BILL ANALYSIS Ó SB 814 Page 1 Date of Hearing: June 18, 2013 ASSEMBLY COMMITTEE ON WATER, PARKS AND WILDLIFE Anthony Rendon, Chair SB 814 (Senate Committee on Natural Resources and Water) - As Amended: June 10, 2013 SENATE VOTE : 34-0 SUBJECT : Public Resources: Administration SUMMARY : Authorizes a permit to take sea cucumbers to be transferred upon the death of the permit holder, and makes several technical non-substantive changes to update sections of law relating to the administrative authorities of the Department of Fish and Wildlife (DFW), the Department of Conservation (DOC), the State Mining and Geology Board (SMGB), and the California Coastal Commission (CCC). Specifically, this bill : 1) Authorizes a sea cucumber dive or trawl permit, upon the death of a sea cucumber permit holder, to be transferred by the deceased person's heirs, assignees, or estate to another qualified person, upon payment of a nonrefundable transfer fee to the DFW. 2) Deletes an obsolete reference to the Division of Recycling, which used to be part of the DOC, but whose functions are now part of the Department of Resources Recycling and Recovery (CalRecycle). 3) Makes other technical non-substantive changes to reflect the DFW's name change, and to update provisions of law regarding preparation and review of mining reclamation plans, designation of special geographic areas by the SMGB, and processes for review of coastal development plans by the CCC. EXISTING LAW : 1)Authorizes a permittee to transfer a sea cucumber permit, subject to specified conditions. 2)Establishes the DOC, the work of which is divided into the following divisions: the California Geological Survey; the Division of Oil, Gas, and Geothermal Resources; the Division SB 814 Page 2 of Land Resource Protection; and the Office of Mine Reclamation. 3)Provides procedures for the development and review of mining reclamation plans and coastal development plans. FISCAL EFFECT : According to the Senate Appropriations Committee, pursuant to Senate Rule 28.8, negligible state costs. COMMENTS : This is an omnibus clean-up bill authored by the Senate Natural Resources and Water Committee, and makes several technical changes to update various sections of law relating to public resource management. The only substantive provision authorizes the transfer of a sea cucumber permit upon the death of a permit holder.
