An act to amend Section 33200 of the Public Resources Code, relating to the Santa Monica Mountains Conservancy.

Existing law, the Santa Monica Mountains Conservancy Act, establishes the Santa Monica Mountains Conservancy and prescribes the membership, functions, and duties of the conservancy with regard to the protection and preservation of lands within the Santa Monica Mountains Zone, as defined. Existing law requires the conservancy be composed of 9 voting members and 3 ex officio members, as specified, and requires the Supervisor of the Angeles National Forest to serve as an ex officio, nonvoting member of the conservancy.

This bill would authorize the Supervisor of the Angeles National Forest to vote on a manner related to a project located within, adjacent to, or substantially affecting, the Angeles National Forest.

The people of the State of California do enact as follows:

SECTION 1.  

Section 33200 of the Public Resources Code is

33200.  

(a) The Santa Monica Mountains Conservancy is
4hereby established within the Resources Agency. The conservancy
P2    1is composed of nine voting members and three ex officio members.
2The voting members are as follows:

3(1) The Superintendent of the Santa Monica Mountains National
4Recreation Area, or his or her designee.

5(2) A member representing the City of Los Angeles, appointed
6by the mayor with the approval of the city council.

7(3) Three public members who shall be residents of either the
8County of Los Angeles or the County of Ventura, one of whom
9shall be appointed by the Governor, one of whom shall be
10 appointed by the Senate Committee on Rules, and one of whom
11shall be appointed by the Speaker of the Assembly. At least one
12of the public members shall reside within the San Fernando Valley
13statistical area, as defined in Section 11093 of the Government
14Code. The seat of a public member shall be deemed vacant if the
15member changes his or her residence to a county other than Los
16Angeles or Ventura County.

17(4) An elected official who is a representative nominated by the
18city councils of those cities which have at least 75 percent of their
19areas within the zone who shall be appointed by the Board of
20Supervisors of the County of Los Angeles or a member appointed
21by the Board of Supervisors of the County of Los Angeles, or that
22member’s designee.

23(5) An elected official who is either a member of the City
24Council of the City of Thousand Oaks or a member of the Board
25of Supervisors of the County of Ventura and who shall be
26appointed by the Board of Supervisors of the County of Ventura,
27or the elected official’s designee.

28(6) The Secretary of the Resources Agency or an employee of
29the agency designated by the secretary.

30(7) The Superintendent of the Angeles District of the Department
31of Parks and Recreation, or his or her designee.

32(b) (1) (A) The California Coastal Commission and the State
33Coastal Conservancy shall each appoint an ex officio member who
34shall be either a member or employee of their respective agency.
35The ex officio member appointed by the California Coastal
36Commission and the State Coastal Conservancy shall be nonvoting
37members, except that the ex officio member appointed by the State
38Coastal Conservancy may vote on any matter relating to a project
39undertaken within the coastal zone portion of the zone.

P3    1(B) On the 10th working day after certification pursuant to
2Chapter 6 (commencing with Section 30500) of Division 20 of
3any local coastal program, or any portion thereof, for any portion
4of the zone, the ex officio member appointed by the California
5Coastal Commission may vote on any matter relating to a project
6undertaken within the coastal zone portion of the zone and the ex
7officio member appointed by the State Coastal Conservancy may
8not vote on the matter.

12(B) The Supervisor of the Angeles National Forest may vote on
13a matter relating to a project located within, adjacent to, or
14substantially affecting, the Angeles National Forest.

15(c) The chairperson and vice chairperson of the conservancy
16shall be selected by the voting members of the conservancy for a
17one-year term. A majority of the total authorized and appointed
18voting membership of the conservancy constitutes a quorum for
19the transaction of any business under this division.

20(d) (1) The following members of the conservancy shall be
21compensated for attendance at regular meetings of the conservancy
22at the rate of one hundred dollars ($100) per day:

23(A) The public members.

24(B) The member appointed by the Board of Supervisors of the
25County of Los Angeles or that member’s designee, unless the
26member or designee is also a member of the board of supervisors,
27in which case no compensation shall be paid.

28(C) The member appointed by the Board of Supervisors of the
29County of Ventura or that member’s designee, unless the member
30or designee is also a member of a board of supervisors, in which
31case no compensation shall be paid.

32(D) The members appointed by the State Coastal Conservancy
33and the California Coastal Commission if these members are not
34employees of their respective agency or are not full-time
35compensated elected officials.

36(E) The appointed member representing the City of Los Angeles.

P4    1(2) All members of the conservancy shall be reimbursed for
2actual and necessary expenses, including travel expenses, incurred
3in the performance of their duties.
