The California Clean Energy Jobs Act, an initiative approved by the voters at the November 6, 2012, statewide general election as Proposition 39, made changes to corporate income taxes and, except as specified, provides for the transfer of $550,000,000 annually from the General Fund to the Clean Energy Job Creation Fund for 5 fiscal years beginning with the 2013-14 fiscal year. Moneys in the Clean Energy Job Creation Fund are available, upon appropriation by the Legislature, for purposes of funding eligible projects that create jobs in California improving energy efficiency and expanding clean energy generation. Existing law provides for the allocation of these funds for eligible projects at public school facilities, university and college facilities, and other public buildings and facilities, as well as job training and workforce development, and public-private partnerships, as specified.

This bill would require the State Energy Resources Conservation and Development Commission to develop and administer a financial assistance program to assist the California Community Colleges, the California State University, and the University of California with energy efficiency and clean energy onsite generation projects. The bill would require the commission to develop and adopt specific guidelines for the program. The bill would appropriate for the 2013-14 fiscal year an unspecified sum from the Clean Energy Job Creation Fund to the commission for the above purpose, thereby making an appropriation.

(1) Existing law requires elections officials to establish a convenient number of election precincts and designate a polling place for each precinct. Under existing law, the local elections official may request the use of school buildings as polling places.

This bill would, for statewide general elections held in November of each even-numbered year, require the county or city and county elections official to establish precincts consisting solely of, and corresponding polling places within, each campus of a community college, the California State University, or the University of California, if the campus meets specified requirements. The bill would require the California State University and the California Community Colleges, and request the University of California, to provide access for the use of their campuses as polling places. By requiring county and city and county elections officials to perform new duties, and the California Community Colleges to provide access as polling places, the bill would impose a state-mandated local program.

(2) The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.

This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.

(a) The State Energy Resources Conservation and
5Development Commission shall develop and administer a financial
6assistance program to assist the California Community Colleges,
7the California State University, and the University of California
8with energy efficiency and clean energy onsite generation projects.

9(b) In addition to the criteria specified in Section 26206, the
10State Energy Resources Conservation and Development
11Commission shall develop and adopt guidelines that do all of the
12following:

13(1) Establish audit standards and procedures.

14(2) Ensure that the projects receiving financial assistance are
15 consistent with the state’s loading order, as described in the Energy
16Plan II jointly adopted by the State Energy Resources Conservation
17and Development Commission and the Public Utilities Commission.

18(3) Ensure that the projects are reliable and feasible with total
19energy savings benefits exceeding project costs.

20(4) Establish energy savings measurement and verification
21standards.

22(5) Require the recipient of financial assistance to report to the
23commission on energy savings achieved.

24(6) If the project is for clean energy onsite generation, require
25that the energy cost savings over 75 percent of the expected life
26of the project will exceed the initial investment.

27(7) Give priority to projects that have the highest energy savings
28relative to the amount of public moneys used to finance the project.

29(8) Include funding for the California Community Colleges, the
30California State University, and the University of California in
31the following proportions:

32(A) ____ percent for projects of the California Community
33Colleges.

34(B) ____ percent for projects of the California State University.

35(C) ____ percent for projects of the University of California.

36(9) (A) Require the Chancellor of the California Community
37Colleges to be responsible for submitting to the commission
38applications for financial assistance and reports on project
39outcomes.

2be responsible for submitting to the commission applications for
3financial assistance and reports on project outcomes.

4(C) Require the University of California to be responsible for
5submitting to the commission applications for financial assistance
6and reports on project outcomes.

7(c) The State Energy Resources Conservation and Development
8Commission may use its existing grant and financing programs to
9minimize administrative costs associated with the program,
10including the program developed pursuant to the Energy
11Conservation Assistance Act of 1979 (Chapter 5.2 (commencing
12with Section 25410) of Division 15).

SECTION 1.  

Section 12289 is added to the Elections Code, to
18read:

12289.  

(a) For each statewide general election held on the first
20Tuesday after the first Monday in November of each
21even-numbered year, the county or city and county elections
22official shall establish precincts consisting solely of, and
23corresponding polling places within, each campus of a community
24college, the California State University, and the University of
25California, if the campus meets all of the following requirements:

26(1) The campus is within the county or city and county’s
27jurisdiction.

28(2) At least 1,000 people live on the campus.

29(3) The campus complies with accessibility requirements and
30guidelines for polling places established by the Secretary of State.

31(b) The California State University and the California
32Community Colleges shall, and the University of California is
33requested to, provide access for use of their campuses as polling
34places. This section does not apply to a campus of the University
35of California if the campus refuses a request for access to the
36campus as a polling place.

37(c) An elections official may establish, pursuant to this section,
38multiple polling places within a campus to meet the unique
39population needs of each campus.

P5    1(d) Each campus within which a polling place is established
2pursuant to this section and the elections official establishing the
3polling place are encouraged to inform the campus community
4that only voters who are registered within the campus precinct
5boundaries are allowed to vote at the campus polling place.

6(e) An elections official may establish a polling place within a
7campus within which a polling place is not required to be
8established pursuant to this section.

SEC. 2.  

If the Commission on State Mandates determines that
10this act contains costs mandated by the state, reimbursement to
11local agencies and school districts for those costs shall be made
12pursuant to Part 7 (commencing with Section 17500) of Division
134 of Title 2 of the Government Code.
