An act to amend Section 73.01 of the Streets and Highways Code, relating to highways.

SB 1368, as introduced, Wolk. State highways: relinquishment.

Existing law gives the Department of Transportation full possession and control of all state highways. Existing law provides for the relinquishment of state highways or portions of state highways to any county or city by the California Transportation Commission in accordance with specified criteria and procedures. Existing law, in addition, authorizes the commission to relinquish to a county transportation commission or regional transportation planning agency a park-and-ride lot within their respective jurisdictions, if the department enters into an agreement with the county transportation commission or regional transportation planning agency providing for that relinquishment and other conditions are satisfied.

This bill would also authorize the commission to relinquish a park-and-ride lot to a joint powers authority formed for purposes of providing transportation services in the manner described above.

The people of the State of California do enact as follows:

SECTION 1.  

Section 73.01 of the Streets and Highways Code
2 is amended to read:

73.01.  

The commission may relinquish to a county
2transportation commission created pursuant to Chapter 1
3(commencing with Section 130000) of Division 12 of the Public
4Utilities Code,begin insert a joint powers authority formed for purposes of
5providing transportation services,end insert
orbegin insert aend insert regional transportation
6planning agency, a park-and-ride lot within their respective
7jurisdictions, on terms and conditions that the commission finds
8to be within the best interests of the state, if the department enters
9into an agreement with the county transportationbegin delete commissionend delete
10begin insert commission, joint powers authority,end insert or regional transportation
11planning agency providing for that relinquishment. The county
12transportationbegin delete commissionend deletebegin insert commission, joint powers authority,end insert or
13regional transportation planning agency requesting the
14relinquishment shall agree to maintain, at a minimum, the number
15of parking spaces provided by the department in the lot at the time
16of relinquishment. Any such relinquishment shall become effective
17on the date following the county recorder’s recordation of the
18relinquishment resolution containing the commission’s approval
19of the terms and conditions of the relinquishment.
