An act to amend Section 5074 of the Vehicle Code, relating to vehicles.

Existing law requires the Department of Motor Vehicles to issue, for fees in specified amounts, a special interest license plate bearing a full-plate graphic design that depicts a significant feature or quality of the State of California and is approved by the department in consultation with the California Arts Council. Existing law requires the California Arts Council to use the revenue derived from fee increases authorized during the 2003-04 Regular Session exclusively for arts education and local arts programming, and prohibits the council from using this revenue for administrative costs.

This bill would delete the provision prohibiting the California Arts Council from using this revenue for administrative costs.

The people of the State of California do enact as follows:

SECTION 1.  

Section 5074 of the Vehicle Code is amended to

5074.  

(a) This section shall be known and may be cited as the
2Polanco-Bates License Plates for the Arts Act of 1993. The
3California Arts Council shall participate in the special interest
4license plate program.

5(b) In addition to the regular fees for an original registration or
6renewal of registration, the following additional fees shall be paid
7for the issuance, transfer, or renewal of license plates bearing,
8notwithstanding Section 5060, a full-plate graphic design that
9depicts a significant feature or quality of the State of California,
10approved by the department in consultation with the California
11Arts Council:

12(1) For the original issuance of the plates, fifty dollars ($50).

13(2) For a renewal of registration of the plates, forty dollars ($40).

14(3) For the transfer of the special plates to another vehicle,
15fifteen dollars ($15).

16(4) In addition, for the issuance of an environmental license
17plate, as defined in Section 5103, with a full-plate graphic design,
18the additional fees prescribed in Sections 5106 and 5108. The
19additional fees prescribed in Sections 5106 and 5108 shall be
20deposited in thebegin insert Californiaend insert Environmental License Plate Fund.

21(c) Except as provided in paragraph (4) of subdivision (b), all
22fees collected under this section, after deduction of the
23department’s costs in administering this section, shall be deposited
24in the Graphic Design License Plate Account, which is hereby
25established in the General Fund. The funds in the account shall be
26used by the California Arts Council, upon appropriation by the
27Legislature, for arts education and local arts programming.

28(d) The California Arts Council shall use the revenue derived
29from the fee increases authorized by amendment of this section
30during the 2003-04 Regular Session exclusively for arts education
