Under existing law, a person may not stop, park, or leave a vehicle standing alongside a curb space authorized for the loading or unloading of passengers of a bus engaged as a common carrier in local transportation when indicated by a sign or red paint on the curb, except that existing law allows local authorities to permit schoolbuses to stop alongside these curb spaces upon agreement between a transit system operating buses as common carriers in local transportation and a public school district or private school.
This bill would also allow local authorities to permit shuttle service vehicles, as defined, to stop for the loading or unloading of passengers alongside these curb spaces upon agreement between a transit system operating buses engaged as common carriers in local transportation and a shuttle service provider, as defined.begin insert The bill would state that it is the intent of the Legislature to not replace public transit services.end insert

The people of the State of California do enact as follows:
begin insertIt is the intent of the Legislature, in allowing local
2authorities to permit shuttle service vehicles to utilize designated
3transit system curb spaces, to not replace public transit services.
4The Legislature finds and declares that this act applies only to
5shuttle services that do not offer services to the general public as
6common carriers.end insert
Section 22500.5 of the Vehicle Code is amended to
9read:
(a) Upon agreement between a transit system
11operating buses engaged as common carriers in local transportation
12and a public school district or private school, local authorities may,
13by ordinance, permit schoolbuses owned by, or operated under
14contract for, that public school district or private school to stop
15for the loading or unloading of passengers alongside any or all
16curb spaces designated for the loading or unloading of passengers
17of the transit system buses.
18(b) Upon agreement between a transit system operating buses
19engaged as common carriers in local transportation and a shuttle
20service provider, local authorities may, by ordinance or resolution,
21permit shuttle service vehicles
to stop for the loading or unloading
22of passengers alongside any or all curb spaces designated for the
23loading or unloading of passengers of the transit system buses.
24(1) As used in this subdivision, “shuttle service vehicle” means
25a motor vehicle designed, used, or maintained by or for a
26charter-party carrier of passengers, as defined in Section 5360 of
27the Public Utilities Code, or a passenger stage corporation, as
28defined in Section 226 of the Public Utilities Code, or any highway
29carrier of passengers required to register with the Public Utilities
30Commission.
31(2) As used in this subdivision, “shuttle service” means
32transportation by private vehicles offered for the exclusive or
33primary use of a discrete group, including, but not limited to,
34clients, patients, students, paid
or unpaid staff, visitors, or residents,
35between an organization or entity’s facilities or between the
P3 1organization or entity’s facilities and other locations, on a regularly
2scheduled basis.
3(3) As used in this subdivision, “shuttle service provider” means
4any person using shuttle service vehicles to provide shuttle service.
