FISCAL EFFECT Minor, absorbable costs to the Department of Industrial Relations. COMMENTS Purpose . Under existing law, certain industries have special time periods to provide final pay to an employee that is discharged or quits. For example, payment of wages for employees laid off or discharged from production of motion pictures may be made by the next regular payday. If an employer willfully fails to pay any wages of an employee who is discharged or who quits, the wages of the employee continue as a penalty for up to 30 days. These wages are often referred to as "waiting time" penalties. The code that governs "waiting time" penalties includes cross-references to the special industry laws so that "waiting time" penalties are still applicable once the special time for payment of wages has lapsed. The statute that governs "waiting time" penalties does not include a cross-reference to the statue governing special time periods for live theatrical and concert industry employers.
