SB 850, as amended, Block. Public postsecondary education: community college districts: baccalaureate degree pilot program.
Existing law establishes the California Community Colleges, under the administration of the Board of Governors of the California Community Colleges, as one of the segments of public postsecondary education in this state. Existing law requires the boardbegin insert of governorsend insert to appoint a chief executive officer, to be known as the Chancellor of the California Community Colleges. Existing law establishes community college districts, administered by governing boards, throughout the state, and authorizes these districts to provide instruction to students at the community college campuses maintained by the districts.
Existing law requires community colleges to offer instruction through, but not beyond, the 2nd year of college and authorizes community colleges to grant associate degrees in arts and science.
This bill would authorize thebegin delete Chancellor of the California Community Collegesend deletebegin insert board of governors, in consultation with the California State University and the University of California,end insert tobegin delete authorize the establishment of oneend deletebegin insert establish aend insert baccalaureate degree pilot programbegin delete per campus per district. The bill would provide that the baccalaureate degree pilot program shall consist of a limited number of campuses,end deletebegin insert
at not more than 20 community college districts,end insert to be determined by thebegin delete Chancellor.end deletebegin insert chancellor and approved by the board of governors, which would authorize each participating campus within the district to offer one type of baccalaureate degree, as specified.end insert The bill would require a baccalaureate degree pilot program to expire 8 years after the establishment of the program. The bill would require a participatingbegin insert community collegeend insert district to meet specified requirements, including, but not limited to, offering baccalaureate degrees inbegin delete a limited number of fields of study,end deletebegin insert
subject areas with unmet workforce needs, as specified,end insert and submitting a report to thebegin delete Legislatureend deletebegin insert
chancellorend insert at least one year prior to the expiration of the baccalaureate degree pilot programbegin insert or one year after the first graduating class, whichever occurs first,end insert that would evaluate specified factors.
This bill would also require the governing board of a participatingbegin insert community collegeend insert district tobegin delete perform certain functionsend deletebegin insert submit certain information for review by the chancellor and approval by the board of governors, including the proposed governance system of the baccalaureate degree pilot program,end insert and wouldbegin delete authorize the governing board to charge baccalaureate degree-seeking students a fee for enrollment
in specified courses, which would be required to be expended for the purpose of providing a pilot program. The bill wouldend delete authorize the governing board ofbegin delete theend deletebegin insert a community collegeend insert district to enter into agreements with local businesses and agencies to provide educational services to students participating in a baccalaureate degree pilot program.begin insert The bill would provide that the board of governors shall develop and adopt by regulation a funding model for the support of the baccalaureate degree pilot programs, as specified.end insert

The Legislature finds and declares all of the
2following:
P3 1(a) California needs to produce one million more baccalaureate

3economically competitive in the coming decades.
4(b) The 21st century workplace increasingly demands a higher
5level of education in applied fields.
6(c) There is demand for education beyond the associate
degree
7level in specific academic disciplines that is not currently being
8met by California’s four-year public institutions.
9(d) Community colleges can help fill the gaps in our higher
10education system by granting baccalaureate degreesbegin delete forend deletebegin insert inend insert a limited
11number of specific areas in order to meet a growing demand for a
12skilled workforce.
13(e) These baccalaureate programs will be limited and will not
14begin insert in any wayend insert detract from the community colleges’begin insert
traditionalend insert
15 mission to advance California’s economic growth and global
16competitiveness through education, training, and services that
17contribute to continuous workforce improvement, nor willbegin delete theend delete
18begin insert theseend insert programs unnecessarily duplicate similar programs offered
19by nearbybegin insert
publicend insert four-year institutions.
20(f) Community colleges can provide a quality baccalaureate
21educationbegin delete with lower costs to their students than a traditional begin insert to their students,end insert enabling place-bound local
22four-year university,end delete
23studentsbegin insert and military veteransend insert the opportunity to earn the
24baccalaureate degree needed for new job opportunities and
25promotion.
26(g) Twenty-one other states, from Florida to Hawaii, already
27allow their community colleges to offer baccalaureate degrees.
28California is one of the most innovative states in the nation, and
29the California
Community Colleges will use that same innovative
30spirit to produce morebegin delete health, biotechnology, and other needed begin insert professionals in health, biotechnology, public safety,
31professionals.end delete
32and other needed fields.end insert
Article 3 (commencing with Section 78040) is added
34to Chapter 1 of Part 48 of Division 7 of Title 3 of the Education
35Code, to read:

Forbegin delete theend delete purposes of this article, “district” means any
40community college district identified by the Chancellor of the

