assembly Committee on Budget and the Senate Committee on
Budget and Fiscal Review may consider information contained within
the report required by subdivision (a) in connection with the state
budget for the upcoming fiscal year.
   (c) The Legislature may withhold or modify appropriations for the
upcoming fiscal year for any state agency that fails to timely report
information to the Department of Finance pursuant to Executive Order
B-13-11.
   9136.1.  Pursuant to Section 10231.5, this article is repealed on
April 1, 2019.
