An act to amend Section 110430 of the Health and Safety Code, relating to food safety.

Existing law requires the State Department of Public Health to adopt regulations providing for the issuance of permits to manufacturers, processors, or packers of a class of food that may be injurious to the health of any human or other animal that consumes the food by reason of contamination with micro-organisms during manufacture, packing, or storage.

This bill would make a technical, nonsubstantive change to that provision.

The people of the State of California do enact as follows:

SECTION 1.  

Section 110430 of the Health and Safety Code
2 is amended to read:

110430.  

Whenever the department finds that a class of food
4distributed in this state may, by reason of contamination with
5micro-organisms during manufacture, packing, or storage, be
6injurious to the health of any man or other animal that consumes
7begin delete itend deletebegin insert the foodend insert and that the injurious nature cannot be adequately
8determined after this food has entered commerce, the department
9shall adopt regulations providing for the issuance of permits to
P2    1manufacturers, processors, or packers of the class of food. These
2permits shall establish conditions governing the manufacture,
3packing, or storage of the class of food for the period of time as
4may be necessary to protect the public health. The regulations shall
5prescribe a date after which no person shall introduce or deliver
6for introduction into commerce any food manufactured, packed,
7or stored by any manufacturer, processor, or packer, unless the
8person holds a permit issued by the department as provided by the
9regulations.
