SB 291, as amended, Hill. Public Utilities Commission: safety enforcement: gas and electrical corporations.
Under existing law, the Public Utilities Commissionbegin delete (PUC)end delete has regulatory authority over public utilities, including gas corporations and electrical corporations, as defined. The Public Utilities Act requires thebegin delete PUCend deletebegin insert commissionend insert to investigate the cause of all accidents occurring upon the property of any public utility or directly or indirectly arising from or connected with its maintenance or operation, resulting in loss of life or injury to person or property and requiring, in the judgment of thebegin delete PUCend deletebegin insert
commissionend insert, investigation by it, and authorizes thebegin delete PUCend deletebegin insert commissionend insert to make any order or recommendation with respect to the investigation that it determines to be just and reasonable. The act additionally authorizes thebegin delete PUCend deletebegin insert commissionend insert to ascertain and fix just and reasonable standards, classifications, regulations, practices, measurements, or services to be furnished, imposed, observed, and followed by specified public utilities, including electrical and gas corporations. Existing law authorizes thebegin delete PUCend deletebegin insert
commissionend insert
to issue and serve citations in the enforcement of certain pipeline safety laws applicable to mobilehome park gas delivery systems and propane operators.
This bill would require thebegin delete PUCend deletebegin insert commission, in an existing or new proceeding,end insert to develop and implementbegin insert a safety enforcement program that includesend insert procedures for issuance of citations bybegin delete PUCend deletebegin insert commissionend insert staff, under the direction of the Executive Director of thebegin delete PUCend deletebegin insert
commissionend insert, to gas corporations and electrical corporations for correction and punishment of safety violations. The bill would require thebegin delete PUCend deletebegin insert commissionend insert to develop and implement an appeals process to govern issuance and appeal of citationsbegin insert, or resolution of corrective action orders. The bill would require the commission to implement the safety enforcement program for gas safety by July 1, 2014, and for electric safety by January 1, 2015end insert.

Section 1702.5 is added to the Public Utilities
2Code, to read:
(a) The commission shallbegin insert, in an existing or new
4proceeding,end insert develop and implementbegin delete procedures for issuance of begin insert a safety enforcement program applicableend insert to gas
5citations by commission staff, under the direction of the Executive
6Director,end delete
7corporations and electrical corporationsbegin delete for correction and begin insert,
which includes procedures for
8punishment of safety violationsend delete
9issuance of citations by commission staff, under the direction of
10the Executive Director. The enforcement program shall be designed
11to improve gas and electric system safety through the enforcement
12of applicable law, or order or rule of the commission related to
13safety using a variety of enforcement mechanisms, including the
14issuance of corrective actions, orders, and citations by designated
15commission staffend insert.
16(1) When issuing citations and assessing penalties, the
17commission staff shall take into account voluntary removal or
18resolution efforts undertaken, the prior history of violations, the
19gravity of the violation, and the degree of culpability.
20(2) The procedures shall include, but are not limited to,
21providing notice of violation and a
reasonable period, not to exceed
2230 calendar days, for the respondent to correct the violation, to
23allow one or more hearings within 60 days of being a citation at
24the request of the respondent.
P3 1(3) The commission shall adopt an administrative limit on the
2amount of monetary penalty that may be set by commission staff.
3(b) The commission shall develop and implement an appeals
4process to govern the issuance and appeal of citationsbegin insert or resolution
5of corrective action ordersend insert issued by the commissionbegin insert staffend insert.
6(c) The commission shall, within a reasonable time set by the
7commission, conclude a safety enforcement action by determining
8a finding of violation, by corrective action order, citation,
9determination of no violation, or other action. The commission
10may institute a formal proceeding regarding the alleged violation
11regardless of any enforcement action taken at the commission staff
12level.
13(d) The commission shall implement the safety enforcement
14program for gas safety by July 1, 2014, and the safety enforcement
15program for electric safety no later than January 1, 2015.
