SB 695, as amended, Wright. California Science Center: parking facilities.
Existing law establishes the Sixth District Agricultural Association, also known as the California Science Center, and requires the California Science Center to manage or operate its parking facilities in a manner that preserves and protects the interests of itself and the California African American Museum, and recognizes the cultural and educational character of Exposition Park. Existing law requires all revenues received by the California Science Center from its parking facilities to be deposited in the Exposition Park Improvement Fund in the State Treasury, and specifies that the funds may only be used, upon appropriation by the Legislature, for improvements to Exposition Park.
This bill would provide that the California Science Center shall not delegate tobegin delete any other partyend deletebegin insert
the University of Southern Californiaend insert the power to manage and operate its parking facilities, and would specify that those provisions are declaratory of existing law. The bill would also prohibit the California Science Center from entering intobegin delete aend deletebegin insert anyend insert salebegin insert of,end insert orbegin delete aend delete lease for a term of more than 10 years for the use ofbegin insert, its parking facilities,end insert the Los Angelesbegin insert Memorialend insert Coliseumbegin insert,end insert
or the Los Angelesbegin insert Memorialend insert Sports Arena, unless the Legislature authorizes the proposed sale or lease by statute.
This bill would declare that it is to take effect immediately as an urgency statute.

The people of the State of California do enact as follows:
Section 4106 of the Food and Agricultural Code,
2as amended by Section 6 of Chapter 137 of the Statutes of 2012,
3is amended to read:
(a) The California Science Center shall work with the
5Los Angeles Memorial Coliseum Commission, the City of Los
6Angeles, and the County of Los Angeles to develop additional
7parking facilities in Exposition Park to the extent necessary to
8allow for expansion of the park.
9(b) (1) The California Science Center shall manage or operate
10its parking facilities in a manner that preserves and protects the
11interests of itself and the California African American Museum
12and recognizes the cultural and educational character of Exposition
13Park.
14(2) The California Science Center shall not delegate tobegin delete any other
the University of begin insertSouthern end insert
15party, including, but not limited to,end delete
16Californiabegin delete,end delete the power to manage and operate its parking facilities.
17This paragraph is declaratory of existing law.
18(c) The Exposition Park Improvement Fund is hereby created
19in the State Treasury. All revenues received by the California
20Science Center from its parking facilities, from rental of museum
21facilities, or from other business activities shall be deposited in
22the Exposition Park Improvement Fund.
23(d) The moneys in the Exposition Park Improvement Fund may
24only be used, upon appropriation by the Legislature, for
25improvements to Exposition Park, including, but not
limited to,
26maintenance of existing parking and museum facilities, replacement
27of museum equipment, supplies and wages expended to generate
28revenues from rental of museum facilities, development of new
29parking facilities, and acquisition of land within or adjacent to
30Exposition Park.
P3 1(e) (1) The Legislature hereby finds and declares that there is
2a need for development of additional park, recreation, museum,
3and parking facilities in Exposition Park. The Legislature
4recognizes that the provision of these needed improvements as
5identified in the California Science Center Exposition Park Master
6Plan may require the use of funds provided by other governmental
7agencies or private donors.
8(2) The California Science Center may accept funds from other
9governmental
agencies or private contributions for the purpose of
10implementation of the California Science Center Exposition Park
11Master Plan. The private contributions and funds from
12governmental agencies other than state governmental agencies
13shall be deposited in the Exposition Park Improvement Fund in
14the State Treasury and shall be available for expenditure without
15regard to fiscal years by the California Science Center for
16implementation of the California Science Center Exposition Park
17Master Plan. Funds from other state governmental agencies shall
18be deposited in the Exposition Park Improvement Fund and shall
19be available for expenditure, upon appropriation, by the California
20Science Center for implementation of the California Science Center
21Exposition Park Master Plan. However, any expenditure is not
22authorized sooner than 30 days after notification in writing of the
23necessity therefor to the chairperson of
the committee in each
24house that considers appropriations and the Chairperson of the
25
Joint Legislative Budget Committee, or not sooner than whatever
26lesser time as the chairperson of the joint committee, or his or her
27designee, may in each instance determine. Neither the City of Los
28Angeles nor the County of Los Angeles shall impose any tax upon
29tickets purchased authorizing the use of parking facilities owned
30by the California Science Center.
Section 4109 is added to the Food and Agricultural
32Code, to read:
Notwithstanding any other law, the California Science
34Center shall not enter into, and the Director of General Services
35shall not approve, any salebegin insert ofend insert, or lease for a term of more than 10
36years for the begin deleteuse, ofend deletebegin insert use of, its parking facilities,end insert the Los Angeles
37Memorial Coliseumbegin insert,end insert or the Los Angeles Memorial Sports Arena,
38unless the Legislature authorizes the proposed sale or lease by
39
statute.
This act is an urgency statute necessary for the
2immediate preservation of the public peace, health, or safety within
3the meaning of Article IV of the Constitution and shall go into
4immediate effect. The facts constituting the necessity are:
5In order to ensure that the state maintains the operations and
6fiscal integrity of state resources, it is necessary for this act to take
7effect immediately.
