   An act to amend Section 4501 of the Penal Code, relating to
assault.



	LEGISLATIVE COUNSEL'S DIGEST


   SB 905, as introduced, Knight. Assault: force likely to produce
great bodily injury.
   Existing law provides that, except as specified, every person
confined in a state prison who commits an assault upon the person of
another with a deadly weapon or instrument, or by any means of force
likely to produce bodily injury, shall be guilty of a felony and
punished by imprisonment in the state prison for 2, 4, or 6 years.
   This bill would make technical, nonsubstantive changes to these
provisions.
   Vote: majority. Appropriation: no. Fiscal committee: no.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section 4501 of the Penal Code is amended to read:
   4501.   (a)  Except as provided in Section 4500, every
person confined in a state prison of this state who commits an
assault upon the person of another with a deadly weapon or 
instrument, or by any means of force likely to produce great bodily
injury,   instrument  shall be guilty of a felony
and shall be imprisoned in the state prison for two, four, or six
years to be served consecutively. 
   (b) Except as provided in Section 4500, every person confined in a
state prison of this state who commits an assault upon the person of
another by any means of force likely to produce great bodily injury
shall be guilty of a felony and shall be imprisoned in the state
prison for two, four, or six years to be served consecutively.
