An act to amend Section 44259 of the Education Code, relating to teacher credentialing.

Existing law establishes minimum requirements for the issuance of a preliminary multiple or single subject teaching credential by the Commission on Teacher Credentialing. Among other requirements, existing law requires satisfactory completion of a program of professional preparation accredited by the Committee on Accreditation, but specifies that the program shall not include more than one year, or the equivalent of 15 of a 5-year program, of professional preparation.

SECTION 1.  

Section 44259 of the Education Code is amended
2to read:

44259.  

(a) Except as provided in subparagraphs (A) and (C)
4of paragraph (3) of subdivision (b), each program of professional
5preparation for multiple or single subject teaching credentials shall
6not include more than two yearsbegin delete of, or the equivalent of two-fifths
7of a five-year program in,end delete

8preparation.

9(b) The minimum requirements for the preliminary multiple or
10 single subject teaching credential are all of the following:

11(1) A baccalaureate degree or higher degree from a regionally
12accredited institution of postsecondary education. Except as
13provided in subdivision (c) of Section 44227, the baccalaureate
14degree shall not be in professional education. The commission
15shall encourage accredited institutions to offer undergraduate
16minors in education and special education to students who intend
17to become teachers.

18(2) Passage of the state basic skills proficiency test that is
19developed and administered by the commission pursuant to Section
20 44252.5.

21(3) Satisfactory completion of a program of professional
22preparation that has been accredited by the Committee on
23Accreditation on the basis of standards of program quality and
24effectiveness that have been adopted by the commission. In
25accordance with the commission’s assessment and performance
26standards, each program shall include a teaching performance
27assessment as set forth in Section 44320.2 that is aligned with the
28California Standards for the Teaching Profession. The commission
29shall ensure that each candidate recommended for a credential or
30certificate has demonstrated satisfactory ability to assist pupils to
31meet or exceed academic contentbegin insert and performanceend insert standards for
32pupils adopted by the state board pursuant to Section 60605.
33Programs that meet this requirement for professional preparation
34shall include any of the following:

35(A) Integrated programs of subject matter preparation and
36professional preparation pursuant to subdivision (a) of Section
3744259.1.

P3    1(B) Postbaccalaureate programs of professional preparation,
2pursuant to subdivision (d) of Section 44259.1.

3(C) Internship programs of professional preparation, pursuant
4to Section 44321, Article 7.5 (commencing with Section 44325),
5Article 11 (commencing with Section 44380), and Article 3
6(commencing with Section 44450) of Chapter 3.

7(4) Study of alternative methods of developing English language
8skills, including the study of reading as described in subparagraphs
9(A) and (B), among all pupils, including those for whom English
10is a second language, in accordance with the commission’s
11standards of program quality and effectiveness. The study of
12reading shall meet the following requirements:

13(A) Commencing January 1, 1997, satisfactory completion of
14comprehensive reading instruction that isbegin delete research-basedend deletebegin insert research
15basedend insert
and includes all of the following:

16(i) The study of organized, systematic, explicit skills including
17phonemic awareness, direct, systematic, explicit phonics, and
18decoding skills.

19(ii) A strong literature, language, and comprehension component
20with a balance of oral and written language.

21(iii) Ongoing diagnostic techniques that inform teaching and
22assessment.

23(iv) Early intervention techniques.

24(v) Guided practice in a clinical setting.

25(B) For purposes of this section, “direct, systematic, explicit
26phonics” means phonemic awareness, spelling patterns, the direct
27instruction of sound/symbol codes and practice in connected text,
28and the relationship of direct, systematic, explicit phonics to the
29components set forth in clauses (i) to (v), inclusive, of subparagraph
30(A).

31A program for the multiple subjects credential also shall include
32the study of integrated methods of teaching language arts.

33(5) Completion of a subject matter program that has been
34approved by the commission on the basis of standards of program
35quality and effectiveness pursuant to Article 6 (commencing with
36Section 44310) or passage of a subject matter examination pursuant
37to Article 5 (commencing with Section 44280). The commission
38shall ensure that subject matter standards and examinations are
39aligned with the academic contentbegin insert and performanceend insert standards for
40pupils adopted by the state board pursuant to Section 60605.

P4    1(6) Demonstration of a knowledge of the principles and
2provisions of the Constitution of the United States pursuant to
3Section 44335.

4(7) Commencing January 1, 2000, demonstration, in accordance
5with the commission’s standards of program quality and
6effectiveness, of basic competency in the use of computers in the
7classroom as determined by one of the following:

8(A) Successful completion of a commission-approved program
9or course.

10(B) Successful passage of an assessment that is developed,
11approved, and administered by the commission.

