           SUMMARY  

          This bill allows the City of Escalon to sell specified parcels  
          of land purchased with state park bond funds on the condition  
          that replacement property is acquired.  The bill also requires:

          1)The transfer to be consistent with the provisions of the Safe  
            Neighborhood Parks, Clean Water, Clean Air, and Coastal  
            Protection Bond Act of 2000 relating to transfers of property  
            acquired with the bond funds, and the City to submit to the  
            Department of Parks and Recreation (DPR) a proposal  
            demonstrating compliance with those provisions.

          2)The City to provide various information to DPR regarding the  
            sale, including price information of both the property being  
            sold and the replacement property, current appraisals of both  
            properties, a willing seller letter, a parcel map of and  
            conceptual site plan for the replacement property, and a  
            commitment by the City to develop the replacement property for  
            recreational purposes.

          3)DPR to determine that all of the conditions set forth in the  
            bill have been met before the sale of the original property or  
            the purchase of the replacement property can occur. 

           FISCAL EFFECT  

          Minor and absorbable costs to the Department of Parks and  
          Recreation to review documents and determine that conditions  
          governing the transfer have been met.

           1)Purpose  . This bill seeks to obtain the required legislative  
            authorization to allow the City to sell parcels of land  
            originally acquired in 2004 with state parkland bond funds  
            intended to create a new park adjacent to a planned housing  
            development. Due to the economic downturn the housing was  
            never built, leaving the City with remote undeveloped  
            parkland. The City would like to sell this land and instead  
            purchase alternate property to expand a park near its  
            community center.

           2)Prior Legislation  . The Legislature has authorized several  
            cities to transfer park property acquired or developed with  
            state bond funds to other public entities on the condition the  
            cities or other public entities provide replacement property:

             a)   AB 1732 (Hall), Chapter 191, Statutes of 2010, allowed  
               the City of Los Angeles to transfer to the Los Angeles  
               Unified School District (LAUSD) parkland acquired with park  
               bond funds and, in exchange, LAUSD provided replacement  
               parkland facilities.

             b)   AB 1457 (Baca), Chapter 852, Statutes of 2006, allowed  
               the City of San Bernardino to transfer Seccombe Lake Park  
               to the Redevelopment Agency of San Bernardino in exchange  
               for replacement park land within reasonable proximity of  
               Seccombe Lake Park.

             c)   AB 1864 (Matthews), Chapter 558, Statutes of 2006,  
               allowed the City of Merced to transfer up to three acres of  
               land in Fahrens Creek Park to the Merced City School  
               District to construct a new school, subject to the  
               provisions of the Public Park Preservation Act of 1971.
