Existing law establishes the Dental Hygiene Committee of California, within the jurisdiction of the Dental Board of California, and provides for the appointment of the committee members. Existing law requires the committee to administer the laws regulating dental hygienists. Under existing law those provisions remain in effect only until January 1, 2015.
This bill would extend the operation of those provisions until January 1, 2019.

The people of the State of California do enact as follows:
Section 1901 of the Business and Professions
2Code is amended to read:
(a) There is hereby created within the jurisdiction of the
4Dental Board of California a Dental Hygiene Committee of
5California in which the administration of this article is vested.
P2 1(b) This section shall remain in effect only until January 1,begin delete 2015end delete
2begin insert 2019end insert, and as of that date is repealed, unless a later enacted statute,
3that is enacted before January 1,begin delete 2015end deletebegin insert 2019end insert, deletes or
extends
4that date. Notwithstanding any otherbegin delete provision ofend delete law, the repeal
5of this section renders the committee subject to review by the
6appropriate policy committees of the Legislature.
Section 1903 of the Business and Professions Code is
8amended to read:
(a) (1) The committee shall consist of nine members
10appointed by the Governor. Four shall be public members, one
11member shall be a practicing general or public health dentist who
12holds a current license in California, and four members shall be
13registered dental hygienists who hold current licenses in California.
14Of the registered dental hygienists members, one shall be licensed
15either in alternative practice or in extended functions, one shall be
16a dental hygiene educator, and two shall be registered dental
17hygienists. No public member shall have been licensed under this
18chapter within five years of the date of his or her appointment or
19have any current financial interest in a dental-related business.
20(2) For purposes of this subdivision, a
public health dentist is
21a dentist whose primary employer or place of employment is in
22any of the following:
23(A) A primary care clinic licensed under subdivision (a) of
24Section 1204 of the Health and Safety Code.
25(B) A primary care clinic exempt from licensure pursuant to
26subdivision (c) of Section 1206 of the Health and Safety Code.
27(C) A clinic owned or operated by a public hospital or health
28system.
29(D) A clinic owned and operated by a hospital that maintains
30the primary contract with a county government to fill the county’s
31role under Section 17000 of the Welfare and Institutions Code.
32(b) (1) Except as specified in paragraph (2), members of the
33committee shall be
appointed for a term of four years. Each
34member shall hold office until the appointment and qualification
35of his or her successor or until one year shall have lapsed since
36the expiration of the term for which he or she was appointed,
37whichever comes first.
38(2) For the term commencing on January 1, 2012, two of the
39public members, the general or public health dentist member, and
40two of the registered dental hygienist members, other than the
P3 1dental hygiene educator member or the registered dental hygienist
2member licensed in alternative practice or in extended functions,
3shall each serve a term of two years, expiring January 1, 2014.
4(c) Notwithstanding any other provision of law and subject to
5subdivision (e), the Governor may appoint to the committee a
6person who previously served as a member of the committee even
7if his or her previous term expired.
8(d) The committee shall elect a president, a vice president, and
9a secretary from its membership.
10(e) No person shall serve as a member of the committee for
11more than two consecutive terms.
12(f) A vacancy in the committee shall be filled by appointment
13to the unexpired term.
14(g) Each member of the committee shall receive a per diem and
15expenses as provided in Section 103.
16(h) The Governor shall have the power to remove any member
17from the committee for neglect of a duty required by law, for
18incompetence, or for unprofessional or dishonorable conduct.
19(i) The committee, with the approval of the director, may appoint
20a person
exempt from civil service who shall be designated as an
21executive officer and who shall exercise the powers and perform
22the duties delegated by the committee and vested in him or her by
23this article.
24(j) This section shall remain in effect only until January 1,begin delete 2015end delete
25begin insert 2019end insert, and as of that date is repealed, unless a later enacted statute,
26that is enacted before January 1,begin delete 2015end deletebegin insert 2019end insert, deletes or extends
27that date.
