Existing law provides that the Department of Transportation has full possession and control of all state highways. Existing law describes the authorized routes in the state highway system and establishes a process for adoption of a highway on an authorized route by the California Transportation Commission.begin insert Existing law provides for relinquishment by the commission of highways to local agencies upon relocation and under various other circumstances.end insert

The relinquishment would be subject to a determination by the commission that it is in the best interest of the state to do so and terms and conditions approved by the commission. The relinquishment would be subject to an agreement by the city to accept the relinquishment. The bill would thereafter require the commission to adopt the new bypass alignment into the state highway system upon a determination that it is in the best interests of the state to do soend insert.

The people of the State of California do enact as follows:

(a) Upon a determination by the commission that it is
4in the best interest of the state to do so, the commission may, upon
5terms and conditions approved by it, relinquish to the City of
6Hollister the portion of Route 25 that is located between
7Sunnyslope Road and San Felipe Road within the city limits of
8that city prior to the relocation of that portion of Route 25 through
9adoption of the proposed new easterly bypass alignment of Route
1025, if the city agrees to accept the relinquishment.
11(b) The terms and conditions imposed pursuant to subdivision
12(a) shall include a requirement for the City of Hollister to maintain
13within its jurisdiction signs directing motorists to the continuation
14of Route 25 until such time as the new easterly bypass
alignment
15is adopted and opens to traffic.
16(c) A relinquishment under this section shall become effective
17immediately following the recording by the county recorder of the
18relinquishment resolution containing the commission’s approval
19of the terms and conditions of the relinquishment.
20(d) On and after the effective date of the relinquishment, both
21of the following shall apply:
22(1) The relinquished portion of Route 25 shall cease to be a
23state highway.
24(2) The relinquished portion of Route 25 may not be considered
25for future adoption under Section 81.
26(e) Upon a determination by the commission that it is in the best
27interest of the state to do so, the commission shall, upon terms and
28
conditions approved by it, adopt into the state highway system the
29proposed easterly bypass alignment for Route 25 that is located
30between the limits of Sunnyside Road and San Felipe Road in the
31City of Hollister. The adoption may occur at any time after the
32effective date of the relinquishment pursuant to subdivision (c).
Section 325 of the Streets and Highways Code
34 is amended to read:
Route 25 is from Route 198 to Route 101 near Gilroy.