12(c) The minimum requirements for the clear multiple or single
13subject teaching credential shall include all of the following
14requirements:

15(1) Possession of a valid preliminary teaching credential, as
16prescribed in subdivision (b), possession of a valid equivalent
17credential or certificate, or completion of equivalent requirements
18as determined by the commission.

19(2) Except as provided in paragraph (3), completion of a
20program of beginning teacher induction, including one of the
21following:

22(A) A program of beginning teacher support and assessment
23approved by the commission and the Superintendent pursuant to
24Section 44279.1, a provision of the Marian Bergeson Beginning
25Teacher Support and Assessment System.

26(B) An alternative program of beginning teacher induction that
27is provided by one or more local educational agencies and has
28been approved by the commission and the Superintendent on the
29basis of initial review and periodic evaluations of the program in
30relation to appropriate standards of credential program quality and
31effectiveness that have been adopted by the commission, the
32Superintendent, and the state board pursuant to this subdivision.
33The standards for alternative programs shall encourage innovation
34and experimentation in the continuous preparation and induction
35of beginning teachers. An alternative program of beginning teacher
36induction that has met state standards pursuant to this subdivision
37may apply for state funding pursuant to Sections 44279.1 and
3844279.2.

39(C) An alternative program of beginning teacher induction that
40is sponsored by a regionally accredited college or university, in
P5    1cooperation with one or more local school districts, that addresses
2the individual professional needs of beginning teachers and meets
3the commission’s standards of induction. The commission shall
4ensure that preparation and induction programs that qualify
5candidates for professional credentials extend and refine each
6beginning teacher’s professional skills in relation to the California
7Standards for the Teaching Profession and the academic content
8begin insert and performance end insert standards for pupils adopted by the state board
9pursuant to Section 60605.

10(3) (A) If a candidate satisfies the requirements of subdivision
11(b), including completion of an accredited internship program of
12professional preparation, and if that internship program fulfills
13induction standards and is approved as set forth in this subdivision,
14the commission shall determine that the candidate has fulfilled the
15requirements of paragraph (2).

16(B) If an approved induction program is verified as unavailable
17to a beginning teacher, or if the beginning teacher is required under
18the federal No Child Left Behind Act of 2001 (20 U.S.C. Sec. 6301
19et seq.) to complete subject matter coursework to be qualified for
20a teaching assignment, the commission shall accept completion of
21an approved clear credential program after completion of a
22baccalaureate degree at a regionally accredited institution as
23fulfilling the requirements of paragraph (2). The commission shall
24adopt regulations to implement this subparagraph.

25(4) Experience that includes the application of knowledge and
26skills previously acquired in a preliminary credential program, in
27accordance with commission standards, that addresses the
28following:

29(A) Health education, including study of nutrition,
30cardiopulmonary resuscitation, and the physiological and
31sociological effects of abuse of alcohol, narcotics, and drugs and
32the use of tobacco. Training in cardiopulmonary resuscitation shall
33also meet the standards established by the American Heart
34Association or the American Red Cross.

35(B) Field experience in methods of delivering appropriate
36educational services to pupils with exceptional needs in regular
37education programs.

38(C) Advanced computer-based technology, including the uses
39of technology in educational settings.

P6    1(d) The commission shall develop and implement standards of
2program quality and effectiveness that provide for the areas of
3application listed in subparagraphs (A) to (C), inclusive, of
4paragraph (4) of subdivision (c), starting in professional preparation
5and continuing through induction.

6(e) A credential that was issued before January 1, 1993, shall
7remain in force as long as it is valid under the laws and regulations
8that were in effect on the date it was issued. The commission shall
9not, by regulation, invalidate an otherwise valid credential, unless
10it issues to the holder of the credential, in substitution, a new
11credential authorized by another provision in this chapter that is
12no more restrictive than the credential for which it was substituted
13with respect to the kind of service authorized and the grades,
14classes, or types of schools in which it authorizes service.

15(f) A credential program that is approved by the commission
16 shall not deny an individual access to that program solely on the
17grounds that the individual obtained a teaching credential through
18completion of an internship program when that internship program
19has been accredited by the commission.

20(g) Notwithstanding this section, persons who were performing
21teaching services as of January 1, 1999, pursuant to the language
22of this section that was in effect before that date, may continue to
23perform those services without complying with any requirements
24that may be added by the amendments adding this subdivision.

25(h) Subparagraphs (A) and (B) of paragraph (4) of subdivision
26(b) do not apply to any person who, as of January 1, 1997, holds
27a multiple or single subject teaching credential, or to any person
28enrolled in a program of professional preparation for a multiple
29or single subject teaching credential as of January 1, 1997, who
30subsequently completes that program. It is the intent of the
31Legislature that the requirements of subparagraphs (A) and (B) of
32paragraph (4) of subdivision (b) be applied only to persons who
33enter a program of professional preparation on or after January 1,
341997.
