   An act to add Section  20103.9   20112.5
 to the Public Contract Code, relating to public contracts.


	LEGISLATIVE COUNSEL'S DIGEST


   SB 1347, as amended, Anderson. Public contracts:  local
agencies.   school districts. 
   The Local Agency Public Construction Act establishes contracting
by local agencies for the construction of public works. Existing law
regulates the procedures by which a  local agency 
 school district  awards public works contracts.
   This bill would require a  local agency to timely post on
  school district, at the next regular update of 
its Internet Web  site   site, to post on that
site  a copy of any final public works contract awarded at a
cost of $5,000 or more. By imposing an additional duty upon
local governments   school districts  in the
posting of  local agency  public works contracts,
this bill would impose a state-mandated local program.
   The California Constitution requires the state to reimburse local
agencies and school districts for certain costs mandated by the
state. Statutory provisions establish procedures for making that
reimbursement.
   This bill would provide that, if the Commission on State Mandates
determines that the bill contains costs mandated by the state,
reimbursement for those costs shall be made pursuant to these
statutory provisions.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section  20103.9   20112.5 
is added to the Public Contract Code, to read:
    20103.9.   20112.5.   A  local
agency   school district  subject to this 
chapter   article  that is taking bids for the
construction of a public work or improvement costing five thousand
dollars ($5,000) or more  shall post, in a timely fashion, on
  shall, at the next regular update of  the
 local agency's   school district's 
Internet Web site  , post on that site  a copy of each final
contract awarded.
  SEC. 2.  If the Commission on State Mandates determines that this
act contains costs mandated by the state, reimbursement to local
agencies and school districts for those costs shall be made pursuant
to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of
the Government Code.
