   An act to add Section 12025 to the Government Code, relating to
the  Governor's Budget.   state government.
	LEGISLATIVE COUNSEL'S DIGEST
   SB 335, as amended, Yee.  Governor's Budget: services
  Expenditures: service  contracts.
   Existing law requires  the Governor to submit to the
Legislature, within the first 10 days of each calendar year, a budget
for the ensuing fiscal year containing itemized statements for
recommended state expenditures and estimated state revenues. The
budget must include a statement of accounts payable and a statement
of cashflow for the previous fiscal year, as well as estimates of
accounts payable and cashflow for the current fiscal year and the
succeeding fiscal year.   the Financial Information
System for California (FISCal) to include a state budget transparency
component that allows the public to have access, on an Internet Web
site, to specified information for each General Fund and federal fund
expenditure.  
   This bill would require the Governor, upon full implementation of
the Financial Information System for California (FI$Cal) Project, to
submit an annual report that would be made available on the FI$Cal
Project Internet Web site, that contains specified information
regarding current contracts for services in the amount of $5,001 or
more.  
   This bill would require, upon full implementation of the FISCal
Project for state departments and agencies required to use the FISCal
system, specified information regarding contracts for services in
the amount of $5,001 or more to be made available to the public on
the FISCal Project Internet Web site in a format that allows for
searching and sorting by specified categories.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
  SECTION 1.  Section 12025 is added to the Government Code, to read:
   12025.   (a)    Upon full
implementation of the Financial Information System for California
 (FI$Cal)   (FISCal)  Project  ,
the Governor shall submit to the Legislature an annual report
  for state departments and agencies required to use the
FISCal system, information  regarding  current
 contracts for services in the amount of five thousand one
dollars ($5,001) or  more. The report shall contain all of
the following:   more shall be made available to the
public on the FISCal Project Internet Web site in a format that
allows for searching and sorting by the following categories: 
   (1) 
    (a)  A description of the contract and the services
being purchased. 
   (2) 
    (b)  The name of the agency contracting for the
services. 
   (3) 
    (c)  The name of the contractor and any subcontractors
 , unless otherwise exempt from disclosure  . 
   (4) 
    (d)  The effective date and expiration date of the
contract. 
   (5) 
    (e)  The annual amounts paid under the contract, by
funding source, to the contractor in  past  
prior  fiscal  years and in the current fiscal year.

   (6) The annual amount, by funding source, proposed to be paid to
the contractor under the Governor's Budget.  
   (7) The amount, by funding source, projected to be paid to the
contractor in the fiscal years covered by the contract beyond the
fiscal year addressed in the Governor's Budget.  
   (8) 
    (f)  The total projected cost of the contract, 
by funding source,   or maximum cost the contract is
prohibited from exceeding,  for all fiscal years during which
the contract will be in effect. 
   (g) The acquisition method.  
   (9) Whether the contract was a sole source procurement. 
   (b) The information required by subdivision (a) shall be presented
in the report by agency or comparable budget category. 
   (c) The report shall provide the total cost of contracting for
services for each fund and agency or comparable budget category.
 
   (d) The information required by this section shall be made
available to the public by posting it on the FI$Cal Project Internet
Web site in a format that allows for searching and sorting by the
categories listed in subdivision (a).
