Existing law, the Dental Practice Act, provides for the licensure and regulation of the practice of dentistry by the Dental Board of California. The act, among other things, requires the board to examine all applicants for a license to practice dentistry and to collect and apply all fees, as specified.begin insert The act requires the charges and fees for licensed dentists to be established by the board as is necessary for the purpose of carrying out the responsibilities required by these provisions, subject to specified limitations. Existing law prohibits the fee for an initial license and for the renewal of the license from exceeding $450.end insert

The Legislature finds and declares all of the
2following:

3(a) It is necessary for the initial license and license renewal fee
4for dentists to be increased to five hundred twenty-five dollars
5($525) in order for the Dental Board of California to continue its
6licensing, regulatory, and disciplinary functions.

7(b) Failure to increase the fee amount will result in spending
8reductions that will cause delays in processing times for license
9applications, consumer complaints, investigations, and disciplinary
10actions.

1724.  

The amount of charges and fees for dentists licensed
14pursuant to this chapter shall be established by the board as is
15necessary for the purpose of carrying out the responsibilities
16required by this chapter as it relates to dentists, subject to the
17following limitations:

18(a) The fee for application for examination shall not exceed five
19hundred dollars ($500).

20(b) The fee for application for reexamination shall not exceed
21one hundred dollars ($100).

22(c) The fee for examination and for reexamination shall not
23exceed eight hundred dollars ($800). Applicants who are found to
24be ineligible to take the examination shall be entitled to a refund
25in an amount fixed by the board.

26(d) The fee for an initial license and for the renewal of a license
27shall not exceedbegin delete four hundred fifty dollars ($450)end deletebegin insert five hundred
28twentyend insert

29(e) The fee for a special permit shall not exceed three hundred
30dollars ($300), and the renewal fee for a special permit shall not
31exceed one hundred dollars ($100).

32(f) The delinquency fee shall be the amount prescribed by
33Section 163.5.

34(g) The penalty for late registration of change of place of
35practice shall not exceed seventy-five dollars ($75).

36(h) The application fee for permission to conduct an additional
37place of practice shall not exceed two hundred dollars ($200).

P3    1(i) The renewal fee for an additional place of practice shall not
2exceed one hundred dollars ($100).

3(j) The fee for issuance of a substitute certificate shall not exceed
4one hundred twenty-five dollars ($125).

5(k) The fee for a provider of continuing education shall not
6exceed two hundred fifty dollars ($250) per year.

7(l) The fee for application for a referral service permit and for
8renewal of that permit shall not exceed twenty-five dollars ($25).

9(m) The fee for application for an extramural facility permit
10and for the renewal of a permit shall not exceed twenty-five dollars
11($25).

12The board shall report to the appropriate fiscal committees of
13each house of the Legislature whenever the board increases any
14fee pursuant to this section and shall specify the rationale and
15justification for that increase.

SECTION 1.  

Section 1611 of the Business and Professions
17Code
is amended to read:

1611.  

The board shall carry out the purposes and enforce the
19provisions of this chapter. The board shall examine all applicants
20for a license to practice dentistry according to the provisions of
21this chapter and shall issue licenses to practice dentistry in this
22state to those applicants who successfully pass the examination of
23the board and otherwise comply with the provisions of this chapter.
24The board shall collect and apply all fees as directed by this
25chapter.
