An act to amend Section 1724 of the Business and Professions Code, relating to dentistry.

Existing law, the Dental Practice Act, provides for the licensure and regulation of the practice of dentistry by the Dental Board of California. The act, among other things, requires the board to examine all applicants for a license to practice dentistry and to collect and apply all fees, as specified. The act requires the charges and fees for licensed dentists to be established by the board as is necessary for the purpose of carrying out the responsibilities required by these provisions, subject to specified limitations. Existing law prohibits the fee for an initial license and for the renewal of the license from exceeding $450.

The people of the State of California do enact as follows:

SECTION 1.  

The Legislature finds and declares all of the
2following:

P2    1(a) It is necessary for the initial license and license renewal fee
2for dentists to be increased to five hundred twenty-five dollars
3($525) in order for the Dental Board of California to continue its
4licensing, regulatory, and disciplinary functions.

5(b) Failure to increase the fee amount will result in spending
6reductions that will cause delays in processing times for license
7applications, consumer complaints, investigations, and disciplinary
8actions.

SEC. 2.  

Section 1724 of the Business and Professions Code is
10amended to read:

1724.  

The amount of charges and fees for dentists licensed
12pursuant to this chapter shall be established by the board as is
13necessary for the purpose of carrying out the responsibilities
14required by this chapter as it relates to dentists, subject to the
15following limitations:

16(a) The fee for application for examination shall not exceed five
17hundred dollars ($500).

18(b) The fee for application for reexamination shall not exceed
19one hundred dollars ($100).

20(c) The fee for examination and for reexamination shall not
21exceed eight hundred dollars ($800). Applicants who are found to
22be ineligible to take the examination shall be entitled to a refund
23in an amount fixed by the board.

24(d) The fee for an initial license and for the renewal of a license
25begin deleteshall not exceedend deletebegin insert isend insert five hundred twenty-five dollars ($525).

26(e) The fee for a special permit shall not exceed three hundred
27dollars ($300), and the renewal fee for a special permit shall not
28exceed one hundred dollars ($100).

29(f) The delinquency fee shall be the amount prescribed by
30Section 163.5.

31(g) The penalty for late registration of change of place of
32practice shall not exceed seventy-five dollars ($75).

33(h) The application fee for permission to conduct an additional
34place of practice shall not exceed two hundred dollars ($200).

35(i) The renewal fee for an additional place of practice shall not
36exceed one hundred dollars ($100).

37(j) The fee for issuance of a substitute certificate shall not exceed
38one hundred twenty-five dollars ($125).

39(k) The fee for a provider of continuing education shall not
40exceed two hundred fifty dollars ($250) per year.

P3    1(l) The fee for application for a referral service permit and for
2renewal of that permit shall not exceed twenty-five dollars ($25).

3(m) The fee for application for an extramural facility permit
4and for the renewal of a permit shall not exceed twenty-five dollars
5($25).

6The board shall report to the appropriate fiscal committees of
7each house of the Legislature whenever the board increases any
8fee pursuant to this section and shall specify the rationale and
9justification for that increase.
