AB 2752 (Transportation Committee) - As Amended: April 24,
2014
SUBJECT : Transportation omnibus bill
SUMMARY : Makes various technical and non-substantive changes
to provisions of law related to transportation. Specifically,
this bill :
1)Replaces outdated references to the Secretary of the Business,
Transportation, and Housing Agency with references to the
Secretary of the Transportation Agency.
2)Makes several clarifying changes relating to the ability of
counties to use an alternative procurement procedure that
authorizes a county road commissioner, or a registered civil
engineer under the direction of the county transportation
director, to have any work upon county highways done under his
or her supervision and direction; including:
a) Clarifying that counties should calculate their eligible
force account work on a fiscal year basis;
b) Clarifying that counties should use the State
Controller's Annual Streets and Roads Report as of March 1
each year to set the cap on the amount of work they are
authorized to perform using the alternative procurement
procedure for the following fiscal year;
c) Clarifying that counties can comply with the requirement
to "declare work" using the alternative procedure in three
ways: listing anticipated projects in the annual budget,
listing anticipated projects for the fiscal year, and/or on
a project-by-project basis; and,
d) Enacting language included in a letter to the Journal by
Assembly Member Hall clarifying that force account work to
facilitate private contracts does not count towards the
annual cap.

District to impose transaction and use taxes to reflect the
currently required two-thirds voter approval for the
imposition of a special tax.
4)Updates the vote threshold for local governments to impose
fuel taxes to reflect the currently required two-thirds voter
approval for the imposition of a special tax.
5)Fixes an incorrect statutory cross-reference to the
Commissioner of the California Highway Patrol's authority to
enter into interstate agreements with the Nevada Highway
Patrol, Arizona Department of Public Safety, and Oregon State
Police.
6)Clarifies that applicants for a California Legacy License
Plate may request a personalized plate or accept a plate
character sequence assigned by the Department of Motor
Vehicles and makes conforming changes related to existing fees
for retention of personalized plates.
7)Fixes an incorrect statutory cross-reference to the definition
of a motor vehicle in a section of the Vehicle Code related to
child passenger restraints.
8)Brings language relating to vehicles transporting hazardous
materials into conformance with federal law to ensure that
California can continue to be eligible for Motor Carrier
Safety Assistance Program grant funds.
EXISTING LAW includes numerous provisions related to
transportation.
FISCAL EFFECT : Unknown
COMMENTS : The Assembly Committee on Transportation is authoring
this year's transportation omnibus bill as a cost-effective way
of making a number of minor, non-controversial changes to
statute at one time. There is no known opposition to any of the
items in the bill. If issues arise that cannot be resolved, the
provision of concern will be deleted from the bill.
