           SUMMARY  

          This bill adds human trafficking victims who have suffered  
          emotional injury to the list of victims eligible for  
          compensation from the Victim Compensation Program administered  
          by the California Victim Compensation and Government Claims  
          Board (Board). 

          This bill also deletes obsolete language relative to a lapsed  
          pilot program.
           
           FISCAL EFFECT  

          Minor Restitution Fund costs to the extent this bill results in  
          additional successful claims by explicitly making human  
          trafficking victims eligible for crime victim compensation. The  
          Board is unaware of any denied claims from a human trafficking  
          victim.   

          The $160 million Restitution Fund has a projected 2013-14  
          reserve of $40 million.

           COMMENTS  

           1)Rationale  . The author contends explicitly making human  
            trafficking victims will safeguard restitution efforts on  
            their behalf. 

           2)Current law:

              a)   Provides that violating the freedom of another with the  
               intent to commit specified crimes, including enticing a

               minor to become a prostitute, using a child under 16 for a  
               lewd act, abducting a minor for prostitution, pornography,  
               sexual exploitation, or using a minor to perform a  
               prohibited act, is human trafficking, generally punishable  
               by 8, 14, or 20 years in state prison, and/or by a fine of  
               up to $500,000.  

             b)   Authorizes the Board to reimburse specified crime  
               victims for financial losses they suffer as a direct result  
               of criminal acts, with indemnification made from the  
               Restitution Fund, which is continuously appropriated to the  
               Board for these purposes.

             c)   Provides specified crime victims - those who suffer  
               physical or emotional injury - are eligible for Board  
               compensation, which is generally limited to a total of  
               $35,000, and includes payment for medical expenses,  
               counseling, loss of income, employment services,  
               residential security enhancements, and relocation expenses.
