Existing law permits the governing board of any community college district without advertising for bids, and when that board has determined it to be in the best interests of the district, to authorize by contract, lease, requisition, or purchase order, any public corporation or agency, as specified, to lease data-processing equipment, purchase materials, supplies, equipment, automotive vehicles, tractors, and other personal property, as specified.

This bill would also permit a community college district to authorize the lease or purchase of personal property directly from a vendor by contract, lease, requisition, or purchase order and make payment to the vendor on the same terms as provided in an existing contract between a public corporation or agency and the vendor for the lease or purchase of the personal property.

The Student Transfer Achievement Reform Act requires the California State University to guarantee admission with junior status to a community college student who meets the requirements for the associate degree for transfer. A student admitted to the California State University pursuant to the act is entitled to receive priority over all other community college transfer students, excluding community college students who have entered into a transfer agreement between a community college and the California State University prior to the fall term of the 2012-13 academic year. The act also encourages community colleges to facilitate the acceptance of credits earned at other community colleges toward the associate degree for transfer.

Notwithstanding any other provisions of Sections 81640
4to 81654, inclusive, of the Education Code, or of Sections 20651
5to 20659, inclusive, of this code, the governing board of any
6community college district without advertising for bids, and when
7that board has determined it to be in the best interests of the district,
8may authorize by contract, lease, requisition, or purchase order,
9any public corporation or agency, including any county, city, town,
10or district, to lease data-processing equipment, purchase materials,
11supplies, equipment, automotive vehicles, tractors, and other
12personal property for the district in the manner in which the public
13corporation or agency is authorized by law to make the leases or
14purchases. Upon receipt of any such personal property, provided
15the property complies with the specifications set forth in the
16contract, lease, requisition, or purchase order, the community
17college district may draw a warrant in favor of the public
18corporation or agency for the amount of the approved invoice,
19including the reasonable costs to the public corporation or agency
20for furnishing the services incidental to the lease or purchase of
21the personal property.begin insert Alternatively, if there is an existing contract
22between a public corporation or agency and a vendor for the lease
23or purchase of the personal property, a community college district
24may authorize the lease or purchase of the personal property

SECTION 1.  

Section 66746 of the Education Code is amended
2to read:

66746.  

(a) Commencing with the fall term of the 2011-12
4academic year, a student who earns an associate degree for transfer
5granted pursuant to subdivision (b) shall be deemed eligible for
6transfer into a California State University baccalaureate program
7when the student meets both of the following requirements:

8(1) Completion of 60 semester units or 90 quarter units that are
9eligible for transfer to the California State University, including
10both of the following:

11(A) The Intersegmental General Education Transfer Curriculum
12(IGETC) or the California State University General
13Education-Breadth Requirements.

14(B) A minimum of 18 semester units or 27 quarter units in a
15major or area of emphasis, as determined by the community college
16district.

17(2) Attainment of a minimum grade point average of 2.0.

18(b) (1) As a condition of receipt of state apportionment funds,
19a community college district shall develop and grant associate
20degrees for transfer that meet the requirements of subdivision (a).
21A community college district shall not impose any requirements
22in addition to the requirements of this section, including any local
23college or district requirements, for a student to be eligible for the
24associate degree for transfer and subsequent admission to the
25California State University pursuant to Section 66747.

26(2) The condition of receipt of state apportionment funding
27contained in paragraph (1) shall become inoperative if, by
28December 31, 2010, each of the state’s 72 community college
29districts has submitted to the Chancellor of the California
30Community Colleges, for transmission to the Director of Finance,
31signed certification waiving, as a local agency request within the
32meaning of paragraph (1) of subdivision (a) of Section 6 of Article
33XIII B of the California Constitution, any claim of reimbursement
34related to the implementation of this article.

35(c) A community college district is encouraged to consider the
36local articulation agreements and other work between the respective
37faculties from the affected community college and California State
38University campuses in implementing the requirements of this
39section.

P4    1(d) Community colleges are encouraged to facilitate the
2acceptance of credits earned at other community colleges toward
3the associate degree for transfer pursuant to this section.

4(e) This section shall not preclude students who are assessed
5below collegiate level from acquiring remedial noncollegiate level
6coursework in preparation for obtaining the associate degree.
7Remedial noncollegiate level coursework shall not be counted as
8part of the transferable units required pursuant to paragraph (1) of
9subdivision (a).
