An act to amend Section 19605.74 of the Business and Professions Code, relating to horse racing.

Existing law generally provides for the distribution of funds collected from wagers on horse racing in California. In years that the Breeders’ Cup Championship series is conducted at a race meeting in California, existing law requires that specified amounts that would have otherwise been distributed to a purse account be made available to promote and sponsor the Breeders’ Cup.

This bill would instead specify that those amounts shall be made available to the organization operating the Breeders’ Cup Championship series for the purpose of promoting and supporting the Breeders’ Cup, including the payment of purses in Breeders’ Cup Championship races.

SECTION 1.  

Section 19605.74 of the Business and Professions

is amended to read:

19605.74.  

For every year that the organization operating the
4Breeders’ Cup Championship series chooses to conduct the
P2    1Breeders’ Cup at a race meeting in California, the following,
2notwithstanding any otherbegin delete provision ofend delete law, shall apply to the race
3meeting conducting the Breeders’ Cup races on days during which
4Breeders’ Cup races are conducted:

5(a) The amounts that would have otherwise been distributed to
6a purse account pursuant to subdivisions (a), (b), (c), and (d) of
7Section 19601.02 shall be made availablebegin insert to the organization
8operating the Breeders’ Cup Championship seriesend insert
for the purpose
9of promoting andbegin delete sponsoringend deletebegin insert supportingend insert the Breeders’ Cupbegin insert,
10including the payment of purses in Breeders’ Cup Championship

12(b) The thoroughbred racing association hosting the Breeders’
13Cup shall enter into a written agreement, in consultation and
14cooperation with the California Tourism Commission and the
15statewide marketing organization formed pursuant to Section
1619605.73, with the organization that operates the Breeders’ Cup
17regarding the manner in which the funds set aside to support and
18promote the Breeders’ Cup are to be expended.

19(c) Within 90 days after the holding of each Breeders’ Cup, a
20 written report shall be made to the board detailing the manner in
21which the set-aside funds were utilized to promote and support the
22Breeders’ Cup.
