Existing law establishes the Office of Planning and Research and sets forth its powers and duties as the comprehensive state planning agency.

This bill would require the Office of Planning and Research to establish a pilot program to study and test the usefulness of social impact partnerships, as specified, as a mechanism for social programs operated and administered by nongovernmental organizations pursuant to a proposed contract entered into with a state agency. The bill would require the office to issue a request for applications to receive proposals for the pilot program from non-governmental organizations to address state goals in the areas of reduction of inmate recidivism, improving health care, and improving outcomes for children in the foster care system and those exiting out of the system. The bill would require the office to report its recommendations to the Governor and the Legislature on which social programs to authorize by September 15, 2014. This bill would repeal these provisions on January 1, 2020.

(a) For purposes of this title, “social impact
10partnerships,” also referred to as “social impact bonds,” means
11a financing mechanism for social programs operated and
12administered by nongovernmental organizations pursuant to a
13contract entered into with a state agency. Under the contract, the
14nongovernmental organization and the state agency shall agree
15upon specific program goals with quantifiable target results and
16a set timeframe to achieve those targets. Under the contract, the
17nongovernmental organization shall pay for the entire cost of
18providing the agreed upon service. If the nongovernmental
19organization providing the service meets the agreed upon
20quantifiable results under the contract, the state agency shall,
21upon appropriation by the Legislature, reimburse the
22nongovernmental organization for the cost of the service along
23with an agreed upon rate of financial return.

24(b) “Office” means the Office of Planning and Research
25established pursuant to Section 65037.

(a) The office shall, in addition to its powers and duties
27set forth in Article 4 (commencing with Section 65040) of Chapter
281.5 of Division 1 of Title 7, conduct the Social Impact Partnerships
29Pilot Program, which is hereby established to study and test the
30usefulness of social impact partnerships as a mechanism to help
P3    1state agencies meet their statutory goals in an efficient and
2cost-effective manner.

3(b) The office shall issue a request for applications to receive
4proposals from nongovernmental organizations to address the
5state goals under subdivision (b) of Section 97002.

6(c) The request for applications shall require proposals to
7include all of the following:

8(1) A description of how the proposed social program will meet
9the state goals under subdivision (b) of Section 97002.

10(2) A description of the organization’s experience in providing
11the proposed social program.

12(3) A description of the financial stability of the organization.

13(4) An identification of each component of the social program
14to be provided.

15(5) A description of how the social program will be provided.

16(6) A description of the recruitment or selection process, or
17both, for participants in the social program.

18(7) The proposed quantifiable results upon which success of the
19social program will be measured.

20(8) An itemization of all expenses proposed to be reimbursed
21under the contract.

(a) The pilot program shall consist of contracts with
23nongovernmental organizations to accomplish the state goals
24under subdivision (b).

25(b) In order to adequately test and fully evaluate the social
26impact partnership model, the pilot program shall be designed to
27achieve three state goals, as follows:

28(1) Reduce recidivism rates for the incarcerated population of
29this state.

30(2) Improve health care. The focus of the pilot program is to
31further the triple aims of health care reform which includes
32improving health quality, reducing costs, and improving the patient
33experience. The social programs under this paragraph shall focus
34on low-income or underserved communities, or both. The social
35programs under this paragraph may include, but are not limited
36to, programs that reduce emergency room visits and
37hospitalizations, incentivize the use of primary care and
38preventative health services, and coordinate the care of patients
39across health care settings and providers.

P4    1(3) Improve outcomes for children under the jurisdiction of the
2foster care system or those exiting out of the system. Those
3outcomes include, but are not limited to, improving the health and
4well-being of the children.

The pilot program shall be outcome oriented, and
6payment to the nongovernmental organizations under the contract
7shall be based on the successful completion of the terms of the
8contract. These terms shall be determined and approved by the
9office in coordination with the relevant state department or agency.

The office shall report its recommendations to the
11Governor and the Legislature by September 15, 2014, regarding
12which social programs to authorize. The recommendations shall
13include proposed contracts with specific nongovernmental
14organizations for specific social programs. The contracts shall
15also include metrics for determining the success of the social
16programs and the terms governing the proposed rate of financial
17return.

This title shall not create a statutory entitlement to
19services or any contractual obligation on the part of the state. It
20is the intent of the Legislature that a proposed contract under
21Section 97005 is subject to legislative review and approval before
22its execution, and that any appropriation only occur after the
23review and approval.

This title shall be repealed on January 1, 2020.

SECTION 1.  

Section 8203.2 of the Government Code is
25amended to read:

8203.2.  

Notaries public appointed and commissioned pursuant
27to Section 8203.1, shall be appointed only upon the
28recommendation of the commanding officer of the reservation in
29which they are to act, and they shall be authorized to act only
30within the boundaries of this reservation.
