SB 580, as amended, Leno. Crime victims: traumabegin insert recoveryend insert center grants.
The California Victim Compensation and Government Claims Board administers a program to assist state residents to obtain compensation for their pecuniary losses suffered as a direct result of criminal acts. Payment is made under these provisions from the Restitution Fund, which is continuously appropriated to the board for these purposes.
This bill would authorize the board, as specified, to administer a program to award, upon appropriation by the Legislature, up to $2 million in grants, annually, to traumabegin insert recoveryend insert centers, as defined.

The people of the State of California do enact as follows:
Section 13963.1 is added to the Government
2Code, to read:
(a) The Legislature finds and declares all of the
4following:
5(1) Without treatment, approximately 50 percent of people who
6survive a traumatic, violent injury experience lasting or extended
P2 1psychological or social difficulties. Untreated psychological trauma
2often has severe economic consequences, including overuse of
3costly medical services, loss of income, failure to return to gainful
4employment, loss of medical insurance, and loss of stable housing.
5(2) Victims of crime should receive timely and effective mental
6health treatment.
7(3) The board shall administer a program
to evaluate applications
8and award grants to trauma recovery centers.
9(b) The board shall only award a grant to a traumabegin insert recoveryend insert
10 center that meets both of the following criteria:
11(1) The traumabegin insert recoveryend insert center demonstrates that it serves as a
12community resource by providing services, including, but not
13limited to, making presentations and providing training to law
14enforcement, community-based agencies, and other health care
15providers on the identification and effects of violent crime.
16(2) Any other related criteria required by the board.
17(c) Upon appropriation by the Legislature, the board may award
18grants totaling up to two million dollars ($2,000,000) per year. All
19grants shall be funded only from the Restitution Fund.
20(d) The board may award a grant providing funding for up to a
21maximum period of three years. Any portion of a grant that a
22traumabegin insert recoveryend insert center does not use within the specified grant
23period shall revert to the Restitution Fund. The board may award
24consecutive grants to a traumabegin insert recoveryend insert center to prevent a lapse
25in funding. The board shall not award a traumabegin insert recoveryend insert center
26more than one grant for any period of time.
27(e) (1) The board shall not receive, evaluate, or approve
28applications for trauma recovery center grants in a fiscal year
29unless the Restitution Fund is projected to have a yearend fund
30reserve equal to, or greater than, the equivalent of 25 percent of
31total budgeted expenditures for the fund, as projected in the January
32budget proposed by the Governor pursuant to Section 12 of Article
33IV of the California Constitution.
34(2) Grants awarded to trauma recovery centers shall not result
35in a yearend balance to the Restitution Fund of less than 25 percent
36of total budgeted expenditures for the fund, as projected in the
37January budget proposed by the Governor pursuant to Section 12
38of Article IV of the California Constitution.
P3 1(f) The board, when considering grant applications, shall give
2preference to a
traumabegin insert recoveryend insert center that conducts outreach to,
3and serves, both of the following:
4(1) Crime victims who typically are unable to access traditional
5services, including, but not limited to, victims who are homeless,
6chronically mentally ill, of diverse ethnicity, members of immigrant
7and refugee groups, disabled,begin delete orend delete who have severe trauma-related
8symptoms or complex psychologicalbegin delete issues.end deletebegin insert issues, or juvenile
9victims, including a minor who has had contact with the juvenile
10dependency system or falls under Section 601 of the Welfare and
11Institutions Code.end insert
12(2) Victims of a wide range of crimes, including, but not limited
13to, victims of sexual assault, domestic violence, physical assault,
14shooting, stabbing, and vehicular assault, and family members of
15homicide victims.
16(g) The traumabegin insert recoveryend insert center sites shall be selected by the
17board through a well-defined selection process that takes into
18account the rate of crime and geographic distribution to serve the
19greatest number of victims.
20(h) A traumabegin insert recoveryend insert center that is awarded a grant shall do
21both of the following:
22(1) Report to the board
annually on how grant funds were spent,
23how many clients were served (counting an individual client who
24receives multiple services only once), units of service, staff
25productivity, treatment outcomes, and patient flow throughout
26both the clinical and evaluation components of service.
27(2) In compliance with federal statutes and rules governing
28federal matching funds for victims’ services, each center shall
29submit any forms and data requested by the board to allow the
30board to receive the 60 percent federal matching funds for eligible
31victim services and allowable expenses.
32(i) For purposes of this section, a “traumabegin insert recoveryend insert center”
33provides, including, but not limited to, all of the following
34resources,begin delete treatment,end deletebegin insert
treatments,end insert and recovery services to crime
35victims:
36(1) Mental health services.
37(2) Assertive community-based outreach and clinical case
38management.
39(3) Coordination of care among medical and mental health care
40providers, law enforcement agencies, and other social services.
P4 1(4) Services to family members and loved ones of homicide
2victims.
3(5) A multidisciplinary staff of clinicians that includes
4psychiatrists, psychologists, and social workers.
Section 13964 of the Government Code is amended
6to read:
(a) Claims under this chapter shall be paid from the
8Restitution Fund.
9(b) Notwithstanding Section 13340, except for funds to support
10traumabegin insert recoveryend insert center grants pursuant to Section 13963.1, the
11proceeds in the Restitution Fund are hereby continuously
12appropriated to the board, without regard to fiscal years, for the
13purposes of this chapter. However, the funds appropriated pursuant
14to this section for administrative costs of the board shall be subject
15to annual review through the State Budget process.
16(c) A sum
not to exceed 15 percent of the amount appropriated
17annually to pay claims pursuant to this chapter may be withdrawn
18from the Restitution Fund, to be used as a revolving fund by the
19board for the payment of emergency awards pursuant to Section
2013961.
