An act to amend Section 431 of the Military and Veterans Code, relating to the state militia.

Existing law authorizes the Adjutant General to take specified actions with respect to state armories, including leasing or otherwise authorizing the use of all armories for any lawful purpose, and requires all revenues or income from any armory to be paid into the Armory Discretionary Improvement Account in the General Fund.

This bill would make technical, nonsubstantive changes to this provision.

The people of the State of California do enact as follows:

SECTION 1.  

Section 431 of the Military and Veterans Code
2 is amended to read:

431.  

(a) The Adjutant General may, either directly or through
4armory boards, or through subordinate commanders, lease or
5otherwise authorize the use of, by any person for any lawful
6purpose, manage, supervise all activities in, perform all necessary
7military duties with respect to and control all armories that are
8built or acquired by the state, that come into possession or control
9of the state, or that are erected, purchased, leased, or provided or
P2    1contributed to, in whole or in part, by any city, county, political
2subdivision, or district, or by anyone, for armory purposes.

3(b) The Adjutant General may contract with the United States
4for the operation of any armory for purposes of training of federal
5military personnel, with provision that all state costs related to that
6operation shall be reimbursed by the United States.

7(c) All revenues or income from any armory shall be paid to
8the Adjutant General who shall account for the revenues or income
9to the Controller at the close of each month in the form that the
10Controller prescribes and shall deposit the revenues and income
11into the Treasury to the credit of the Armory Discretionary
12Improvement Account, which is hereby created, in the General
13Fund. The revenues and income in the account shall bebegin insert madeend insert
14 available,begin delete when appropriatedend deletebegin insert upon appropriation by the end insert
15begin insertLegislatureend insert, to the Adjutant General, for allocation for the
16 maintenance, repairs, improvements, and operating expenses
17necessary or desirable for increased or improved community
18utilization of the facilities of the armory from which the revenues
19and income were derived.
