           SUMMARY  

          This bill provides that any state agency, county, municipality,  
          or special district may offer excess military weapons or  
          equipment, including historical war equipment such as artillery,  
          tanks, or armored vehicles, to the California State Military  
          Museum and Resource Center or any branch museum, as specified.

          This bill also amends Penal Code sections that authorize  
          donation of weaponry to the California National Guard military  
          museum to instead refer to the California State Military Museum  
          and Resource Center located in Sacramento, and at branch museums  
          located at the California National Guard facilities at Camp  
          Roberts, Camp San Luis Obispo, and Los Alamitos Armed Forces  
          Reserve Center. 
            
           FISCAL EFFECT  

          Negligible, as this bill clarifies current law and allows for  
          additional equipment donations. 

           COMMENTS  

           1)Rationale  . The author notes current law does not reflect the  
            correct name of the California State Military Museum.  It  
            refers to a previous name, which makes it difficult for law  
            enforcement agencies that may have historical or militarily  
            significant weapons that can be turned over to the California  
            National Guard for display in the museum, to know who to  
            contact.  

           2)Current law  requires destruction of guns that have been seized

            or abandoned and are in the custody of law enforcement  
            agencies, with specified exceptions. One such exception is  
            that  weapons may be donated to the California National Guard  
            military museum, now the California State Military Museum and  
            Resource Center.
