An act to add Section 33319.4 to the Education Code, and to amend Section 19995 of the Government Code, relating to state employees.

SB 619, as introduced, Yee. State employees: training: civics orientation.

Existing law requires the Department of Human Resources (CalHR) to devise plans for and cooperate with appointing powers and other supervising officials in the conduct of employee training programs so that the quality of service rendered by persons in the state civil service may be continually improved.

This bill would require the State Department of Education, on or before January 1, 2015, to develop and make available online a state employee civics orientation on federal and state government. The bill would require private matching funds before any appropriation to the State Department of Education for those purposes is encumbered. The bill would require an appointing power or other supervising official for an employee hired, promoted, or reclassified after July 1, 2015, to certify annually to CalHR that the employee has completed that orientation.

The people of the State of California do enact as follows:

SECTION 1.  

Section 33319.4 is added to the Education Code,

33319.4.  

(a) On or before January 1, 2015, the State
2Department of Education shall develop and make available online
3a state employee civics orientation on federal and state government
4to facilitate a basic understanding of the responsibilities and
5operation of the three branches of government and the importance
6of civic engagement. The orientation shall include practical
7examples and shall be updated as necessary.

8(b) Moneys, or a portion of moneys, appropriated to the State
9Department of Education by the Legislature for the development
10of the orientation pursuant to subdivision (a) shall not be
11encumbered unless the total amount encumbered is matched by
12private funds. Moneys appropriated that are not matched by private
13funds shall revert to the General Fund.

Section 19995 of the Government Code is amended

23existing processes and resources, shall certify annually to the
24department that the employee has completed employee training
25developed pursuant to Section 33319.4 of the Education Code.

28provisions of a memorandum of understanding reached pursuant
29to Section 3517.5, the memorandum of understanding shall be
30controlling without further legislative action, except that if such
31provisions of a memorandum of understanding require the
32expenditure of funds, the provisions shall not become effective
33unless approved by the Legislature in the annual Budget Act.
