An act to amend Section 4106 of, and to add Section 4109 to, the Food and Agricultural Code, relating to the California Science Center, and declaring the urgency thereof, to take effect immediately.

Existing law establishes the Sixth District Agricultural Association, also known as the California Science Center, and requires the California Science Center to manage or operate its parking facilities in a manner that preserves and protects the interests of itself and the California African American Museum, and recognizes the cultural and educational character of Exposition Park. Existing law requires all revenues received by the California Science Center from its parking facilities to be deposited in the Exposition Park Improvement Fund in the State Treasury, and specifies that the funds may only be used, upon appropriation by the Legislature, for improvements to Exposition Park.

This bill would provide that the California Science Center shall not delegate to any other party the power to manage and operate its parking facilities, and would specify that those provisions are declaratory of existing law. The bill would also prohibit the California Science Center from entering into a sale or a lease for a term of more than 10 years for the use of the Los Angeles Coliseum or the Los Angeles Sports Arena, unless the Legislature authorizes the proposed sale or lease by statute.

This bill would declare that it is to take effect immediately as an urgency statute.

SECTION 1.  

Section 4106 of the Food and Agricultural Code,
2as amended by Section 6 of Chapter 137 of the Statutes of 2012,
3is amended to read:

(a) The California Science Center shall work with the
5Los Angeles Memorial Coliseum Commission, the City of Los
6Angeles, and the County of Los Angeles to develop additional
7parking facilities in Exposition Park to the extent necessary to
8allow for expansion of the park.

14(2) The California Science Center shall not delegate to any
15other party, including, but not limited to, the University of
16California, the power to manage and operate its parking facilities.

18(c) The Exposition Park Improvement Fund is hereby created
19in the State Treasury. All revenues received by the California
20Science Center from its parking facilities, from rental of museum
21facilities, or from other business activities shall be deposited in
22the Exposition Park Improvement Fund.

23(d) The moneys in the Exposition Park Improvement Fund may
24only be used, upon appropriation by the Legislature, for
25improvements to Exposition Park, including, but not limited to,
26maintenance of existing parking and museum facilities, replacement
27of museum equipment, supplies and wages expended to generate
28revenues from rental of museum facilities, development of new
29parking facilities, and acquisition of land within or adjacent to
30Exposition Park.

31(e) (1) The Legislature hereby finds and declares that there is
32a need for development of additional park, recreation, museum,
33and parking facilities in Exposition Park. The Legislature
34recognizes that the provision of these needed improvements as
35identified in the California Science Center Exposition Park Master
P3    1Plan may require the use of funds provided by other governmental
2agencies or private donors.

3(2) The California Science Center may accept funds from other
4governmental agencies or private contributions for the purpose of
5implementation of the California Science Center Exposition Park
6Master Plan. The private contributions and funds from
7governmental agencies other than state governmental agencies
8shall be deposited in the Exposition Park Improvement Fund in
9the State Treasury and shall be available for expenditure without
10regard to fiscal years by the California Science Center for
11implementation of the California Science Center Exposition Park
12Master Plan. Funds from other state governmental agencies shall
13be deposited in the Exposition Park Improvement Fund and shall
14be available for expenditure, upon appropriation, by the California
15Science Center for implementation of the California Science Center
16Exposition Park Master Plan. However, any expenditure is not
17authorized sooner than 30 days after notification in writing of the
18necessity therefor to the chairperson of the committee in each
19house that considers appropriations and the Chairperson of the
20 Joint Legislative Budget Committee, or not sooner than whatever
21lesser time as the chairperson of the joint committee, or his or her
22designee, may in each instance determine. Neither the City of Los
23Angeles nor the County of Los Angeles shall impose any tax upon
24tickets purchased authorizing the use of parking facilities owned
25by the California Science Center.

SEC. 2.  

Section 4109 is added to the Food and Agricultural
27Code
, to read:

4109.  

Notwithstanding any other law, the California Science
29Center shall not enter into, and the Director of General Services
30shall not approve, any sale, or lease for a term of more than 10
31years for the use, of the Los Angeles Memorial Coliseum or the
32Los Angeles Memorial Sports Arena, unless the Legislature
33authorizes the proposed sale or lease by statute.

SEC. 3.  

This act is an urgency statute necessary for the
35immediate preservation of the public peace, health, or safety within
36the meaning of Article IV of the Constitution and shall go into
37immediate effect. The facts constituting the necessity are:
