Existing law, the Charter Schools Act of 1992, requires, as a condition of apportionment, among other things, a charter school to offer 64,800 minutes of instruction in a fiscal year for pupils in grades 9 to 12, inclusive, and, for classroom-based instruction, as defined, to have at least 80% of the instructional time offered to be at the schoolsite.

begin insertThe Legislature finds and declares that early college
6high schools are innovative partnerships between charter or
7noncharter public secondary schools and a local community
8college, the California State University, or the University of
9California that allow pupils to earn a high school diploma and up
10to two years of college credit in four years or less. Early college
11high schools are small, autonomous schools that blend high school
12and college into a coherent educational program. In early college
13high schools, pupils begin taking college courses as soon as they
14demonstrate readiness and the college credit earned may be
15applied toward completing an associate or bachelor’s degree,
16transfer to a four-year university, or obtaining a skills certificate.
Section 46146.5 of
the Education Code is amended to
19read:
(a) A day of attendance for a pupil enrolled in grade
2111 or 12 at an early college high school or middle college high
22school is 180 minutes of attendance if the pupil is also enrolled
23part time in classes of the California State University or the
24University of California for which academic credit will be provided
25upon satisfactory completion of enrolled courses.
26(b) A day of attendance for a pupil enrolled in an early college
27high school or middle college high school, who is also a special
28part-time student enrolled in a community college under Article
291 (commencing with Section 48800) of Chapter 5 of Part 27, and
30who will receive academic credit upon satisfactory completion of
31enrolled
courses, is 180 minutes of attendance.
32(c) A day of attendance for a pupil enrolled in an early college
33high school or middle college high school who does not satisfy
34subdivision (a) or (b) is 240 minutes of attendance.
35(d) For a charter school that is an early college high school or
36middle college highbegin delete school eligible to claim classroom-based begin insert school, for purposes of
37instruction apportionments in accordance with subdivision (e) of
38Section 47612.5, a day of attendance for a pupil enrolled in grade
3911 or 12 is 180 minutes of attendanceend delete

32(g) Subdivisions (d) and (e) shall not change the requirement
33for charter schools to offer the minimum number of annual
34instructional minutes pursuant to paragraph (1) of subdivision (a)
35of Section 47612.5.
36(h) For a pupil enrolled in a charter school that is an early
37college high school or middle college high school who does not
38satisfy the attendance and enrollment requirements in subdivision
39(d) or (e), attendance shall be claimed by the charter school
40pursuant to Section 47612.5.
P5 1(f) For a pupil enrolled in a charter school that is an early
2college high school or middle college high school and who does
3not satisfy the attendance and enrollment requirements of
4subdivision (d) or (e), for purposes of calculating classroom-based
5average daily attendance for classroom-based instruction
6apportionments, at least 80 percent of the instructional time offered
7by the charter school shall be at the schoolsite, and the charter
8school shall require the attendance of the pupil for a minimum of
967 percent of the minimum instructional time required to be offered
10pursuant to paragraph (1) of subdivision (a) of Section 47612.5.
11(g) For purposes of this section, middle college high school is
12described in Section 11300 and early college high school is
13described in Section
11302.
