An act to amend Section 4106 of, and to add Section 4109 to, the Food and Agricultural Code, relating to the California Science Center, and declaring the urgency thereof, to take effect immediately.

Existing law establishes the Sixth District Agricultural Association, also known as the California Science Center, and requires the California Science Center to manage or operate its parking facilities in a manner that preserves and protects the interests of itself and the California African Americanbegin delete Museum,end deletebegin insert Museumend insert andbegin insert thatend insert recognizes the cultural and educational character of Exposition Park. Existing law requires all revenues received by the California Science Center from its parking facilities to be deposited in the Exposition Park Improvement Fund in the State Treasury, and specifies that the funds may only be used, upon appropriation by the Legislature, for improvements to Exposition Park.

This bill would provide that the California Science Center shall not delegate tobegin delete the University of Southern Californiaend deletebegin insert any other partyend insert the power to manage and operate its parking facilities, and would specify that those provisions are declaratory of existing law. The bill would require the California Science Center to establish the minimum and maximum parking rates that may be charged at parking facilities in Exposition Park. The bill would also prohibit the California Science Center from entering into any sale of, or lease for a term of more than 10 years for the use of, its parking facilities, the Los Angeles Memorial Coliseum, or the Los Angeles Memorial Sports Arena, unless the Legislature authorizes the proposed sale or lease by statute, except if the lease contains terms that require the lessee to perform substantial capital improvements.

This bill would declare that it is to take effect immediately as an urgency statute.

The people of the State of California do enact as follows:

SECTION 1.  

Section 4106 of the Food and Agricultural Code,
2as amended by Section 6 of Chapter 137 of the Statutes of 2012,
3is amended to read:

4106.  

(a) The California Science Center shall work with the
5Los Angeles Memorial Coliseum Commission, the City of Los
6Angeles, and the County of Los Angeles to develop additional
7parking facilities in Exposition Park to the extent necessary to
8allow for expansion of the park.

9(b) (1) The California Science Center shall manage or operate
10its parking facilities in a manner that preserves and protects the
11interests of itself and the California African American Museum
12andbegin insert thatend insert recognizes the cultural and educational character of
13Exposition Park.

14(2) The California Science Center shall not delegate tobegin delete the
15University of Southern Californiaend delete
begin insert any other partyend insert the power to
16manage and operate its parking facilities. This paragraph is
17declaratory of existing law.

18(3) The California Science Center shall establish the minimum
19and maximum parking rates that may be charged at parking
20facilities in Exposition Park.

21(c) The Exposition Park Improvement Fund is hereby created
22in the State Treasury. All revenues received by the California
23Science Center from its parking facilities, from rental of museum
24facilities, or from other business activities shall be deposited in
25the Exposition Park Improvement Fund.

P3    1(d) The moneys in the Exposition Park Improvement Fund may
2only be used, upon appropriation by the Legislature, for
3improvements to Exposition Park, including, but not limited to,
4maintenance of existing parking and museum facilities, replacement
5of museum equipment, supplies and wages expended to generate
6revenues from rental of museum facilities, development of new
7parking facilities, and acquisition of land within or adjacent to
8Exposition Park.

9(e) (1) The Legislature hereby finds and declares that there is
10a need for development of additional park, recreation, museum,
11and parking facilities in Exposition Park. The Legislature
12recognizes that the provision of these needed improvements as
13identified in the California Science Center Exposition Park Master
14Plan may require the use of funds provided by other governmental
15agencies or private donors.

16(2) The California Science Center may accept funds from other
17governmental agencies or private contributions for the purpose of
18implementation of the California Science Center Exposition Park
19Master Plan. The private contributions and funds from
20governmental agencies other than state governmental agencies
21shall be deposited in the Exposition Park Improvement Fund in
22the State Treasury and shall be available for expenditure without
23regard to fiscal years by the California Science Center for
24implementation of the California Science Center Exposition Park
25Master Plan. Funds from other state governmental agencies shall
26be deposited in the Exposition Park Improvement Fund and shall
27be available for expenditure, upon appropriation, by the California
28Science Center for implementation of the California Science Center
29Exposition Park Master Plan. However, any expenditure is not
30authorized sooner than 30 days after notification in writing of the
31necessity therefor to the chairperson of the committee in each
32house that considers appropriations and the Chairperson of the
33 Joint Legislative Budget Committee, or not sooner than whatever
34lesser time as the chairperson of the joint committee, or his or her
35designee, may in each instance determine. Neither the City of Los
36Angeles nor the County of Los Angeles shall impose any tax upon
37tickets purchased authorizing the use of parking facilities owned
38by the California Science Center.

SEC. 2.  

Section 4109 is added to the Food and Agricultural
40Code
, to read:

4109.  

(a) Notwithstanding any other law, and except as
2specified in subdivision (b), the California Science Center shall
3not enter into, and the Director of General Services shall not
4approve, any sale of, or lease for a term of more than 10 years for
5the use of, its parking facilities, the Los Angeles Memorial
6Coliseum, or the Los Angeles Memorial Sports Arena, unless the
7Legislature authorizes the proposed sale or lease by statute.

8(b) Notwithstanding subdivision (a), a lease for a term of more
9than 10 years does not require authorization by the Legislature if
10the terms of the lease obligate the lessee to perform substantial
11capital improvements to the facility so that the lessee may be
12afforded the opportunity to obtain a reasonable return on
13investment.

SEC. 3.  

This act is an urgency statute necessary for the
15immediate preservation of the public peace, health, or safety within
16the meaning of Article IV of the Constitution and shall go into
17immediate effect. The facts constituting the necessity are:

18In order to ensure that the state maintains the operations and
19fiscal integrity of state resources, it is necessary for this act to take
20effect immediately.
