An act to add Title 9 (commencing with Section 14060) to Part 4 of the Penal Code, relating to violence prevention.

Existing law provides for multiple violence prevention programs, including the California Gang, Crime, and Violence Prevention Partnership Programbegin delete,end deletebegin insert;end insert the California Community Crime Resistance Programbegin delete,end deletebegin insert;end insert the Rural Indian Crime Prevention Programbegin delete,end deletebegin insert;end insert and the sexual assault felony enforcement (SAFE) team program.

This bill would create the California Violence Prevention Authority within thebegin delete Department of Justiceend deletebegin insert State Department of Public Healthend insert. The authority would be given duties and responsibilities related to the prevention of violence, including, developing a statewide violence prevention plan and coordinating statewide violence prevention efforts. The duties and responsibilities of the authority would also include administering a violence prevention grant program with available funds, as specified. The bill would provide for an advisory committee, as specified, to assist the authority, and would also create the Violence Prevention Fund in the State Treasury. This bill would specify that funding for the authority shall be provided in the annual Budget Act, as specified.

SECTION 1.  

Title 9 (commencing with Section 14060) is

This title shall be known and may be cited as the
7California Violence Prevention Act of 2013.

14062.  

(a) The California Violence Prevention Authority is
9hereby created within thebegin insert Stateend insert Department ofbegin delete Justice.end deletebegin insert Public
10Health.end insert

11(b) The duties and responsibilities of the authority shall include,
12but are not limited to, all of the following:

13(1) Developing a statewide, violence prevention plan that
14includes multidisciplinary approaches, including criminal justice
15and public health approaches, to violence prevention in families,
16schools, and communities.

17(2) Coordinating statewide violence prevention efforts.

18(3) Seeking, receiving, and administering grants and funds from
19public and private sources for violence prevention efforts and
20programs.

21(4) Distributing the grants and funds obtained for violence
22prevention efforts and programs, pursuant to rules adopted by the
23authority and subject to appropriation, to local and statewide
24organizations, initiatives, and programs that address violence
25prevention in a comprehensive and collaborative manner, including,
26but not limited to, the following:

27(A) Community based youth violence prevention programs,
28including mentoring programs, after school programs, and job
29training and development programs.

30(B) Early childhood intervention programs designed to prevent
31violence and identify and serve at-risk children and families.

32(C) Family violence and sexual assault prevention initiatives.

33(D) Programs that integrate violence prevention services with
34alcohol and substance abuse prevention services.

35(E) Programs that integrate violence prevention services with
36providing health care services.

P3    1(5) Providing training and technical assistance to help build the
2capacity of organizations, communities, and local government to
3develop, implement, and evaluate violence prevention programs.

(a) The authority shall have an advisory board which
5shall meet periodically to carry out the purposes of this title and
6to execute the duties and responsibilities identified in Section
714062.

8(b) The advisory board shall include, and be chaired by, the

and the State Director of Public Health.

11(c) The advisory board shall also include the following:

12(1) The Secretary of the California Health and Human Services
13Agency, or his or her designee, and one additional representative
14of the California Health and Human Services Agency, to be
15selected by the Secretary of the California Health and Human
16Services Agency.

18Highway Patrol, or his or her designee.

19(3) The Director of Social Services, or his or her designee.

20(4) The Director of the California Department of Aging, or his
21or her designee.

34 Each public member shall be appointed for a term of three years,
35and may be reappointed.

The Violence Prevention Fund is hereby created in the
37State Treasury. Funds received from private, state, or federal
38sources for violence prevention purposes may be deposited into
39the fund. Upon appropriation by the Legislature, these funds shall
P4    1be used by the California Violence Prevention Authority to carry
2out the purposes of this title.

SEC. 2.  

Funding to implement the purposes, objectives, and
4operations of the California Violence Prevention Authority shall
5be provided from an amount appropriated to thebegin insert Stateend insert Department
6of begin deleteJusticeend deletebegin insert Public Healthend insert for that purpose in the annual Budget Act.