2baccalaureate degree pilot program. Each district may establish
3baccalaureate degree pilot programs pursuant to Section 78041.
Notwithstanding Section 66010.4, thebegin delete Chancellor of begin insert Board of Governors of the
5the California Community Collegesend delete
6California Community Colleges, in consultation with the California
7State University and the University of California,end insert may authorize
8the establishment of baccalaureate degree pilot programs that meet
9all of the eligibility requirements set forth in Section 78042. A
10pilot program established pursuant to this section shall expire eight
11years after the establishment of the program. For purposes of this
12section, a pilot program is established when the first class of
13students begins the program.
The baccalaureate degree pilot
14program shall consist of abegin delete limited number of campuses,end deletebegin insert maximum
15of twenty districts,end insert to be determined by the Chancellor of the
16California Communitybegin delete Colleges.end deletebegin insert Colleges and authorized by the
17Board of Governors of the California Community Colleges.end insert

19offer baccalaureate degree programs through the appropriate
20accreditation body.

authorization from the Board of
22Governors of the California Community Colleges, a end insertdistrict shall
23maintain the primary mission of the California Community
24Colleges specified in paragraph (3) of subdivision (a) of Section
2566010.4. The district, as part of the baccalaureate degree pilot
26program, shall have the additional mission to provide high-quality
27undergraduate education at an affordable price for students and
28the state.

end insertdistrict shall have the expertise, resources, and student
6interest to offer a quality baccalaureate degree in the chosen field
7of study.
8(d) begin deleteThe end deletebegin insertA end insertdistrict shall maintain separate records for students
9who are enrolled in courses classified in the upper division and
10lower division of a baccalaureate program. A student shall be
11reported as a community college student for enrollment in a lower
12division course and as a baccalaureate degree program student for
13enrollment in an upper division course.
14(e) The governing board of the district shall do all of the
15following:
16(e) A governing board of a district seeking authorization to offer
17a baccalaureate degree pilot program shall submit all of the
18following for review by the Chancellor of the California
19Community Colleges and approval by the Board of Governors of
20the California Community Colleges:

26appropriate costs end delete
27in a baccalaureate degree program.
28(f) (1) The governing board of the district may charge
29baccalaureate degree-seeking
students a fee, of an amount to be
30determined by the governing board, that covers the additional costs
31imposed by providing a baccalaureate degree pilot program, for
32enrollment in courses that are not transfer core curriculum courses,
33as defined in Section 66720.
34(f) (1) The Board of Governors of the California Community
35Colleges shall develop and adopt by regulation a funding model
36for the support of the baccalaureate degree pilot programs that is
37based on a calculation of the number of full-time equivalent
38students enrolled in the pilot programs.
39(2) All fees collected pursuant to this subdivision shall be
40deposited in the designated fund of the district in accordance with
P6 1the California Community Colleges Budget and Accounting
2Manual, and shall be expended for the purpose of providing a
3baccalaureate degree pilot program.
4(2) Funding for each full-time equivalent student shall be at an
5agreed upon marginal cost calculation that shall not exceed the
6California State Universities marginal cost calculation.
7(3) Each student in the baccalaureate degree pilot programs
8authorized by this article shall not be charged fees higher than
9the mandatory systemwide fees charged for baccalaureate degree
10programs at the California State University.
11(4) Fees for upper division coursework in the baccalaureate
12degree pilot programs shall be set and approved by the Legislature
13in a manner consistent with the setting of fees for lower division
14coursework at the California community colleges.
15(g) The governing board ofbegin delete theend deletebegin insert
aend insert district may enter into
16agreements with local businesses and agencies to provide
17educational services to students participating inbegin delete theend deletebegin insert aend insert baccalaureate
18degree pilot program.
19(h) begin deleteThe district shall submit a report to the Legislature end deletebegin insertA district
20that received authorization to offer a baccalaureate degree pilot
21program shall submit a report to the Chancellor of the California
22Community Colleges end insertat least one year prior to the expiration of
23the baccalaureate degree pilot program pursuant to Sectionbegin delete 78041.end delete
24begin insert
78041 or one year after the first graduating class of the
25baccalaureate degree pilot programend insertbegin insert, whichever occurs first.end insert The
26report shall examine the success of the baccalaureate degree pilot
27program by evaluating all of the following factors:
28(1) The percentage of students who complete a baccalaureate
29degree, calculated by dividing the number of students who graduate
30from the baccalaureate degree pilot program by the number of
31students who enrolled in the program.
32(2) The extent to which the baccalaureate degree pilot program
33is self-supporting, such that the student fees charged pursuant to
34subdivision (f) cover the costs of the program.
35(3) Whether there is a problem
with finding and paying
36instructors for the baccalaureate degree pilot program.
37(4) Whether there was a decline in enrollmentbegin delete in theend deletebegin insert atend insert
38 California State Universitybegin delete and theend deletebegin insert
orend insert University of Californiabegin delete as begin insert campuses in the regions served by the district as a directend insert result

40of the baccalaureate degree pilot program.
P7 1(5) The number of students who received jobs in the area in the
2field of study of their baccalaureate degree.
3(6) The amount of student fees charged pursuant to subdivision
4(f) compared to the amount of student fees charged for courses at
5the California State University and the University of California.
6(i) A report submitted pursuant to subdivision (h) shall be
7submitted in compliance with Section 9795 of the Government
8Code.
