standards for vessels that discharge ballast water in the state,
makes minor clean-up amendments to various code section related
to public resources management.
Assembly Amendments add provisions authorizing, upon the death
of a sea cucumber permitholder, the deceased person's sea
cucumber dive or trawl permit to be transferred by his/her
heirs, assignees, or estate to a qualified person as provided,
upon payment of the fee; delay implementation of ballast water
performance standards for vessels that discharge ballast water
in the state; and make other clarifying and technical changes.
ANALYSIS :
Existing law:
1. Prohibits sea cucumbers from being taken, possessed aboard a
boat, or landed by a person for commercial purposes except
under a valid sea cucumber permit.
2. Authorizes a sea cucumber permit to be transferred if
specified conditions are met, including requiring that an
application for transfer be submitted to the Department of
Fish and Wildlife and the payment of a transfer fee.
3. Requires, under the Surface Mining and Reclamation Act of
1975 (Act), administered by the Department of Conservation,
every lead agency to adopt ordinances that establish
procedures for the review and approval of reclamation plans,
and, before approving a reclamation plan, to submit the plan
to the Director of Conservation. The Act prohibits a person,
with exceptions, from conducting surface mining operations
unless, among other things, a reclamation plan is submitted
to and approved by the lead agency for the operation.
4. Authorizes, under the Act, the State Mining and Geology Board
to designate specific geographic areas of the state as areas
of statewide or regional significance, as specified.
This bill:
1. Authorizes a cucumber fishing permit holder's estate to
transfer the decedent's permit to a qualified person.

2. Requires all vessels with a ballast water capacity of 1,500
to 5,000 metric tons to comply with the state's ballast water
discharge performance standards by January 1, 2016. Requires
all vessels with a ballast water capacity of less than 1,500
metric tons or a ballast water capacity greater than 5,000
metric tons, to comply with the performance standards by
January 1, 2018.
3. Makes minor clean up amendments to various code sections
related to public resources management.
