          SUBJECT:  State employees:  reinstatement after military service


          SUMMARY:  Ensures that state civil service employees who work on  
          an hourly basis are able to reinstate upon returning from active  
          military duty, as specified.  Specifically, this bill: 


          1)Requires that an employee who is paid hourly and reinstates  
            after termination of military service be given the same shift  
            and number of work hours as the employee had prior to going on  
            military leave. 
          EXISTING LAW:  


          1)Defines military leaves of 6 months or less as "short-term"  
            and those lasting more than 6 months as "long-term."

          2)Requires that a state employee on a long-term military leave  
            who returns to state service within six months after  
            termination of military service be reinstated, as specified.



          3)Requires that a state employee on a short-term military leave  
            who returns to state service within 10 days after termination  
            of military service be reinstated, as specified.

          FISCAL EFFECT:  Unknown.


          COMMENTS:  The State Civil Service Act provides reinstatement  
          benefits to permanent, probationary, and exempt employees  
          returning home from active duty military service.  


          According to the author, "Hourly employees are not granted the  
          same courtesy, and some return home to find they have an  
          employer, but no hours of work, and therefore no income.  As  
          permanent hourly employees are becoming more traditional for the  
          State, it is only fitting that we fix this loophole in which  
          some of our service members are falling victim."


          The author concludes, "Californian is home to the highest  
          percentage of veterans in the United States.  Our State agencies  
          should strive to be an example for the country when it comes to  
          ensuring women and men returning home from deployment have their  
          jobs returned to them."
