BILL ANALYSIS Ó SB 436 Page 1 Date of Hearing: September 11, 2013 ASSEMBLY COMMITTEE ON APPROPRIATIONS Mike Gatto, Chair SB 436 (Jackson) - As Amended: September 6, 2013 Policy Committee: Natural ResourcesVote:N/A Urgency: Yes State Mandated Local Program: No Reimbursable: SUMMARY This bill appropriates $1 million from the Proposition 12 park bond to the State Coastal Conservancy for an emergency grant to the City of Port Hueneme. Specifically, this bill: 1)Appropriates $1 million from the Safe Neighborhood Parks, Clean Water, Clean Air, and Coastal Protection (Proposition 12) bond fund to the Coastal Conservancy for emergency erosion control projects in the City of Port Hueneme permitted by the Coastal Conservancy. 2)Expands the use of the Harbors and Watercraft Revolving Fund to include grants or loans to cities to prevent infrastructure damage to street and properties caused by beach erosion. 3)Requires $1 million to be appropriated from the Harbors and Watercraft Revolving Fund if the Coastal Commission requires a project that is not eligible for Proposition 12 funding. 4)Provides the bill is contingent upon the enactment of AB 606 (Williams), which is being amended to include similar provisions. FISCAL EFFECT 1)Potential increased expenditures of $1 million from Proposition 12. 2)Potential increased expenditures of $1 million or more from the Harbors and Watercraft Revolving Fund by increasing SB 436 Page 2 funding eligibility. 3)Minor administrative costs to the Coastal Conservancy, the Department of Parks and Recreation, and the Coastal Commission. COMMENTS 1)Purpose and Background. According to the author, the city of Port Hueneme requires emergency funding to prevent severe erosion from damaging public infrastructure. A road identified by the Federal Emergency Management Agency for tsunami evacuation is among the public properties in jeopardy. The erosion problem was created by the construction of the deep-water Port of Hueneme and also may result in environmental damages downstream at the Ormand Beach wetlands and waste piles at the Halaco Superfund site. The author is seeking emergency state assistance based on a severe erosion event this year and federal funding reductions. 2)Opposition. The Recreational Boaters of California are opposed to this bill based on the provisions that would allow the state Harbors and Watercraft Revolving Fund to be used for non-boating purposes. The fund derives revenues from fuel tax dollars and boat registration fees. The committee may wish to consider amending the bill to limit the use of Harbor and Watercraft Revolving Funds to the City of Port Hueneme project only.
