An act to amend Section 4501 of the Penal Code, relating to assault.

SB 905, Knight. Assault: force likely to produce great bodily injury.

Existing law provides that, except as specified, every person confined in the state prison who commits an assault upon the person of another with a deadly weapon or instrument, or by any means of force likely to produce bodily injury, shall be guilty of a felony and punished by imprisonment in the state prison for 2, 4, or 6 years.

This bill would make technical, nonsubstantive changes to these provisions.

The people of the State of California do enact as follows:

SECTION 1.  

Section 4501 of the Penal Code is amended to read:

4501.  

(a) Except as provided in Section 4500, every person confined in a state prison of this state who commits an assault upon the person of another with a deadly weapon or instrument shall be guilty of a felony and shall be imprisoned in the state prison for two, four, or six years to be served consecutively.

(b) Except as provided in Section 4500, every person confined in a state prison of this state who commits an assault upon the person of another by any means of force likely to produce great bodily injury shall be guilty of a felony and shall be imprisoned in the state prison for two, four, or six years to be served consecutively.
