SB 440, as amended, Padilla. Public postsecondary education: Student Transfer Achievement Reform Act.
(1) Existing law establishes the California Community Colleges and the California State University as 2 of the segments of public postsecondary education in this state. Existing law, the Student Transfer Achievement Reform Act, encourages community colleges to facilitate the acceptance of credits earned at other community colleges toward the associate degree for transfer. The act also requires the California State University to guarantee admission with junior status to a community college student who meets the requirements for the associate degree for transferbegin insert, and provides that admission to the California State University under these provisions does not guarantee admission for specific majors or campusesend insert. A student admitted to the California State University pursuant to the act is entitled to receive priority over all other community college transfer students, excluding community college students who have entered into a transfer agreement between a community college and the California State University prior to the fall term of the 2012-13 academic year.
This bill would express findings and declarations of the Legislature relating to timely progression from lower division coursework to degree completion. The bill would require community colleges to create an associate degree for transfer in every majorbegin insert and area of emphasisend insert offered by that collegebegin delete that has anend deletebegin insert
for anyend insert approved transfer model curriculumbegin delete before the commencement of the 2014-15 academic year, and to create an associate degree for transfer in specified areas of emphasis before the commencement of the 2016-17 academic yearend delete,begin insert
as prescribed,end insert thereby imposing a state-mandated local program.
The bill would require California State University campuses to accept transfer model curriculum-aligned associate degrees for transfer inbegin delete each of theend deletebegin insert every major and concentration offered by thatend insert California State Universitybegin delete degree options, as defined, within a major field, and accept transfer model curriculum-aligned associate degrees for transfer in each of the specified areas of emphasis referenced aboveend deletebegin insert, as specifiedend insertbegin insert.
This bill would provide that the guarantee of admission for those community college students described above includes admission to a program or major and concentration that is either similar to the student’s community college transfer model curriculum-aligned associate degree for transfer or may be completed with 60 semester units of study beyond that degree for transfer, the determinations to be made by the campus to which the student is admittedend insert. The bill would require the California State University to develop an admissions redirection process for students admitted pursuant to the Student Transfer Achievement Reform Act who apply for admission to the California State University, but are not accepted into the campuses specifically applied to.
The bill would require the California Community Colleges and the California State University, in consultation with specified parties, to develop a student-centered communication and marketing strategy in order to increase the visibility of the associate degree for transfer pathway for all students in California. To the extent that this provision would create new duties for community college districts, it would constitute a state-mandated local program.
(2) The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.

The people of the State of California do enact as follows:
The Legislature finds and declares all of the
2following:
3(a) Since the enactment of the 1960 Master Plan for Higher
4Education, preparing students to transfer to a four-year university
5has been a core function of the California Community Colleges.
6(b) Successful and timely progression from lower division
7coursework to degree completion is a basic principle of California
8higher education and is critical to the future of the state’s economy.
9(c) The Public Policy Institute of California projects that
10California’s workforce
will have one million fewer graduates than
11it needs in 2025, and that increasing transfer rates from community
12colleges to four-year postsecondary educational institutions could
13dramatically reduce the education skills gap.
14(d) Today, one in every four jobs requires an associate degree
15or higher. In the near future, one in every three jobs will require
16an associate degree or higher.
17(e) The size of the California Community Colleges and the
18California State University systems, which have the largest share
19of postsecondary students in the nation, allow the state to address
20the serious projected shortage of educated workers.
21(f) To meet workforce demands in a cost-effective way, it is
22critical that we significantly increase the
number of students
23obtaining an associate degree while preparing for transfer to a
24four-year college or university.
25(g) Although the community college and state university
26segments have undertaken tremendous efforts to institute the new
27transfer pathway, current implementation efforts of Sections 66746
28and 66747 of the Education Code alone are insufficient to ensure
29that the associate degree for transfer becomes the preferred transfer
30pathway for all students across the state.
Section 66746 of the Education Code is amended to
32read:
(a) Commencing with the fall term of the 2011-12
2academic year, a student who earns an associate degree for transfer
3granted pursuant to subdivision (b) shall be deemed eligible for
4transfer into a California State University baccalaureate program
5when the student meets both of the following requirements:
6(1) Completion of 60 semester units or 90 quarter units that are
7eligible for transfer to the California State University, including
8both of the following:
9(A) The Intersegmental General Education Transfer Curriculum
10(IGETC) or the California State University General
11Education-Breadth Requirements.
12(B) A minimum of 18 semester units or 27 quarter units in a
13major or area of emphasis, as determined by the community college
14districtbegin insert and meeting the requirements of an approved transfer
15model curriculumend insert.
16(2) Obtainment of a minimum grade point average of 2.0.
17(b) (1) (A) As a condition of receipt of state apportionment
18funds, a community college district shall develop and grant
19associate degrees for transfer that meet the requirements of
20subdivision (a). A community college district shall not impose any
21requirements in addition to the requirements of this section,
22including any local college
or district requirements, for a student
23to be eligible for the associate degree for transfer and subsequent
24admission to the California State University pursuant to Section
2566747.

32(C) A community college shall, before the commencement of
33the 2016-17 academic year, create an associate degree for transfer
34in areas of emphasis for disciplines including, but not necessarily
35limited to, all of the following:
36(i) Applied sciences.

