BILL ANALYSIS Ó SB 305 Page 1 Date of Hearing: August 14, 2013 ASSEMBLY COMMITTEE ON APPROPRIATIONS Mike Gatto, Chair SB 305 (Lieu) - As Amended: August 5, 2013 Policy Committee: Business and Professions Vote: 13-0 Urgency: No State Mandated Local Program: No Reimbursable: No This bill extends the sunset dates for, and implements recommendations that emerged from the legislative sunset review of, various boards regulated by the Department of Consumer Affairs (DCA). Specifically, this bill: 1)Extends until January 1, 2018 the sunset dates for the provisions establishing the Naturopathic Medicine Committee (NMC), the Speech-Language Pathology and Audiology and Hearing Aid Dispensers Board (SLPHADB), The Board of Occupational Therapy (BOT), the Board of Optometry (OB), and the Respiratory Care Board of California (RCB). 2)Extends the term of the executive officers of the SLPHADB, RCB, and the OB. 3)Specifies that any board, committee, or bureau regulated by DCA is authorized to receive specified criminal records needed to complete an application for licensure. 4)Exempts certain individuals performing pulmonary tests in specified hospitals in Los Angeles County from certain licensure requirements. 5)Provides that the Osteopathic Medical Board of California and the State Board of Chiropractic Examiners, which were created by initiative, shall be subject to review by the appropriate policy committees of the Legislature. FISCAL EFFECT Annual fee-supported special fund costs associated with continued operation of the following regulatory entities, as SB 305 Page 2 follows: a)NMC - $165,000. b)SLPHADB - $1.9 million. c)BOT - $1.4 million. d)OB - $1.8 million. e)RCB - $3.3 million. COMMENTS 1)Rationale . This bill extends the sunset on provisions establishing various boards for four years, and makes other minor changes that emerged from legislative sunset review hearings. 2)Related Legislation . SB 198 (Lieu) also being heard in committee today, is a sunset review bill relating to the Physical Therapy Board. SB 304 (Price), which makes changes to the Medical Practice Act and to the Medical Board of California, is pending in the Assembly Business, Professions and Consumer Protection Committee. SB 306 (Price), 2013, contained numerous provisions that are now included in this bill. This bill was amended to address an unrelated topic and its provisions were added to this bill.
