An act to add Section 12289 to the Elections Code, relating to elections.

LEGISLATIVE COUNSEL’S DIGEST

SB 267, as amended, Pavley. Polling places: higher education campuses.

(1) Existing law requires elections officials to establish a convenient number of election precincts and designate a polling place for each precinct. Under existing law, the local elections official may request the use of school buildings as polling places.

This bill would, forbegin insert statewide generalend insert electionsbegin delete conducted by a county or city and countyend deletebegin insert held in November of each even-numbered yearend insert, require the county or city and county elections official to establish precincts consisting solely of, and corresponding polling places within, each campus of a community college, the California State University, or the University of California, if the campus meets specified requirements. The bill would require the California State University and the California Community Colleges, and request the University of California, to provide access for the use of their campuses as polling places. By requiring county and city and county elections officials to perform new duties, and the California Community Colleges to provide access as polling places, the bill would impose a state-mandated local program.

(2) The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.

This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.

SECTION 1.  

Section 12289 is added to the Elections Code, to

5first Monday in November of each even-numbered yearend insert
, the county
6or city and county elections official shall establish precincts
7consisting solely of, and corresponding polling places within, each
8campus of a community college, the California State University,
9and the University of California, if the campus meets all of the
10following requirements:

11(1) The campus is within the county or city and county’s
12jurisdiction.

13(2) At least 1,000 people live on the campus.

14(3) The campus complies with accessibility requirements and
15guidelines for polling places established by the Secretary of State.

16(b) The California State University and the California
17Community Colleges shall, and the University of California is
18requested to, provide access for use of their campuses as polling
19places. This section does not apply to a campus of the University
20of California if the campus refuses a request for access to the
21campus as a polling place.

22(c) An elections official may establish, pursuant to this section,
23multiple polling places within a campus to meet the unique
24population needs of each campus.

25(d) Each campus within which a polling place is established
26pursuant to this section and the elections official establishing the
27polling place are encouraged to inform the campus community
P3    1that only voters who are registered within the campus precinct
2boundaries are allowed to vote at the campus polling place.

3(e) An elections official may establish a polling place within a
4campus within which a polling place is not required to be
5established pursuant to this section.

SEC. 2.  

If the Commission on State Mandates determines that
7this act contains costs mandated by the state, reimbursement to
8local agencies and school districts for those costs shall be made
9pursuant to Part 7 (commencing with Section 17500) of Division
104 of Title 2 of the Government Code.