P5 1(C) A community college shall create an associate degree for
2transfer in every major and area of emphasis offered by that
3college for any approved transfer model curriculum approved
4subsequent to the 2013-14 academic year within 18 months of the
5approval of the transfer model curriculum.
6(D) Before the commencement of the 2015-16 academic year,
7there shall be the development of at least two transfer model
8curriculum in areas of emphasis and, before the commencement
9of the 2016-17 academic year, there shall be the development of
10at least two additional transfer model curriculum in areas of
11emphasis.
12(2) The condition of receipt of state apportionment funding
13contained in
paragraph (1) shall become inoperative if, by
14December 31, 2010, each of the state’s 72 community college
15districts has submitted to the Chancellor of the California
16Community Colleges, for transmission to the Director of Finance,
17signed certification waiving, as a local agency request within the
18meaning of paragraph (1) of subdivision (a) of Section 6 of Article
19XIII B of the California Constitution, any claim of reimbursement
20related to the implementation of this article.
21(c) A community college district is encouraged to consider the
22local articulation agreements and other work between the respective
23faculties from the affected community college and California State
24University campuses in implementing the requirements of this
25section.
26(d) Community colleges are encouraged to facilitate the
27acceptance of credits earned at other community colleges toward
28the associate degree for transfer pursuant to this section.
29(e) This section shall not precludebegin insert enrollment in nontransferable
30student success courses or precludeend insert students who are assessed
31below collegiate level from acquiring remedial noncollegiate level
32coursework in preparation for obtaining the associate degree.

shall not be counted as part of the
35transferable units required pursuant to paragraph (1) of subdivision
36(a).
Section 66747 of the Education Code is amended to
38read:
(a) (1) Notwithstanding Chapter 4 (commencing with
40Section 66201), the California State University shall guarantee

2who meets all of the requirements of Sectionbegin delete 66746. Admission
3to the California State University, as provided under this article,
4does not guarantee admission for specific majors or campuses.
5Notwithstanding Chapter 4 (commencing with Section 66201),
6the California State University shall grant a student priority
7admission to his or her local California State University campus
8and to a program or major that is similar to his or her community
9college major or area of emphasis, as determined by the California
10State University campus to which the student
is admitted. A
11California State University campus shall accept transfer model
12curriculum-aligned associate degrees for transfer in each of the
13California State University degree options within a major field.
14The California State University shall accept transfer model
15curriculum-aligned associate degrees for transfer in each of the
16areas of emphasis listed in subparagraph (C) of paragraph (1) of
17subdivision (b) of Section 66746.end delete
18program or major and concentration, as applicable, that meets
19either of the following:end insert
20(A) Is similar to the student’s community college transfer model
21curriculum-aligned associate degree for transfer,
as determined
22by the California State University campus to which the student is
23admitted.
24(B) May be completed with 60 semester units of study beyond
25the community college transfer model curriculum-aligned associate
26degree for transfer, with completion ability determined by the
27California State University campus to which the student is
28admitted.
29(2) Admission to the California State University, as provided
30under this article, does not guarantee admission for a specific
31major or campus.
32(3) Notwithstanding Chapter 4 (commencing with Section
3366201), the California State University shall grant a student
34priority admission to his or her local California State University
35campus and to a program or major and concentration that is
36similar to the student’s community college transfer model
37curriculum-aligned associate degree for transfer, as determined
38by the California State University campus to which the student is
39admitted.
P7 1(4) A California State University campus shall accept transfer
2model curriculum-aligned associate degrees for transfer in every
3major and concentration offered by that California State University
4campus that meets the requirements of paragraph (1). A California
5State University campus shall additionally make every effort to
6accept transfer model curriculum-aligned associate degrees for
7
transfer in each of the California State University concentrations.

11(b) A student admitted under this article shall receive priority
12over all other community college transfer students, in accordance
13with subdivision (b) of Section 66202, excluding community
14college students who have entered into a transfer agreement
15between a community college and the California State University
16prior to the fall term of the 2012-13 academic year. A student
17admitted pursuant to this article shall have met the requirements
18of an approved transfer agreement consistent with subdivision (a)
19of Section 66202.
20(c) The California State University shall develop an admissions
21redirection
process for students admitted under this article who
22apply for admission to the California State University, but are not
23accepted into the California State University campuses specifically
24applied to. This process shall be aligned with the guaranteed
25admission into the California State University system under
26subdivision (a).
Section 66748.5 is added to the Education Code, to
28read:
The California Community Colleges and the
30California State University, in consultation with students, faculty,
31student service administrators, the State Department of Education,
32the California Education Round Table, and other key stakeholders,
33shall develop a student-centered communication and marketing
34strategy in order to increase the visibility of the associate degree
35for transfer pathway for all students in California that includes,
36but is not necessarily limited to, all of the following:
37(a) Outreach to high schools.
38(b) Information on the pathway prominently displayed in all
39community college counseling offices and
transfer centers.
P8 1(c) Associate degree for transfer pathway information provided
2to all first-year community college students developing an
3education plan to aid them in making informed educational choices.
4(d) Targeted outreach to first-year students through campus
5orientations andbegin delete existingend delete student support services programsbegin delete (federal begin insert offered by the campus that may
6TRIO programs), including, butend delete
7include, but areend insert not necessarily limited to,begin insert Federal TRIO Programs,end insert
8
First-Generation Experience,begin delete Mesaend deletebegin insert MESAend insert, and Puente.
9(e) Information prominently displayed in community college
10course catalogs.
11(f) Information prominently displayed on the Internet Web sites
12of each community college, each campus of the California State
13University, and on the CaliforniaColleges.edu Internet Web site.
If the Commission on State Mandates determines that
15this act contains costs mandated by the state, reimbursement to
16local agencies and school districts for those costs shall be made
17pursuant to Part 7 (commencing with Section 17500) of Division
184 of Title 2 of the Government Code.
